In the name of God Amen the Two and twentyeth day of February in the Four and Thirtieth year of the raigne of our Soveraigne Lord King Charles the Second by the grace of God of England Scotland France & Ireland Defender of the Faith &r Annoq Dom.i 1681 I Thomas Brinley of Sutton in the parish of Woking in the County of Surrey yeoman being sick and weak but of sound and Perfect mind and memory thanks be to Almighty god for ye same, Doe make this my last Will and testament in manner and forme following (That is to say) First & principally I Comend my Soule to Almighty God my Creator and my body to the Earth to be decently buried according to the discretion of mine Executrix hereafter named And as for such temporall Estate as the Lord of his infinite goodness & mercy hath bestowed unto me I give and bequeath the same as followeth Item I give and bequeath unto John Weston Esq.r eldest Sonne & heire of S.r Richard Weston late of Sutton afforesaid Knight deceased the sume of Tenn pounds of lawfull money of England to be by him disposed of according as I shall direct & appoint by a Note or writing under my hand or by word of mouth Item I give and bequeath unto George Weston Gent the sume of Three pounds of lawfull money of England Item I give and bequeath unto Andrew Weston Gent And to Henry Weston Gent And alsoe to Mrs Honor Mounson widdow the full & just sume of Three pounds of lawfull money of England to be equally devided amongst them Item I give and bequeath unto John Burkett and Thomas Burkett (the Sonnes of John Burkett my kinsman late deceased) the full sume of Thirty pounds of lawfull money of England, All which severall sumes before menconed hereby given and bequeathed to be paid unto them severally as they are named within Twelve months next after the decease of me the said Thomas Brinley and Elizabeth my Wife And it is my Will and meaning that if when we die or depart this life not leaveing soe much of our said Temporall Estate sufficiently to pay our Debts Legacies & Funerall charges That then every one of the Legatees before menconed shall be deducted or paid short of every one of their Legacyes or sumes an equall part according to the pportion Item all the rest of my Goods and Chattells whatsoever are yet unbequeathed I give and bequeath unto my Loveing Wife Elizabeth Brinley whom I make and ordaine sole Executrix of this my last Will and Testament And I desire my trusty and Loveing Friends Richard Weston of Sutton in Woking aforesaid Esq.r and Richard Lee of Sutton afforesaid yeoman to be Overseers of this my said last Will and Testament, and I desire them to see my Debts and Legacies honestly and carefully sattisfyed & paid according to the true intent & meaning of this my present last Will & Testament, But it is further my Will and meaning that the sume of Tenn pounds above mentioned given & bequeathed unto the said John Weston Esq.r shall be paid unto him w.thin One month next after my Decease; And I frustrate and make void all Wills & Testaments formerly by me at any time or times made and done and I declare this to be my last Will and Testament only in Wittness whereof I have hereunto set my hand and Seale the day and yeare first above written: Thomas Brinley Signed Sealed Published Pnounced and declared by the said Thomas Brinley for his last Will and Testament in the presence of William Nettleford Jane Jame Sam.l Heath Probatum fuit humoi Testam.tum Thom‘ Brinley ...
