This is the last Will and Testament of me Mary Martin of Pirbright in the County of Surrey Widow I direct all my just debts funeral and testamentary expences to be fully paid satisfied and discharged by my Executors hereinafter named as soon as conveniently can be after my decease by and out of my Personal estate Also I give devise and bequeath unto my good friends the Reverend William Fraser of Pirbright aforesaid Clerk James Honer of the same place Miller and John Martin of the same place Cordwainer their heirs executors and administrators all and singular my messuages or tenements lands hereditaments and real estate whatsoever and wheresoever situate lying and being in that part of Great Britain called England And also all and singular my goods chattels rights credits Personal Estate and Effects whatsoever and wheresoever the same shall be which I may happen to be possessed of or interested in at the time of my decease To hold the same and every part and parcel thereof unto and to the use of the said William Fraser James Honer and John Martin their heirs executors administrators and assigns Nevertheless Upon the trusts hereinafter mentioned (that is to say) Upon trust that they my said trustees do and shall as soon as conveniently can be after my decease make sale and absolutely dispose of and convert into money All my said messuages or tenements and hereditaments goods chattels and all and singular my real and personal estate and effects and every part and parcel thereof or so much or such part or parts thereof as shall be convertible or applicable for that purpose either together or in lots or parcels to such person or persons as shall be desirous or willing to purchase the same or any part thereof and either by Public Auction or Private Contract and for the best price or prices that can be reasonably had or gotten for the same And in order to facilitate the Sale and Conveyance of my said personal estate and also the sale and disposition of my said personal estate hereinbefore by me given devised and bequeathed I do hereby Will declare and direct that the receipt or receipts of my said trustees or of the survivors or survivor of them or the heirs executors administrators or assigns of such survivor shall be a good and effectual discharge or good valid and effectual discharges to the purchaser or purchasers of my said real and personal estates or any part or parts thereof respectively his her and their heirs executors administrators and assigns for so much money or consideration as in such receipt or receipts shall be mentioned or expressed to be received And that the purchaser or purchasers after such receipt or receipts shall be made and given shall be thereby absolutely acquitted and discharged of and from the same and every part thereof and shall not afterwards be answerable or accountable for the loss misapplication or nonapplication of such purchase money or any part thereof or be in anywise required relating thereto And from and after such sale or disposition of my said real and personal estate my Will is And I do hereby direct that they my said Trustees and the survivor of them and the executors and administrators of such survivor do and shall stand possessed of and interested in the moneys arising by the sale of my aforesaid real and personal estate and all other my trust estate and premises Upon the trusts following (that is to say) Upon trust to pay and divide the same and every part thereof unto Benjamin Lambert Elizabeth Lambert and Joseph Hammersley Lambert the children of Joseph Hammersley Lambert the younger late of Pirbright aforesaid deceased equally share and share alike as tenants in common and not as joint tenants and to their several and respective heirs executors administrators and assigns upon their severally attaining their respective ages of twenty one years the interest and annual produce thereof in the meantime to be applied in for and towards their his or her maintenance support and education in such manner as they my said trustees shall in their discretion think proper And I do hereby give and bequeath the same accordingly Provided always And I do hereby further declare my Will and meaning to be That in case any or either of them the said Benjamin Lambert Elizabeth Lambert and Joseph Hammersley Lambert the younger shall happen to depart this life before he she or they shall have attained the age of twenty one years leaving lawful issue of his her or their body or respective bodies lawfully begotten Then I give and bequeath and do hereby direct my said trustees or the survivors or survivor or the executors or administrators of such survivor to pay and divide or transfer the part or share of him her or them so dying as aforesaid of and in my aforesaid trust estate and premises unto such child or children and their respective executors and administrators if more than one equally share and share alike as tenants in common and not as joint tenants and if but one then to such only one it being my intention that the issue of any deceased child should enjoy the full benefit of this my Will intended for the father or mother if living But in case any or either of them the said Benjamin Lambert Elizabeth Lambert and Joseph Hammersley Lambert the younger shall happen to die in my lifetime or before he she or they shall severally have attained the age of twenty one years and without leaving any issue of his her or their body or bodies lawfully begotten Then I give and bequeath and do hereby direct my said trustees or the survivors or survivor or the executors or administrators of such survivor to pay and divide or transfer the part or share of him her or them so dying as aforesaid of and in my aforesaid trust estate and premises unto the survivors and survivor of them the said Benjamin Lambert Elizabeth Lambert and Joseph Hammersley Lambert the younger and their respective executors and administrators if more than one equally share and share alike upon their severally attaining their respective ages of twenty one years and if but one shall survive then to such only one his or her executors administrators and assigns upon his or her attaining that age And in case of the death of all of them the said the said Benjamin Lambert Elizabeth Lambert and Joseph Hammersley Lambert the younger under the age of twenty one years and without leaving any lawful issue Then I do hereby give and bequeath the whole of my said trust estate monies and premises unto my good friend Thomas Baron the younger of Newbury in the County of Berks Esquire absolutely and for ever to and for his own use and benefit And I hereby I nominate constitute and appoint the said William Fraser James Honer and John Martin Executors of this my Will and hereby revoking all former Wills I declare this to be my last Will and Testament And I do hereby authorize and empower my said Trustees and the survivor of them his executors and administrators to retain and reimburse to themselves and to pay over to each other all such costs charges and expences and reasonable allowance for such time and trouble as they shall respectively sustain incur or be put unto in or about the Probate of this my Will or the execution of the Trusts thereof And I do direct that they or either of them shall not be answerable or accountable for any more of the said trust monies than shall actually come to their respective hands nor for the failure of any banker or broker or otherwise except the same shall happen by or through their respective wilful neglect or default nor one of them for the other of them (notwithstanding their joining in any receipt for conformity only) but each of them for himself and his own acts neglects and defaults only In Witness whereof I the said Mary Martin the Testatrix have to this my last Will and Testament contained in four sheets of paper to the first three sheets thereof set my hand and to this fourth and last sheet my hand and seal the eleventh day of June in the year of our Lord one thousand eight hundred and thirty one Mary Martin Signed sealed published and declared by the said Mary Martin as
