This is the last Will and Testament of me Richard Head of Chobham in the 
County of Surrey Farmer as follows (that is to say)  In the first place I direct 
that all such debts as I shall justly owe at the time of my decease together with 
my funeral and testamentary charges and expences be fully paid and satisfied 
by my Executors hereinafter named   I give and bequeath unto my wife 
Elizabeth Head the sum of Twenty pounds and I direct the same to be paid her 
within one Calendar month after my decease  I give and bequeath all and 
singular my personal estate and effects whatsoever and of what nature or kind 
soever unto my friends Zachariah Turner of the said Parish of Chobham 
Farmer and James Hayward of Sunbury in the County of Middlesex Grocer 
their executors administrators or assigns Upon Trust to make sale of and 
convert into money all such part or parts thereof as shall not consist of money 
or securities for money and to call in and compel payment of all such parts 
thereof as shall consist of money out upon security at interest or otherwise 
And also to collect and get in all book and other debts which shall be owing to 
me at the time of my decease in such manner as they or he shall think fit  And I 
hereby declare and direct that the said Zachariah Turner and James Hayward 
and the survivor of them and the executors and administrators of such survivor 
shall stand and be possessed of the monies I may be entitled to at the time of 
my decease and the monies to arise from the sale and conversion of my said 
personal estate Upon the Trusts and for the interests and purposes hereinafter 
declared of and concerning the money to arise by the sale of my real estate  
And as to and concerning all that my messuage or tenement barn stable 
outhouses yards gardens and appurtenances and the several pieces or parcels 
of land thereunto belonging containing altogether by estimation Seven acres 
(more or less) situate lying and being at and near Burrow Hill in the said Parish 
of Chobham  and now in my own occupation Together with all other my real 
estate whatsoever and wheresoever situate lying or being with their rights 
members and appurtenances I give and devise the same unto and To the use 
of the said Zachariah Turner and James Hayward their heirs and assigns for 
ever  Upon Trust that they the said Zachariah Turner and James Hayward and 
the survivor of them and the heirs and assigns of such survivor do and shall 
when and as soon as they or he in their or his absolute discretion shall think fit 
after my decease sell and absolutely dispose of the same either together or in 
parcels and either by public sale or private contract as to them or him shall 
seem best for the most money that can be reasonably obtained for the same 
And I hereby declare that it shall be lawful for the said Zachariah Turner and 
James Hayward and the survivor of them and the heirs and assigns of such 
survivor on any such sale or sales to make any stipulations as to the Title to be 
produced to the said hereditaments or any part or parts thereof and to buy in 
the same premises or any part or parts thereof  And to alter or rescind any 
Contract for the sale thereof or any part thereof and to resell the same without 
being liable for any loss to be occasioned thereby and also do and shall make 
execute and perfect all necessary or proper Deeds writings conveyances 
surrenders and assurances for the purpose of vesting the same in any 
purchaser or purchasers thereof or in such person or persons as he she or they 
shall direct or appoint  And I hereby declare and direct that the receipt or 
receipts of the said Zachariah Turner and James Hayward and the survivor of 
them and the heirs and assigns of such survivor shall be a good valid and 
sufficient acquittance and discharge or good valid and sufficient acquittances 
and discharges for all or any monies payable to them or him under the Trusts 
of this my Will  And that no purchaser or purchasers or other person or 
persons after obtaining such receipt or receipts shall be obliged to see to the 
application or be answerable for the misapplication or nonapplication of such 
purchase money or any part thereof  And I do hereby further will and direct 
that the said Zachariah Turner and James Hayward and the survivor of them 
and the heirs and assigns of such survivor do and shall stand possessed of and 
interested in the money to arise by the sale of my said real estate and also of 
the monies I may be entitled to at the time of my decease and of the monies to 
arise by the sale and conversion of my said personal estate Upon Trust in the 
first place to pay my just debts and my funeral and testamentary charges and 
expences and the Legacy hereinbefore bequeathed and subject thereto Upon 
Trust to lay out and invest the same in their or his names or name in the 
purchase of a competent share or competent shares of any of the 
parliamentary stocks or public funds of Great Britain or at interest upon 
