Ireland King & Queene Defenders of the Faith &r Annoq Domi 1727 I Thomas Martin Sene.r of Woaking in the County of Surrey yeoman being in Indeferent good Health in boddy and of sonnd and perfect Mind and Memory (praise be to God) but calling to Mind the uncertainty of this Transitory life here on Earth doe make and Ordeyne this my last Will and Testament in Manner and forme Following (That is to say) First and prencipally I recommend and bequeath my soule into the hands of Allmighty God my Creator and Redeemer hooping in and by the reconciliation of Jesus Christ to be saved and my Body to the Earth from whence it came to be buryed in such decent Manner as as [sic] it shall please my Executor hereafter named to appoynte and as touching such Temporall estate as the Lord far above my deserts hath Bestooed upon me my Will and meaning is the same shall be Imployed and Bestooed as hereafter in and by this my Will is Expressed Imprimis I will give and Bequeath unto my Three daughters Jane Slifeild the wife of John Slifeild Sarah Bowls the Wife of Francis Bowls and Elizabeth Head the Wife of William Head Sixty pounds a peece of good and lawfull money of great Brittain to be payd by my Executor hereafter named within Twelve months next after my decease Item I give and Bequeath unto my Grandson Thomas Stevens son of my Daughter Mary Stevens Deceased Twenty pounds of good and lawfull money of great Brittain to be payd by my Executor hereafter named so soon as he shall attaine unto the age of One and Twenty yeares or at the day of his Marriage which shall first happen But if my said Grandson Thomas Stevens doe happen to depart this life before he attaine unto the age of One and Twenty yeares and without a Heire of his own boddy Then his said legacie of Twenty pounds shall be pai[d] to my daughter Elizabeth Head before named and at the time as it would have bin dne if the said Thomas had lived Item I give and Bequeath unto my Grandaughter Mary Stevens daughter of my said Daughter Mary Stevens Deceased Twenty pounds of good and lawfull money of great Brittain to be payd by my said Executor hereafter named so soon as she shall attaine unto the age of One and Twenty yeares or at the day of her Marriage which shall first happen But if my said Grandaughter Mary Stevens doe happen to depart this life before she doe attaine unto the age of One and Twenty yeares leaveing no Heire of her own boddy Then her said legacie of Twenty pounds shall be payd unto my Grandson Thomas Stevens before named and at the time as it would have bin dne if the said Mary had lived But if both my said GrandChildren doe happen to depart this life and leaveing no Heirs of their own boddys then the said Mary Stevens legacie shall be equally devided between my Three Daughters Ann Slifeild Sarah Bowls and Elizabeth Head above named if they be then living but if not the Heires of the boddys of they that are Deceased shall have a part as their Mother might if they had bin the living And Further if it should happen that if either any or all of my said Three Daughters doe depart this life before their legacie of Sixty pounds apece be due and payable then her or their legacie so dyeing shall be payd to the heires of the Boddys of the deceased And for want of such Issue or Heirs to be devided equally amongst them that are living and the Heires of the boddys of those that are deceased And my said Two Grand Children shall have their part if any such legacie doe happen to be left to be devided And my Will and Meaning is that if my said Grand Children doe happen to depart this life before their legacies are due and payable and leave Heirs of their own boddys that such Heire or Heirs shall enjoy what themselves would if they had lived Item I allow Give and Bequeath unto my said Three Daughters Ann Slifeild Sarah Bowls and Elizabeth Head Tenn Lether Sheets Five pewter Dishes Three Kilderkin Drink Juggs Two Round Tabls my Bead in the parler with the Boulster pillow Curtins Vallins Bedsted Matt and Cord theirunto belonging one Nest of Draws in the Hall neere unto the Jack and all my Shifts neckclothe[s] and Handkirchifs And my Will is that the next day after my Buriall my Overseers herafter named shall see the Goods before Given deli[vered] unto my said Three daughters and to be equally devided between them And Whereas I have Surrendered into the hands of the Lord of the Mannor of Woaking aforesaid my Messuage or Tenement Buildings and Lands with the appurten.ces situate in Woaking aforesaid to the Use of my last Will and Testament Item I therefore Give Devise and Bequeath unto my son Thomas Martin all that my Messuage or Tenement Buildings and Copyhold Lands with the appurten.ces lying within the said parish of Woaking to Remayne and be to the soale Use and Behoofe of my said son Thomas Martin his Heires and Assignes for ever upon this condition that he my said son Thomas Martin his Heires or Assignes doe and shall well and truly pay or cause to be payd out of the said Messuage or Tenement Buildings Lands and Appurten.ces herein before given him unto my said Three Daughters Ann Slifeild Sarah Bowls and Elizabeth Head and my Two Grand Children Thomas Stevens and Mary Stevens or to the Heires of any of them their severall legacies herein before Given them and at such times as is herein before Directed But if my sai[d] son Thomas Martin his Heires and Assignes doe Refuse or neglect to pay or cause to be payd unto my said Three Daughters and Two Grand Children or to their severall Heires their severall Legacies Given them as aforesaid and at such times as is before Directed That then it shall and may be good and lawfull to and for him hir them or any or all of them if so Neglected to be payd as aforesaid to enter in and enjoi the said Messuage or Tenement Buildings Lands and Appurten.ces or any part thereof and the same to possess and enjoy ntill he she or they shall be fully satisfyed and payd Item I allsoe Give and Bequeath unto my said son Thomas Martin all my Goods Chattells and Credits (Except such Goods as is hereinbefore Given) and doe herby make Constitute and Ordeyne my said son Thomas Martin soale Executor of this my last Will and Testament he paying all my Debts Legacies and Funerall Charges and Expences and I doe desire my loveing Brothe[r] in law Richard Collyer of Hillplace and my loveing Kinsman John Vincent of Beechhill to be overseers of this my last Will and Testament and to see the same peformed and for their pains I Give to each of them half a Guina to by Gloves and to be payd to them by my said Executor and I doe hereby Revoke and Annull all former and other Will or Wills by me heretofore made and this to be taken for my last Will and Testament and no other (the word (Mary) in the Margin and the word (my) between the six and Thirtyth and Seven and Thirtyth lines ware enterlined before the ensealing hereof) In Wittness whereof I the said Thomas Martin have hereunto sett
