October the Fith 1652 [ I don't believe this as the original probate is dated the 22 Sep 1635] In the name of God Amen I John Lettice of Horsell in the Countye of Surrey husbandman beeinge in good health and perfect memorye thankes bee given to God for diverscances and Considerations have made my last Will and Testament First I bequeath unto God my Soule and my bodye unto the earth to bee buried in the parrish of Horsell Item I will and ordaine that my Mother Alice Lettice and Ann Lettice my sister bee my whole Executors And shall pay all my debts and Legacyes which I appoynte and give in manner and forme as hereafter Followeth And if the said Legacyes shalbee unpaid at the decease of my Mother then my Sister Ann shall fully possess and hould the house and lande all the whole tenements the full tearme of Twelve yeares to pay the said Legacyes accordingly as hereafter followeth Item First I give and bequeath unto my Wife Annis dureing my Mothers life Thirtye shillinges a weake And if shee lives longer than my Mother Item shee shall have Fortye shillinges a Weake after the decease of my Mother dureing her owne life Item I give alsoe unto my Wife a flock bed Three sheetes a Blanckett and a Coverlett an upper Chamber in ??ge over the Chamber next the Sate for to lodge in dueringe her life And to have the use of the fire freely at her need Item I give and bequeath unto Alice Blackewell the daughter of my sister Alice Twentye poundes to bee paid in Fower Yeares after my decease by Fower poundes a Year and to put it out for her good And Two stalls of Beet to bee sett out for her good and benefitt the first Yeare after my decease Item I give and bequeath unto Margarett Blackewell the daughter of my sister Alice Twentye poundes to bee paid by Five poundes a Year And to eam to make payment the yeare after her Sister is paid And soe to continue the payment yearely till the full somme of Twentye poundes bee paid And to be put out for the good of the said Margarettt Blackewell And alsoe One stale of Beet to bee putt out for her good and benefitt the First yeare after my decease And if it shall please God that either the said Alice or Margarett Blackewell or either of them shall dye not havinge received her legacye then my Will is that the longer liver of them shall have her sisters legacye Item I give unto my Brothers sonne Frances Lettice the house and land all the whole Tenement to enter thereon and enjoy at the age of Twentye and Five yeares if my Sister Ann have had the use and possession thereof the aforesaid Tearme of Twelve years and if it please God that my Mother shall live soe longe that my Sister Ann have not enjoyed the house and land the time as is above mentioned then my Will is that she shall take as much time as shall finish and make upp and accomplish the sd Twelve yeares without any disturbance or molestation either by the said Francis or any or him and if it shall so fall out that there bee more yeares then Twelve betwixt the decease of my Mother and the age of Twenty Five yeares of the said Francis Lettice my will is that my Sister shall quietly and peaceably enjoy the said whole tenemt and land untill he come to the full age of Twentye Five yeares provided that she maintaine and uphold the dwellinge house and all other out houses belongeinge thereunto And also do maintayne the land wth the fences beelonging thereunto And that shee nor none by her procurement shall make any waste of the Wood groweinge but onely for the use of the land And my will is that my Sister after the decease of my Mother shall pay unto the said Francis Lettice Tenn shillinges a yeare till such time that hee come to enjoy the land Item my will is that hee the said Francis shall not make any Bargaine or saile of the house and land or of either of them the which if hee doe my will is it shall not bee of any effect but to keepe it to his owne use and to the use of his heyres male after him lawfully begotten of his bodye if hee have noe such then my will is that it shall remaine and bee to the use of my Sister Ann Lettice and to Alice Blackewell and to Margarett Blackewell the daughters of my Sister Alice and there heyres lawfully begotten of theire bodyes for ever to either of them alike Item I give and bequeath unto Humfrey Simmockes Five shillings Item I give and bequeath unto Robert Boylett Five shillings Item I give and bequeath unto the poore of the parrish of Horsell Three shillinges Four pence Item my will is that if my Sister Ann doe Marrye that her husband shall not make any sale of the yeares or have any power to meddle with any thinge in this my Will noe longer time then shee doth live If shee have a Childe lawfully begotten of her bodye then the residue of the time shall remane to the good of her Childe alsoe my will is that if default bee made in the payment of any of the legacyes at the time appointed then it shalbee lawfull for them to enter upon the last said Tenement and to hould and enjoy and occuie quietlye and peaceably without molestation of any till such time as they are paid And here I make Thomas Blackewell and John Blackewell Overseers of this my Will and