Government or real securities in England or Wales but not in Ireland with 
power to alter vary or transpose the said stocks funds or securities into or for 
other stocks funds or securities of the same or a like nature at their or his 
discretion And do and shall stand possessed of and interested in the said Trust 
monies and the stocks funds and securities on which the same may be invested 
Upon Trust that they the said Zachariah Turner and James Hayward and the 
survivor of them and the heirs and assigns of such survivor do and shall pay the 
interest dividends and annual produce thereof unto or permit the same to be 
received by my said wife Elizabeth Head and her assigns during the term of her 
natural life And from and immediately after her decease do and shall stand and 
be possessed of and interested in the said Trust monies and the stocks funds 
and securities and the dividends interest and annual proceeds thereof In Trust 
for all and every my children and child living at my decease to be divided 
between them in equal shares and proportions as Tenants in common  And I 
declare my will to be that in case any of my children shall die in my lifetime 
leaving lawful issue who being a male or males shall attain the age of Twenty 
one years or being a female or females shall attain that age or marry Then I 
declare and direct that my said Trustee or Trustees shall stand possessed of 
the share of such child or children so dying in my lifetime as well original as 
outrising In Trust for such issue to be divided between such issue if more than 
one in equal shares as Tenants in common in a course of Distribution according 
to the stocks and not to the number of individual objects and so that the issue 
of such of my said children as shall die in my lifetime shall take by way of 
substitution the share or respective shares only which the parent or respective 
parents would if living have taken  And I hereby further declare my will to be 
that in the mean time and until the said real and personal estate hereinbefore 
directed to be sold and converted into money shall have been so sold and 
converted into money the said Zachariah Turner and James Hayward and the 
survivor of them his heirs executives and administrators respectively do and 
shall pay and apply the rents and profits interest dividends and annual produce 
of the said real and personal estate or so much thereof respectively as for the 
time being shall not have been sold or converted into money (after payment 
thereout of all rates taxes premiums for Insurance against loss by fire costs of 
repairs and other outgoings which any Tenant or Tenants or any other person 
or persons shall not be liable to pay) to the persons for the purposes and in the 
manner to whom and for and in which the interest dividends and annual 
produce of the monies to arise from the sale or conversion into money thereof 
or the stocks funds or securities in or upon which the same monies are 
hereinbefore directed to be invested would be payable or applicable under the 
Trusts hereinbefore declared and contained in case the sale or conversion into 
money and investment aforesaid were then actually made Provided always 
and I do hereby declare that if the Trustees hereby appointed or either of them 
or any future Trustee of this my will shall die or be desirous of being 
discharged from or refuse or become incapable to act in the Trusts hereby 
created then and as often as the same shall happen it shall be lawful for the 
surviving or continuing Trustee of this my will or the executors or 
administrators of the surviving or continuing Trustee by any writing or writings 
to appoint a new Trustee or new Trustees and that upon every such 
appointment all the Trust premises shall be conveyed assigned and transferred 
respectively in such manner as that the same may be effectually vested in such 
new Trustee or new Trustees solely or jointly with the surviving or continuing 
Trustee  And I hereby declare that the Trustees or Trustee for the time being 
under this my will shall not be answerable the one for the other of them and 
by no means for involuntary losses And that it shall be lawful for such Trustees 
or Trustee for the time being to reimburse themselves out of the monies which 
shall come to their hands by virtue of the Trusts aforesaid all their costs and 
expences in the execution of the said Trusts And lastly I do nominate and 
appoint the said Zachariah Turner and James Hayward Executors of this my will 
hereby  revoking and making void all former and other will and wills by me at 
any time heretofore made and do declare this only to be my last Will and 
Testament  In witness whereof  I the said Richard Head the Testator have to 
each sheet of this my last Will and Testament contained in this and the three 
preceding sheets of paper set my hand this eighteenth day of September in the 
year of our Lord one thousand eight hundred and fifty one  The mark of
