This is the last Will and Testament of me George Street of Pirbright in the County of Surrey Yeoman First I direct that all my just debts funeral and testamentary and executional charges and expences shall be fully paid and satisfied And I give and devise unto my son William Street all that my freehold messuage or tenement lands and hereditaments situate and being at Pirbright aforesaid and which were devised to me and my heirs in and by the last Will and Testament of my late Uncle William Stevens deceased To hold the same unto and to the use of my said son William Street his heirs and assigns for ever And I give and bequeath unto my son John Stevens Street the Legacy or sum of one thousand and one hundred pounds I also give and bequeath unto my daughter Caroline the wife of Edward Langrish the Legacy or sum of eight hundred pounds Also unto my daughter Elizabeth the wife of Charles Hart the Legacy or sum of six hundred pounds And unto my son in law John Upfold the Legacy or sum of eight hundred pounds All which Legacies I direct to be paid to my said son John Stevens Street and my said daughters and the said John Upfold at the end of six Calendar months next after my decease And I give and bequeath unto my said sons William Street and John Stevens Street and my said son in law John Upfold (my executors hereinafter appointed) their executors administrators and assigns the sum of eight hundred pounds to be held and possessed by them Upon the Trusts and for the intents and purposes hereinafter expressed and declared that is to say Upon Trust that they my said Trustees and Executors shall lay out and invest the same in their own names in or upon the Government stock or funds or real security at interest and that they do and shall receive pay and apply the dividends interest and annual proceeds arising therefrom for the joint maintenance education and support of all the children of my late daughter Mary Garton until the youngest of them shall attain the age of Twenty one years And when and as soon as such youngest child shall attain that age then Upon Trust that my said Trustees and Executors shall pay divide and transfer the said sum of eight hundred pounds or the stocks funds or securities in or upon which the same shall be laid out or invested unto and equally between all such children as shall be then living share and share alike And if there shall be but one such child then the whole shall be paid and transferred unto such one child I also give and bequeath unto my said sons William Street and John Stevens Street and my said son in law John Upfold the further sum of eight hundred pounds To be held and possessed by them Upon the Trusts and for the intents and purposes hereinafter expressed and declared that is to say Upon Trust that they my said Trustees and Executors shall lay out and invest the same in their own names in or upon the Government stock or funds or real security at interest and that they do and shall receive pay and apply the dividends interest and annual proceeds arising therefrom for the joint maintenance education and support of the two children of my late daughter Harriet Lynn until the youngest of them shall attain the age of Twenty one years And when and as soon as such youngest child shall attain that age then Upon Trust that my said Trustees and Executors shall pay divide and transfer the said sum of eight hundred pounds or the stocks funds or securities in or upon which the same shall be laid out or invested unto and equally between the two said children or if either of them shall be then dead then to the survivor of such children absolutely And as to all the residue of my estate I give and bequeath the same unto and to be retained by my said two sons William and John Stevens Street in the following proportions videlicet one third part or share thereof to belong to my said son William and the other two third parts or shares thereof to my said son John Stevens Street for their respective benefit and disposal And I direct and declare that it shall be lawful for my said Trustees and executors from and out of all or any part of my estate and effects to retain to and reimburse themselves respectively all costs and charges which they shall sustain and incur in executing the Trusts of this my will and that neither of them shall be liable for more than shall actually be received by them nor for any loss by the failure of any Banker or other person in whose hands any part thereof shall remain or be deposited unless it shall arise from their own respective wilful neglect or default And I nominate and appoint my said sons William Street and John Stevens Street and my said son in law John Upfold Executors of this my last Will and Testament And I revoke former wills by me at any time heretofore made and do declare these presents only to be and contain my last Will and Testament In Witness whereof I the said George Street have to this my last Will and messuage land and hereditaments with the appurtenances situate in the Parish of Pirbright in the County of Surrey and held of the Manor of Pirbright and all my estate right and interest therein and thereto which said premises were lately purchased by me of Thomas Brown and by him surrendered To the use of me and my heirs And I direct and appoint that my said son John Stevens Street or his heirs shall be admitted to the same premises accordingly In Witness whereof I have to this Codicil to my last Will and Testament set and subscribed my name the fifteenth day of December one thousand eight Prerogative in the Goods of George Street deceased Appeared Personally John Rand of Guildford in the County of Surrey Solicitor and made oath that he is one of the subscribed witnesses to the Codicil to the last Will and Testament of George Street late of Pirbright in the County of Surrey Yeoman deceased and which said Codicil bearing date the fifteenth day of December one thousand eight hundred and fifty one is now hereto annexed and he further made oath that on the fifteenth day of December aforesaid the said Testator duly executed his said Codicil by signing his name "G. Street" at the foot or end of the said Codicil in the presence of this deponent and of Thomas Jenner Sells the other subscribed witness thereto both of whom were present at the same time and this deponent and the said Thomas Jenner Sells thereupon subscribed their names to the said codicil in the presence of the said Testator and of each other as attesting witnesses to the due execution of the said Codicil by the said Testator _ J Rand _ On the first day of June 1852 the said John Rand was duly sworn to the Truth of the aforegoing affidavit Before me _ Francis Overton Perpetual Curate of Pirbright Commissioner Proved at London with a Codicil 5th June 1852 before the Judge by the oaths of William Street and John Steven Street the sons and John Upfold the Executors to whom admon was granted having been first sworn by commission duly to administer.
