In the name of God Amen.  I James Jelly of Wokeing in the County of Surry 
Carpenter being sick and weak in Body butt of sound & perfect mind memory 
& understanding praised be almighty God for the same  Do make publish and 
declare this to be my last will & Testamt in manner following (that is to say)  
First and principally I comend my soule into the hands of Almighty God 
hopeing through the merritts Death & passion of my only saviour and 
Redeemer Jesus Christ to have full remission for all my sins my body I Comitt to 
the Earth to be decently Interred att the Discretion of my Executrix hereafter 
named  and as touching such worldly Estate wherewith almighty God has 
bestowed on Me I Give Devise & Dispose thereof as followes Whereas I have 
by surrender beareing Date the Fifth Day of this Instant Aprill surrendered into 
the Hands of the Lord of the Manour of Wokeing all that my Coppyhold 
Messuage or Tenem.t with the Gardens Backsides Barns Stables & Buildings 
wth the Appurtenances to the same belonging & appurtenning scituate lyeing 
and being in the Town Street within the said Manour of Wokeing abutting 
upon a Messuage or Tenement called the Karts Horne on the east part and the 
way there leadeing from a place called Wokeing Broadmead on the south part 
and all other my Coppyhold Messuages or Tenem.ts Lands & Premises with 
their Appurtenances lyeing within the Manour aforesaid to the use and 
Behoofe of such person & persons and to and for such Estate and Estates as I 
the said James Jelly should by my last Will & Testm.t in writeing Limitt Direct & 
Appoint Now I do hereby Give and Devise the Coppyhold Messuage or 
Tenement with the Gardens Backsides Barns Stables and premises now in my 
own occupacon and in the occupacon of John Hollis and Phillip Otway or their 
assigns and all other my Coppyhold Messuages or Tenem.ts Lands & Premises 
with their Appurtenances lyeing within the Manour of Wokeing aforesaid unto 
my Loveing Friends John Slyfield of Wokeing aforesaid Yeom Alexander 
Goodyer of the same place Cooper & John Symonds of Stoke next Guildford 
in the sd County of Surry husband and to the survivors of them and to such 
person & persons as they the said John Slyfield Alexander Goodyer & John 
Symonds or the Survivor of them shall by any writing under their hands Elect & 
Choose to be Trustees in their stead and to the surviving Trustees In Trust and 
upon this Special Trust & Confidence That They the said John Slyfield Alexander 
Goodyer & John Symonds and the survivor of them or such persons whom they 
shall Elect and the survivor of such persons shall permitt & suffer my loveing 
wife Elizabeth to receive & take the Rents Issues & Proffitts of the said 
Coppyhold Estates untill my sonn James Jelly shall attain to his age of One and 
Twenty yeares for & towards the educating & bringing up of my said Children 
and when and so soon as my said sonn James Jelly shall accomplish his full age 
of One & Twenty yeares then in Trust to and for him the said James Jelly his 
Heires & assignes forever  Butt I do hereby give power to the said John Slyfield 
Alexander Goodyer & John Symonds or ye survivor of them or such person 
whom they shall elect to Charge the said Coppyhold Estate with the summe of 
One Hundred & Twenty pounds of lawfull mony of great Brittain and to dispose 
thereof as followes (that is to say) Eighty pounds to my sonn John Jelly to be 
paid him within one month after he shall attain to his age of One & Twenty 
yeares and to my Daughter Sarah the sume of Forty pounds to be paid her 
within one month after she shall attain to her age of One & Twenty yeares butt 
in Case either my sonn John or my Daughter Sarah or both do happen to dye 
before they attain to their sevrall ages of One & Twenty yeares then I do 
hereby Give and Bequeath their Legacies hereby given them equally between 
all my Children that shall be then living Butt in Case my said sonn James Jelly 
shall happen to dye before he attain to his age of One & Twenty yeares Then in 
Trust that my said Trustees shall allow my said loveing Wife Elizabeth to take & 
receive the Rents & profits of the said estate untill my said sonn Richard shall 
attain to his age of One & Twenty yeares and from and att my sonn Richards 
attaining to that age then in Trust for him the said Richard Jelly his Heirs & 
assignes forever Subject nevertheless to the payment of the said sume of one 
