In the name of God Amen The seaventh day of January in the seaven and twentieth yeare of the Reigne of or sovraigne Lord Charles the second by the Grace of God of England Scotland France and Ireland King Defender of the Fayth &c Annoq Dni 1675 I John Porte of Wokeing in the county of Surry husbandman being of good bodily health and of sound and pfect minde and memory (prayse be there fore given to Almighty God) doe make and ordaine this my last will and testament in manner and Forme followeing (That is to say) First and principally I comend my Soule into the hands of Almighty God hopeing through thee merrits death and passion of my lord and saviour Jesus Christ to have full and Free pardon and forgivenesse of all my sins And my body I comitt to the Earth to be decently buried according to the discretion of my Executors hereafter named Item I give bequeath and devise all that my Freehold Messuage or tenement Barnes Edifices and other the buildings thereunto belongeing and formerly erected and One Acre of Errable and three Acres of Coppice land thereunto adjoyneing sometyme the lands of Willm Spencer of Subberton in the County of Southton gent and afterwards the lands of Henry Parklinest late of Wokeing aforesd husbandman deceased and now in the tenure or occupacon of Richard Harrison & Thomas Harrison or their Assignes and abbutteth upon a certaine lane there called Saunders Lane on the north part And the lane called Smarts lane on the west part the Heath there called Smarts Heath on the south part and the lands sometyme of Anthony Machin and now of the widdow Pigge on the east part And alsoe all that Croft of land called Colles Croft conteyneing by estimacon two Acres and an halfe be it more or lesse sometyme the lands of George Dunstone and Anne his wife and after them of Richard Floate or his Asignes and from him by good and lawfull Assurance was conveyed unto the said Henry Parklinest and abutteth upon the lands of John Carman on the East part and the Comon there called Hooke heath on the west part and all and singular the apprtennes thereunto belongeing wch said Messuage or tenem:t and the said piece of land is situate lyeing and being in Wokeing aforesaid my Grandson Robert Machin and his heires To have and to hold the same Messuage or tenem:t lands and prmisses with the apprtennes unto my said Grandson Robert Machin his heires and Assignes for ever Provided alwayes neverthelesse and upon this Condicon that he the said Robert Machin his heires or Assignes shall well and truly pay or cause to be paid unto his sister Mary Machin her Execrs or Assignes the full sume of Twenty pounds of lawfull money of England And to his sister Anne Machin her Execrs or Assignes the full sume of Twenty pounds of lawfull money of England when they shall sevrally accomplish their sevrall ages of One and twenty yeares out of my said Messuage or tenem:t lands and prmisses And in case either the said Mary Machin or Anne Machin shall happen to dye before she or they shall attaine to her or their sevrall ages of One and twenty yeares then my will and meaning is that my said Grandson Robert Machin his heires or Assignes shall pay or cause to be paid to the survivor of them that twenty pounds soe as aforesaid payable to the deceased xly when such survivor shall accomplish her age of One and twenty yeares And in case the said Robert Machin his heires or Assignes shall not pay to the said Mary Machin and Anne Machin their said Execrs or Assignes their said sevrall sumes of money soe as aforesd due and payable att the tymes aforesaid then my will and meaning is that shee or they not having her or their moneys paid to her or them in manner as aforesd att the dayes and tymes aforesd shall or lawfully may enter into the said Messuage or tenem:t lands and prmisses with the apprtences and the same have hold use and enjoy untill shee and they shall be sevrally satisfyed contented and paid their sevrall sumes of money aforesaid and all charges and damages as they or either or any of them shall susteyne in the recovery or getting possession thereof And in case my said Grandson Robert Machin shall happen to dye without Issue before he shall accomplish his age of One and twenty yeares; then my will and meaneing is; And I doe hereby in such case give and devise unto the said Mary Machin my Granddaughter & her heires the said Messuage or tenem:t lands and prmisses with the apprtences to have and to hold the same unto the said Mary Machin her heires and Assignes for ever Provided alwayes neverthelesse and upon this Condicon that shee the said Mary Machin her heires or Assignes shall well and truly pay or cause to be paid unto her sister Anne Machin the full sume of Forty pounds of lawfull money of England when she shall attain unto her age of One and twenty yeares out of my said Messuage or tenem:t lands and prmisses And in case the said Mary Machin her heires or Assignes shall not pay unto her said sister Anne Machin the said sumes of Forty pounds att the tyme aforesaid then my will and meaning is that the said Anne Machin her Execrs or Assignes shall or lawfully may enter into the said Messuage or tenem:t lands and prmisses with the apprtences and the same have hold use and enjoy untill shee and they shall be well and truely satisfyed contented & paid the said sumes of Forty pounds and all charges and damages as they or either or any of them shall susteyne in the recovery or getting possession thereof And for as much as the said Robert Machin Mary Machin & Anne Machin are all under the age of One and twenty yeares I doe hereby nominate ordeyne and appoynt my two loveing freinds John Sawyer of Wokeing aforesd yeom and Willm Collyer of Wokeing aforesd yeom to be Gardians to the said Robert Machin Mary Machin & Anne Machin untill they accomplish their sevrall ages of One and twenty yeares hereby authorizeing and appoynting the said John Sawyer and Willm Collyer to receive the Rents Issues and pfitts of the said Messuage or tenem:t lands and prmisses with the apprtences untill the said Robert Machin Mary Machin & Anne Machin shall sevrally accomplish their sevrall ages of One and twenty yeares & doe hereby will and require them to pay out of the Rents Issues & pfitts of the said Messuage or tenem:t lands and prmisses such sume or sumes of money as they shall rayse out of the same unto the said Mary Machin or Anne Machin or both of them in full of their said legacyes & in full discharge of the said Messuage or tenem:t lands & prmisses with the apprtences from the paym.t thereof But if they the said John Sawyer & Willm Collyer cannot rayse sufficient moneys out of the Rents Issues & pfitts of the said Messuage or tenem:t lands & prmisses dureing the tyme aforesd to pay the said Mary Machin a& Anne Machin their said sevrall legacyes or the legacy of one of them then my will is that they give a true and perfect Account of the same unto the said Robert Machin his heires or Assignes att his age of One and twenty yeares. Item I give and bequeath unto my Grandchild John Machin One table and One Forme in the hall & alsoe one Joynt Bedsteddle matt & Cords & One Cubboard in the Chamber next the said Hall called the Parlour in the Messuage now in the occupacon of Thomas Roake situate in Wokeing aforesaid Item all the rest of my Goods Chattells and debts & all other Assurances for money whatsoever I give and bequeath unto my loveing Daughter Joane Roake hereby desireing her therewith to pay my debts & funerall expences And I doe hereby nominate ordeyne and appoynt the said John Sawyer and Willm Collyer joynt Executrs in trust of this my last will and testam.t hereby desireing and requesting them to Assist my said Grandchildren Mary Machin and Anne Machin in the obteyneing getting and Recovery of their said sevrall legacyes payable in manner and forme as aforesd And I doe hereby give and bequeath unto them five shillings apeice towards their paynes besides their Charges In Witnesse whereof I have hereunto sett my hand and Seale the day and yeare first above written.
