In the name of God Amen This is the Last Will and Testament of me Martha Heath of the parish of Horsell in the County of Surry Spinster revoking all former Wills by me at any time made or executed I desire that all my just debts funeral expences & the expences of proving this my Will be paid by my executors or Executrix hereinafter mentioned in the first place I desire that my body may be decently buried and my Soul I commend to God who gave it and as for my worldly property I dispose of as follows that is to say in the first place I give and bequeath unto my half brother John Heath the sum of twenty pounds of lawful money for his own use and benefit I give and bequeath unto my nephew George Benn the sum of twenty pounds I give and bequeath unto my nephew Thomas Judey the thirty pounds I give and bequeath unto my niece Elizabeth Macperson the sum of twenty pounds I also give and bequeath unto my Master Richard Honer the sum of fifty pounds I give and bequeath unto my brother William Heath the sum of one hundred pounds I give and bequeath unto my brother Frances Heath the sum of one hundred pounds I also give and bequeath unto Sarah the daughter of the said Francis Heath my Chest of Drawers all the rest & residue of my property together with all my wearing apparel I give and bequeath unto my Sister Mary Benn for her own use and benefit but if any one or more of my Brothers or Sisters should die before their legacys become due leaving lawful issue of his or her bodies such Child or Children shall be entitled to so much money equally divided amongst them as their respective father or mother would have been if living also if any one or more of the last mentioned William Heath Francis Heath and Mary Benn should die before the legacies become due not leaving lawful issue then their part or parts shall be equally divided amongst the survivors of the said last three persons also if any one of my nephews or my niece should die before their legacies become due his or her part shall be equally divided in the same manner as before directed the above legacies to be paid within twelve calendar months after my decease and for the better execution of this my Will and Testament I nominate and appoint Richard Honer of the parish of Horsell yeoman and my Sister Mary Benn full and sole Executor and Executrix of this my Will and Testament also my said Executor and Executrix shall be allowed all reasonable expences attending the execution of their duty Signed sealed and delivered by me the Testarix as my last Will and Testament dated this twenty sixth day of March in the year of our Lord one thousand eight hundred and twenty two. Martha X Heath her mark In the presence of us who in her presence and in the presence of each other and at her request have hereunto subscribed our names as Witnesses James Howard his marke Jn.o Wilcox Codicil to the aforegoing Will whereas Mrs Martha Heath has taken into consideration the case of James Benn the husband of Mary Benn mentioned in her last Will as annexed that is to say if the said Mary Benn should die before the legacy become due that the husband James Benn shall enjoy such part as his Wife Mary would have done if living as her issue are before provided for dated this twenty sixth day of March one thousand eight hundred and twenty two.
