This is the Last Will and testament of me Henry Harris of Woking in the County of Surrey Shopkeeper First I will and direct that all my just debts funeral expences and the expences of proving this my will be fully paid satisfied and discharged by my Executor hereinafter named as soon as conveniently can be after my decease by and out of my Real and Personal estate and subject thereto I hereby give devise and bequeath unto my good friends Thomas Woods of Pirbright in the said County of Surrey Mealman Henry Woods of the same place Mealman and James Fladgate of Woking aforesaid Mealman and to the Survivors and Survivor of them and to the Heirs executors administrators and assigns of such Survivor All my Real and Personal estate and Effects whatsoever and wheresoever according to the respective natures and qualities thereof Upon the trusts hereinafter declared concerning the same (that is to say) Upon trust that they my said Trustees or the Survivors or Survivor of them or the Heirs executors admors or assigns of such Survivor do and shall pay and apply the Rents and Profits of my said Real Estate and also the profits of my Shopkeeping business (which I will and direct shall be carried on by my said Trustees or the Survivors or Survivor of them or the Heirs executors or administrators of such Survivor until my youngest child for the time being shall have attained his or her age of twenty one years or as long as they my said Trustees shall think it beneficial so to do) And also the dividends and Interest of all my other personal estate until my youngest child for the time being shall have attained his or her age of twenty one years for and towards the Maintenance and support of my wife Elenor Harris and such child or children as I may happen to have at the time of my decease or that shall be born within a reasonable time afterwards and when and as soon as my youngest child for the time being shall have attained his or her age of twenty one years then Upon trust as soon as conveniently may be to sell and dispose of my said Real Estate either together or in parcels and either by Public Auction or Private contract for the best price and most Money that can reasonably be gotten for the same and the Money thereby arising Upon trust to pay and divide in manner hereinafter mentioned And then Upon further trust (when and as soon as my youngest child for the time being shall have attained his or her age of twenty one years) that they my said Trustees or the Survivors or Survivor of them or the executors or administrators of such Survivor do and shall divide the Monies to arise by the Sale (as hereinbefore directed) of my said Real estate and also my said personal estate and effects unto between and equally amongst such Child or children as I may happen to have at the time of my decease or born in due time afterwards share and share alike as Tenants in Common and not as joint Tenants the share or shares of such of my said Children as shall happen to be dead to go to his her or their executors administrators and assigns And it is my will and meaning that in case of the death of any of my children under the age of twenty one years without leaving issue then and in such case the share or shares of such child or children so dying shall go to the Survivors or Survivor of my said children their executors administrators and assigns if more than one equally to be divided between them share and share alike and if but one then to such only one his or her executors administrators and assigns and to vest and be transferred and paid at the same time as their his or her original share or proportion would be transferable and payable by virtue of this my will Subject nevertheless and I do hereby charge my said Personal estate and also the Monies to arise by Sale (as hereinbefore directed) of my said Real estate to and with the payment of one annuity or annual Sum of Ten pounds to my said wife for and during the term of her natural life if she shall so long continue my widow and unmarried by equal half Yearly Payments in each and every year the first half yearly payment to be made at the end of Six months next after the attainment by my youngest child of his or her age of twenty one years And in case my said wife shall marry again I hereby declare and direct that the provisions hereinbefore made for her shall cease and determine but it is my will and meaning that she shall from and after such Second Marriage receive and be paid one clear Annuity or Annual Sum of five pounds for the Term of her natural life by equal half yearly payments the first half yearly payment to be made at the end of Six months next after her second marriage which I hereby give and bequeath to her accordingly and I hereby charge my said Personal Estate and the Monies to arise by the Sale (as hereinbefore directed) of my said Real estate with the payment thereof And I do hereby authorise and empower my said trustees and the Survivors and Survivor of them and the executors and administrators of such Survivor to advance for the Apprenticing or placing out in the world of all or any of my said children during the minority of such children such sum or sums of money part of the Principal of my said personal estate and the monies to arise by Sale (as hereinbefore directed) of my said Real estate as my said Trustees or trustee shall think prudent or necessary not excluding the then presumptive share of each child so advanced of my said Personal estate Provided always and I do hereby declare and direct that the receipt or receipts of my said Trustees or the Survivors or Survivor of them or the Heirs executors or administrators of such Survivor shall be a good and sufficient discharge or good and sufficient discharges and valid in the Law to the Purchase or Purchasers of all or any part of my said Real and Personal estate and effects for so much Money as in such receipt or receipts shall be expressed to have been received by my said trustees or the survivors or survivor of them his or her Heirs executors or admors and that after such receipt or receipts shall be given such Purchaser or Purchasers shall not be bound or obliged to see to the application of the purchase Money or any part thereof nor be answerable or accountable for the misapplication or nonapplication thereof or of any part thereof Provided also and I hereby further will and declare my will and meaning to be that my said Trustees and the Survivors and Survivor of them his or their Heirs executors and administrators shall be charged and chargeable only for such and so much Money as they and each of them shall respectively receive by virtue of or under the trusts of this my Will and the one of them shall not be answerable or accountable for the others or other of them or for the acts receipts neglects or defaults of the other or others of them but each for his own acts deeds receipts neglects or defaults only nor for the insufficiency of any Security or Securities in or upon any part thereof is or shall or may be vested nor for any loss misfortune or damage which may happen in the execution of the trusts of this my Will or in relation thereto except the same shall happen by or through their or either of their own wilful defaults respectively And also that they my said Trustees shall and do reimburse themselves respectively out of my trust estate and effects all such costs charges damages and expences as they or any of them shall incur sustain or be put unto in the execution of the trusts of this my Will hereby in them reposed And lastly I hereby nominate constitute and appoint my said good friends Thomas Woods Henry Woods and James Fladgate Executors of this my Will and I hereby revoke all former Wills by me made and declare this only to be my last Will and Testament In witness whereof I have to this my last Will and Testament contained in three Sheets of Paper to the two first sheets thereof set my hand and to this third and last sheet my hand and Seal the Seventh day of December in the year of our Lord one thousand eight hundred and twenty four.
