This is the Last Will and testament of me James Fladgate of Chobham in the County of Surrey Farmer I nominate and appoint my two sons James Fladgate and William Fladgate Executors of this my Will & give and bequeath to my Wife Elizabeth Fladgate the sum of One hundred pounds sterling monies to be paid her within fourteen days after my decease I also give and bequeath to my said Wife for her life such articles of furniture as she may chuse to select for the furnishing of a Bed room and Sitting room and after her decease I give and bequeath such articles to my said Son James Fladgate for ever I give and bequeath to my daughter Sarah the wife of Thomas Harris the sum of One thousand and five hundred pounds sterling monies to be paid to her within twelve months after my decease by my said Executors And all the Rest and Residue of my personal estate and effects mortgages bonds bills notes book debts rights and credits whatsoever (subject to the payment thereout of my just debts and funeral and testamentary expences and to the payment of the aforesaid legacy) I give and bequeath the same and every part thereof unto my eldest son James Fladgate for ever I give and bequeath unto my said Wife one Annuity or yearly sum of One hundred pounds of lawful English money to be paid her by four equal quarterly payments during the term of her natural life the first payment to be made at the expiration of three months after my decease And I subject charge and incumber my Farm and Lands called Stanners Hill Manor Farm hereinafter devised to my said son James with the payment thereof And I give my said Wife all the usual proceses and remedies for the recovery of the said Annuity in case the same shall at any time be in arrear by Distress and Sale or by action as are used and enjoyed by Landlords for the recovery of rent in arrear I give devise and bequeath to my said Son James Fladgate All that my freehold messuage farm lands tenements and hereditaments called Stanners Hill Manor Farm subject to and chargeable nevertheless with the aforesaid Annuity of One hundred pounds to my said Wife And all that the Manor or Lordship of Stanners and Fords and which Farm and Manor I formerly purchased of Edmund Bochin Esquire and are situate in the said parish of Chobham and which Farm is now in my own occupation And also all that my messuage farm lands tenements and hereditaments being freehold called Lurkenshaw Farm which I formerly purchased of the said Edmund Bochin and now in my own occupation And also all that my messuage farm lands tenements and hereditaments called Fish Pools situate in Chobham aforesaid which I purchased of William Hammond and which is now in my own occupation And all that piece or parcel of meadow land called Sowmore situate in Chobham aforesaid which I purchased of James Sturt and now in my own occupation And also all those freehold pieces of Arable Land called Brickfields situate in Chobham aforesaid and now in my own occupation To hold the same to my said Son James Fladgate for ever I give devise and bequeath to my said Son William Fladgate All that my messuage farm lands tythes and hereditaments part whereof is freehold and part copyhold called Cross Lanes Farm situate in the Parishes of Woking and Send in the said County of Surrey and now in the occupation of my kinsman William Fladgate at the yearly rent of Two hundred pounds And also all that messuage farm lands and hereditaments being partly freehold and partly copyhold and situate in the Parishes of Horsell Woking and Send and now in the occupation of James Stedman And also all that my share and interest of and in the Vicarage House of Horsell aforesaid and also of and in the several sum and sums of money collected by or due to me as spiritual dues and payments in lieu of Tithes at Horsell foresaid To hold to my said Son William Fladgate for ever I give devise and bequeath to my said [sic] son Richard Fladgate All that my messuage farm lands tenements and hereditaments called Rowell End Farm being freehold situate in Chobham aforesaid and now in my own occupation And also all that my piece or parcel of freehold meadow land called Langshott Otread situate in Chobham aforesaid and now in the occupation of John Stevens And also all that my messuage farm lands tenements and hereditaments called Hennidge Corner being freehold situate in Chobham aforesaid and now or late in the occupation of Henry Edmeads and others And also all that piece of meadow land containing four acres situate at Langshott in Chobham aforesaid and purchased by me of Thomas Simpson and now in the occupation of the said Henry Edmeads And also all those pieces or parcels of meadow land situate at Chobham aforesaid and purchased by me of the devisees of M.r Crenzee and now in the occupation of the said Henry Edmeads And also all that farm lands and hereditaments situate at Chobham aforesaid and now in the occupation of James Taylor and purchased by me of Richard Woods And also all that messuage farm lands and hereditaments called Fowlers Well being freehold situate in Chobham aforesaid and now in my own occupation and all the stacks of Corn Grain and Hay being on the said Farm and Lands in my own occupation at my decease and hereinbefore devised to my said Son Richard and all the growing crops manure ploughings and dressings then being therein and thereon To hold to my said son Richard Fladgate for ever I give devise and bequeath to my son Henry Fladgate All that farm lands tenements and hereditaments situate in Horsell and Chobham aforesaid purchased by me of William Still and Charles Still and now on Lease to the said Charles Still at the yearly rent of Two hundred pounds And all those ten acres of freehold and copyhold land situate in Chertsey Mead in the Parish of Chertsey and now in the occupation of Henry Roake at the annual rent of thirty six pounds To hold to my said son Henry Fladgate for ever I nominate and appoint my said son James Fladgate sole residuary devisee and legatee of this my Will I direct my said Executors to deduct and reimburse themselves all such charges and expences as they may be put unto in carrying the trusts of this my Will into execution And it is my Will and meaning that my said Executors or either of them shall not be liable to answer or make good any loss or losses that shall or may happen to the said Trust estate or in placing out the said trust monies or any part thereof according to the directions of this my Will or in transacting any money matters or otherwise relating to or concerning the execution of the trusts mentioned in this my Will unless the same shall happen by or through their or either of their wilful neglect or default nor shall either of them be answerable or accountable for the other of them or for the acts deeds receipts or disbursements of the other of them but each for his own sole and separate acts deeds receipts and disbursements only And revoking all former wills I declare this only to be my last Will and Testament In testimony whereof I the said James Fladgate the Testator have to this my last Will and Testament contained in three sheets of paper and to a duplicate copy thereof to each sheet set my hand and subscribed my name the twenty sixth day of June in the year of our Lord one thousand eight hundred and fifty.
