In the name of God Amen The Three & twentieth day of January in the Fourth yeare of the Reigne of our Soveraigne Lady Anne by the grace of God of England Scotland France Ireland Queene Defender of the Faith &r And in the yeare of our Lord God One Thousand Seaven Hundred & Five I Gregory Howard now of Godalming in the County of Surrey Husbandman being of sound & perfect minde & memory & of a reasonable constitution of body (praised be Almighty God therefore) Revokeing all wills by mee Ever heretofore made Doe hereby make & declare this my last will and testam.t in manner & forme following First I comend my soule into the hands of Almighty God my Creator trusting through the merritts death & passion of Christ Jesus my Lord & only Saviour to obtaine forgivenesse of my sinns & life everlasting My body I comitt to the Earth to bee buried according att the discretion of my Executor in trust hereafter declared nominated & appoynted And as to such worldly Estate as itt hath pleased God to bless mee with I dispose devise and bequeath the same as hereinafter in this my Will is declared vizt. Item I give unto my Grandson Oliver Auburne the full sume of Five pounds of lawfull money of England to bee paid unto him by my Exors in trust of this my will when hee shall have attained to his full age of One & Twenty yeares And if hee shall happen to dye before hee shall attaine to that age Then I doe hereby give and the said Legacy to him by mee bequeathed imediately after such his death to & amongst my sonn in Lawe Henry Wallis Children wch are male now borne & then living Equally to bee betwixt them & the survivors of them Devided Item I give and Bequeath to my Grandson Richard Wallis to my Grandson William Wallis & to my Grandson James Wallis the sume of Fifty pounds to bee paid unto them respectively att their severalle & respective ages of one and Twenty yeares & then to bee equally devided betwixt them (that is to say) Each of them att their attainmt to the age of Twenty & one yeares to have & receive of my Exors in trust of this my will the sume of Sixteene pounds thirteen shillings & fourpence apeeice wch amounteth to the said sume of Fifty poundes Item I give unto my GrandDaughter Mary Wallis the sume of Five pounds to bee in like manner paid unto her by my said Exors of this my will at her age of Twenty & one yeares or day of marriage wch shall first happen And in case any of my said Grandchildren Richard William James or Mary Wallis shall happen to depart this life before such tyme as his her or their Legacy shall become due & payable That then itt is my will & I do hereby give the Legacy or Legacyes of him her or them soe dyeing Equally to bee devided betweene the survivor & survivors of them share and share alike Item I give will & bequeath unto my Grandaughter Elizabeth Moore the sume of Fifteen pounds Item I give will & bequeath unto my Grandaughter Mary Moore the sume of Fifteen pounds to bee had paid & received at their severall ages of Twenty & one yeares or severall dayes of marriage wch of them shall first happen to come or bee Item I give unto my Grandson Christopher Moore one shilling to be unto him in Tenn dayes next after my decease And if either of my Grandaughters Elizabeth & Mary Moore shall happen to depart this life before such tyme as their or either of their Legacies shall become payable then the survivor of them shall have receive & take the whole Thirty pounds But my will is that my said Grandson Christopher Moore shall have noe part nor share thereof Item I give & bequeath unto my said Grandaughters Elizabeth & Mary Moore the two Chests & all the Linnen therein wch now standeth in the dwelling house of their father Christopher Moore in Godalming aforesaid equally betwixt them to bee devided when & att such tyme as their Legacies aforesaid are to bee paid taken and received by them (But my will is & I doe hereby give unto my Grandaughter Elizabeth Moore one of the best & finest holland Aprons wch is amongst the said Linnen over & above her share of the said Linnen to be had & taken by her when she will after my decease for her owne use And my further will is & I doe hereby give the whole Linnen to the survivor of my said Grandaughters Elizabeth & Mary Moore in case either of them dye before such tyme as is lymitted by this my Will for paym.t of their Legacies to have & enjoy the said Linnen & every part thereof to such the survivor of my said Granddaughters Elizabeth & Mary Moore aforesd) And whereas I have by Indenture Tripartite bearing date the tenth day of November in the yeare of our Lord 1688 made betweene