This is the Last Will and Testament of me Mary Howard of Kingston upon Thames in the County of Surrey Widow I give and devise unto my Brother James Howick of the Parish of Godalming in the County of Surrey Husbandman and his heirs All and every my Messuages or Tenements Buildings Lands and hereditaments situate lying and being in the parish of Pirbright or elsewhere in the County of Surrey To hold the same unto the said James Howick and his heirs To the Uses and upon and for the trusts intents and purposes hereinafter expressed and contained (that is to say) To the Use of my Nephew William Howick the son of the said James Howick and his assigns during his life And after the determination of that Estate by forfeiture or otherwise in his life time To the Use of the said James Howick and his heirs during the life of the said William Howick In trust for him and by the usual ways and means to preserve the Contingent remainders hereinafter devised And after the decease of the said William Howick To the Use of the first Son of the said William Howick and the heirs of his Body lawfully issuing And in default of such issue To the Use of the second and every other Son of the said William Howick severally successively and in remainder one after another according to their respective seniorities and the heirs of their respective Bodies lawfully issuing And for default of such Issue To the use of all and every the Daughters and Daughter of the said William Howick and the heirs of the Bodies and Body of all and every such Daughters or Daughter respectively issuing and the same to be divided between or among such Daughters (if more than one) in equal shares as Tenants in Common in tail And in case there shall be more than one such Daughter and there shall be a failure of Issue of the Body or Bodies of any one or more of them then after the decease and failure of Issue or respective deceases and failures of Issue of such last mentioned Daughter or Daughters as well the share or shares hereby originally by me devised to the Daughter or Daughters so dying and whose Issue shall so fail as the share or shares which by virtue of this present clause shall have survived or accrued to her or them or her or their respective Issue shall severally be and remain To the use of the other or others of such Daughter or Daughters and the heirs of her or their Body or respective Bodies issuing and be divided between or among the said other Daughters (if more than one) in equal shares as Tenants in common by way of cross remainders in tail so long as there shall be issue of any such Daughters And if all the Daughters of the said William Howick (save one) shall die without Issue or if there shall be but one such Daughter then the Entirety of the said Messuages or Tenements Buildings Lands and hereditaments hereinbefore devised shall be and remain To the use of that remaining or such only Daughter and the heirs of her Body issuing and for default of such Issue To the Use of my own right heirs for ever And as to all and singular my Household Goods and Furniture Plate Linen and China Wearing Apparel Trinkets Monies and securities for money and all other my personal Estate and effects of every sort and kind I give and bequeath the same and every part thereof unto and equally between my Brothers James Howick and William Howick and my Sister Elizabeth Wilson share and share alike for their respective absolute use and benefit subject nevertheless to the payment of my just debts and funeral and testamentary expences And I nominate and appoint my said Brother James Howick sole Executor of this my Will Provided always and my Will is that my said Executor shall and may at all times in the first place reimburse and indemnify himself All such costs charges damages and expences as he shall or may at any time expend lay out or be put unto for or by reason or means of the trusts or executorship of this my Will And that he shall not be answerable for any loss which may happen to any Estate or Effects unless such loss happen through his own wilful neglect or default nor for more monies than shall actually come to his hands nor for any loss which may happen by occasion of depositing any money in the hands keeping or custody of any public or common Banker And I do hereby revoke and make void all former and other Wills by me at any time heretofore made and declare these presents only to be and contain my last Will and Testament In Witness whereof I the said Mary Howard the Testatrix have hereunto set my hand and seal the twenty fifth Clerk a Surrogate by the Oath of James Howick the Brother of the deceased the sole Executor to whom Administration was granted he having been first sworn duly to administer.