Hundred & Twenty pounds as before given to John & Sarah which my will & 
meaneing is should be raised out of the estate so soon as they Come of age 
Butt in Case both my said sonns John & Richard should happen to Dye before 
they attain to their sevrall ages of One & Twenty yeares Then I do hereby 
Impower my said Trustees to sell & Dispose of the said estate to the best 
purchaser Can and the monies to be disposed of as follows (that is to say) in 
the first place to pay of the said Legacies of Eighty pounds & Forty pounds to 
my sonn John & my Daughter Sarah and to divide the rest of the said purchase 
money equally between all my Children that shall be then living as they shall 
attain to their ages of One & Twenty yeares but iff either of them Dye before 
they Come to that age the other to have their share  Item I do hereby Give and 
Devise unto my said loveing Friends John Slyfield Alexander Goodyer & John 
Symonds and the survivor of them or such persons as they or the survivor of 
them shall Choose & Elect as aforesaid all that my Freehold Messuage or 
Tenemt Barnes Outhouses Edifices and Buildings and two acres of Arable Land 
with the appurtenances thereunto belonging comonly called Fox Croft scituate 
and being att Kingfield in the said Parish of Wokeing Upon this Special Trust & 
Confidence  That They the said John Slyfield Alexander Goodyer & John 
Symonds and the survivor of Them and such person & persons as they shall 
elect and the survivor of such elected persons shall permit & suffer my said 
loveing Wife Elizabeth to receive & take the Rents & profitts of the said 
Freehold Estate (not comitting wast) for & untill my said sonn Richard shall 
accomplish his age of One & Twenty yeares and when and so soon as my said 
sonn Richard shall attain to that age then In Trust to and for him the said 
Richard Jelly his Heirs & assignes with full power & authourity nevertheless to 
raise out of the said Estate or Charge and advance on the same the sume of 
Forty pounds of lawfull mony of great Brittain and the said sume of Forty 
pounds to pay to my Daughter Elizabeth within one month when she shall 
attain to her age of One and Twenty yeares butt in Case my said Daughter 
Elizabeth happen to dye before she accomplish her said age of One & Twenty 
yeares Then I do hereby give & Bequeath the said sume of Forty pounds 
equally to be divided amongst my Children as they shall attain to their ages of 
One & Twenty yeares  Butt in Case my said sonn Richard Jelly shall happen to 
dye before attains to his said age of One & Twenty yeares or if my said sonn 
James happen to dye so as my sonn Richard will enjoy the Coppyhold estate 
then in Trust that they the said John Slyfield Alexander Goodyer & John 
Symonds or the survivor of them or such person or persons which shall be 
elected as aforesaid shall permitt & suffer my said loveing Wife Elizabeth to 
receive 7 take the Rents & profitts of the said Freehold Estate for and untill my 
said sonn John shall attain to his age of One & Twenty yeares and when and 
soon as my said sonn John shall accomplish that age then to and for the use 
and Behoofe of the said John Jelly his Heirs & assignes forever Subject 
nevethelesse of the payment of the Legacy of Forty pounds to my Daughter 
Elizabeth as aforesd  Item I do hereby Give and Bequeath all that my Leate of 
the River Wye in the County of Surry and the yearly profitts thereof unto my 
said loveing Wife Elizabeth so long and untill my said sonn James shall 
accomplish his age of One & Twenty yeares and when and so soon as my said 
sonn James shall attain to that age then I do hereby Give and Bequeath all the 
said Leate and the Term of Years thereon then to Come unto him the said 
James Jelly his Executors and admors He the said James Jelly his Executors & 
admors paying thereout unto my said Wife Elizabeth the yearly sume of Fifteen 
pounds of lawfull mony of great Brittain dureing the Continuance of the said 
Lease att two half yearly payments butt if my said sonn James Jelly shall Refuse 
and not pay the said yearly sume in manner as aforesaid or if the said James 
Jelly shall happen to dye before he attain to the age of One & Twenty years 
then I do hereby Give and Bequeath the said Lease and the proffitts thereof 
unto my said loveing wife Elizabeth untill my said sonn Richard shall attain to 
the age of One and Twenty yeares and so soon as he accomplish that age then 