mee the said Gregory Howard & Mary my Wife of the first part Edward Neal of Guildford in the County of Surrey Tobaccopipe maker & Jacob Otway of Godalminge in the said County Malster on the second part and Christopher Moore the younger of Godalming aforesaid Collermaker & Mary Howard of Artington in the said County of Surrey spinster daughter of mee the said Gregory Howard on the third part in consideration of a marriage then to be made & solempnysed betweene the said Christopher Moore & my said daughter Mary Howard wch since hath been made & Solempnysed & of the natural Love & affection wch I then had & bore wher the said Mary since deced, settled Conveyed assigned & assured the messuages or teneme.ts & prmsses in the said Indenture menconed & all measnelssegnem.t & tenure of yeares I had or have in the said prmsses unto the said Edward Neale & Jacob Otway their Exors Adm.s & assignes In trust to & for such uses intents & purposses as in & by the said Indenture is expressed lymitted & declared As in & by the same appeaseth relation being thereunto had, Amongst wch severall trusts uses & declarations in the said Indenture comprised there is this particular clause following (vizt) That from & after the decease of the said Christopher Moore & Mary his intended wife & the survivor of them then the said Edward Neale & Jacob Otway their Exors & Adm.s shall stand & bee possessed of & in the said Messuage or teneme.ts & prmsses with their appurtenances last in the said Indenture named To such uses intents & purposes as shee the said Mary my daughter in and by her last will & testament in writeing sealed & subscribed in the prsence of two or more credible witnesses att any tyme dureing the intermarriage with the said Christopher Moore or any other husband (separate & apart from the said husband) or in her widdowhood shall nominate dispose & appoynt the same And for want of such limitation disposecon & appoyntm.t to bee by her made as aforesaid Then the said Edward Neale & Jacob Otway their Executors & Adm.rs shall stand & bee possessed of the same prmsses with ??sency in trust for the Executors or Adm.rs of mee the said Gregory Howard And to or for noe other use or uses intent or purpose whatsoever as in and by the said in part recited Indenture plainly & att large expressly And my further is that since my said daughter Mary the late wife of the said Christopher Moore is departed this life & hath made nor left now such nor any will lymitation or appoyntm.t behind her in writeing or otherwise for the further disposecorn of the prmsses in & by the said in part recited Indenture so menconed & interled that the same shall remayne continue & bee in trust for the Exors or Adm.rs of mee the said Gregory Howard as by the said Indenture is & was intended & to noe other use intent or purpose whatsoever And lastly I do hereby make & declare my Grandchildren Elizabeth Moore & Mary Moore joynt Executrices of this my last will unto whome after my debts & Legacies paid & discharged together with my funerall Expences I give devise & bequeath all the Rest & residue of my Goods Chattells Cattle & personal Estate whatsoever or wheresoever as equally to bee dystributed by my friends hereafter named betwixt them the said Elizabeth & Mary Moore my Grandchildren possible may or can bee adjugted And I doe make & appoynt my freinds John Russell of Guldeford Malster & Edward Neale of Guldeford tobaccopipe maker & Jacob Otway of Godalming collarmaker & James Shrubb jun.r of the same Cloathier Overseers in trust for the Ex.trices of this my will or as Ext.rs intrust thereof for them my said Executrices desireing & hereby authorizeing & impowering them & every of them to take upp & call in all such monies debts & sume & sumes of money as are or shall be due & payable to mee att the tyme of my decease from any person or persons whatsoever And further I doe & perfrme prose onto & Execute all such matters & things as may be expedient to bee done by them for the use & benefitt of my said Executrices before herein by mee declared & appoynted And order & give unto them & each of them the sume of Five shillings over & above such their necessary expences they may bee att in the due performance of the trust I have reposed in them for the true performance of this my Will In Witness whereof I the said Gregory Howard to this my last Will conteyning three sheets of paper affixt together with a Labell have to the bottom of each sheet thereof sett my hand & seale & to the labell thereof my hand & Seale likewise have sett the daye & yeare in the first sheete of this paper