I do Give and Bequeath the said Lease and the Term of Yeares thereon to come 
unto him the said Richard Jelly his Executors & Admors Hee or they paying the 
said yearly sume of Fifteen pounds to my wife in manner as aforesaid Butt in 
Case my said sonn Richard happen to dye before he attaines to the age of One 
& Twenty years or if he refuse to pay the said sume of Fifteen pounds in 
manner as aforesaid Then I do hereby Give and Bequeath the said Lease and 
the Term of Years thereon to come unto my said loveing wife Elizabeth her 
Exectors & Admors And if itt shall happen that my said wife Elizabeth shall dye 
before either my sonn James or Richard shall be of age or before they are 
possessed of the said Lease in manner as aforesaid then I doe hereby Give and 
Bequeath the said Lease and the Term of Years to my Trustees before 
mentioned that they and the survivor of them shall receive & take the proffitts 
of the said Lease untill my said sonn's James or Richard come of age and the 
proffitts to be added towards the bringing up of my said Children  Item I do 
hereby Give and Bequeath unto my Daughter Sarah the sume of Tenn Pounds 
of lawfull mony of great Brittain when she shall attain to her age of One and 
Twenty Years over & above the Legacy I have before given her  Item I Give and 
Bequeath unto my Daughter Elizabeth the sume of Tenn Pounds of like lawfull 
mony of great Brittain when she shall attain to her age of One and Twenty 
Years over and above the Legacy I have before given her  Item I Give and 
Bequeath unto my Daughter Ann the sume of Fifty Pounds of lawfull mony of 
great Brittain when she shall attain to her age of One and Twenty Years  Item I 
Give and Bequeath unto my Daughter Jane the sume of Fifty Pounds of lawfull 
mony of great Brittain when she shall attain to her age of One and Twenty 
Years  Item I Give and Bequeath unto the Child my wife is now Enseynt with 
the sume of Fifty Pounds of like  lawfull mony of great Brittain when he or she 
shall attain to his or her age of One and Twenty Years All which sevrall Legacies 
last mentioned my will and meaneing is and I do hereby charge my Executrix 
hereafter named pay as they are before directed & Limited  And my will & 
meaneing further is that in Case any of my Children have any Differences arise 
amongst for or in respect of this my last Will & Testamt or the Estates or 
Legacies hereby given them then I do desire that such Differences may by the 
advice & consent of my Trustees be left to two Indifferent persons the one to 
be Chosen by each party and those two persons not agreeing to Choose a third 
person whose award shall be finall to hinder vexatious suites of Law Butt if 
either of my said Children shall refuse to consent to arbitration then my will & 
meaneing is that whatever estates he by virtue of my will enjoys shall utterly 
be void and of none effect and that itt shall be in the power of my Executrix to 
sue for and recover the same  Item I do Nominate Constitute & appoint my 
said loveing Friends John Slyfield Alexander Goodyer & John Symonds Trustees 
& Overseers of this my last Will & Testamt giving them full power & authority 
to elect & choose new ones in their stead and desireing them to assist my Wife 
in bringing up of my Children and that in Case my said Wife should dye before 
she has finished ye Trust in bringing up of the Children that they would accept 
of that Trouble  Item all the rest & residue of my ready Money stock Bonds 
Notes & Personal Estate whatsoever not before hereby given I Give and 
Bequeath unto my loveing Wife Elizabeth to bring up my Children to their ages 
of one & Twenty yeares And I do hereby Nominate Constitute ordeyne & 
appoint my said loveing Wife Sole Executrix of this my last Will & Testamt and I 
do hereby revoke and make void all former wills by me made  Item I desire my 
Executrix to pay my Trustees all such sume & Sumes of mony as they shall be 
att manageing the Trust hereby reposed in them  In Wittnesse whereof I the 
said James Jelly have to this my last will & Testament containing Three sheets 
and an half of paper have to each sheet sett my Hand & Seale the seaventh 
Day of Aprill in the Ninth Year of the Reigne of our Soveraigne Lady Ann by the 
Grace of God of great Brittain France & Ireland Queen defender of the Faith &c 
and in the year of our Lord one thousand Seaven Hundred & Tenn
