The last Will and Testament of me Richard Bonsey of Horsell in the County of Surry Gentleman In the First place I give and devise to my Father in Law Richard Smither of Perryfield in the County of Middlesex Yeoman Henry Roake the Elder of Kettlewell in the said parish of Horsell Gentleman and Henry Roake the younger of Kettlewell aforesaid Gentleman their Heirs and assigns all that my Manor of Twitchen otherwise Touchen together with all and every the rights Members and appurtenances thereunto belonging or appertaining and also all that my Messuage or Tenement Farm Lands and Tythes situate lying and being in Horsell aforesaid and in Cobham in the said County of Surrey or in either of them and now in my own occupation and also all other my Messuages Lands Tenements Tythes and Hereditaments whatsoever or wheresoever in the said County of Surry and I also give and bequeath to the said Richard Smither Henry Roake the Elder and Henry Roake the younger all my Goods Chattles and Personal Estate whatsoever In Trust nevertheless as for and concerning all my said Real and Personal Estate to sell and dispose thereof in the best manner and to the best purchasor or purchasors that can be procured for the same respectively And as to my said Real estate untill such purchasor or purchasors can be procured to receive have and take the Rents Issues an profits thereof and from time to time let the same to such person or persons and in such manner as they shall in their discretion think best And as for and concerning the money which shall arise by the said Rents and profits and by such sale of my said Real and Personal Estates to pay apply and dispose thereof in manner and form following that is to say In the first place in answering and paying all my just Debts and funeral Expences and in the next place as for and concerning four hundred pounds part thereof to and place the same out at Interest from time to time until the said principal money shall become payable as hereinafter mentioned (taking from time to time the Approbation in writing of my dear and loving Wife during her natural life in putting and placing the same out at Interest as aforesaid and as concerning the Interest and profits of the said four hundred pounds to pay the same unto my said dear and loving Wife for and during the term of her natural life and as for and concerning all the residue of the said money arising by the said Rents and profits of my said Real Estate and by the sale of my said Real and Personal Estate to put and place the same at Interest from time to time till the same shall become payable as hereinafter mentioned and as for and concerning the Interest and profits of the said four hundred pounds after my said Wifes decease to lay out spend and bestow the same according to their discretion in the Education maintenance and bringing up of all my Children (without being confined to any equality as to the said money so to be laid out spent and bestowed) until they shall respectively attain the age of twenty one years and to pay to each of my said Children at their respective ages of twenty one years an equal proportion of the said Residuum of the said principal money and also to pay to my said Children respectively at their respective ages of twenty one years or the decease of my said Wife which shall last happen the said sum of four hundred pounds in equal proportion and if any or either of my said Children shall happen to die without Issue before his or her part or share parts or shares become payable then the part or share parts or shares of him her or them so dying I direct to be paid to the survivor and survivors of them equally at their said ages of twenty one years respectively but if such Child or Children so dying before his or her part or share parts or shares become payable shall leave behind him her or them any Child or Children then such child or children so left shall be intitled to the Father or Mothers part or share parts or shares and if more than one Child in equal proportion and of this my said Will I do make and appoint the said Richard Smither Henry Roake the Elder and Henry Roake the younger Executors and hereby revoke all former and other wills by me at any time heretofore made and it is my will and directions that neither of my said Trustees be answerable the one for the other of them or of the Heirs Executors or administrators of the other of them and that neither of my said Trustees their Heirs Executors or Administrators shall be answerable for any money that shall happen to be lost without their wilful neglect or default and it is also my will and direction that the said Trustees shall be at Liberty and have a right to retain out of any of the said Trust money not only so much as they shall respectively reasonably expend and lay out in executing the said trust But also what they shall reasonably and respectively deserve for their care and trouble in managing the same and it is also my will and directions that in case the Interest and profits of the residuum of my said Real and Personal Estate and of the Interest and profits of the said four hundred pounds after my said Wifes decease shall not prove sufficient for the bringing up maintaining and educating my said Children that then all or any part of the said residue of the said principal money so directed to be put out at Interest as aforesaid or of the said four hundred pounds after the decease of my said Wifes decease shall be applied for that purpose In Witness whereof I the said Richard Bonsey have to this my last Will and Testament contained in two sheets of paper set my hand to the first and my hand and seal to the last the day of June in the twenty ninth year of the Reign of our Sovereign Lord George the second by the grace of God of Great Britain France and Ireland King defender of the Faith &r and in the year of our Lord one thousand seven hundred and fifty five Rich.d Bonsey Signed sealed I Richard Bonsey of Horsell in the County of Surry Gentleman do this thirtieth day of August in the year of our Lord one thousand seven hundred and Sixty eight make and publish this Codicil to my last Will and Testament in manner following whereas since the Signing and Sealing of my last Will and Testament which through mistake the day of the month was left out which I do this day renew and confirm Henry Roake the Elder and Henry Roake the younger parties to whom I give my Estate in Trust are deceased Now I do hereby declare that my Will is and I do hereby appoint William Edmead the Elder of Stanes in the County of Middlesex Gent and Richard Roake of Kettlewell of Horsell in the County of Surry Gentleman their heirs and assigns In Trust instead of the said Henry Roake the Elder and Henry Roake the younger deceased and do hereby give and devise to them full power as is in and by my said Will and Testament published and declared to be given to Henry Roake t and Henry Roake deceased as aforesaid and further I hereby order and declare my will is I give my dear and loving Wife for term of her natural life all that my freehold Messuage or Tenement where I now dwell together with the outbuildings yard Lane and Backside and garden belonging to the same and also one Close of Meadow adjoining the Garden containing by estimation twenty acres and an half more or less and also all my Household Goods and Furniture plate and Linnen for term of her natural life and from and after her decease the whole to be divided amongst my Children equal by my Trustees as by the will directs and it is my full intent and meaning and my will is that although one of my Children at the time of the signing of my will aforesaid was unborn the said Child shall partake and be coheir and have equal share in all things even the same as if he had been then born according to the directions of my said will and Lastly it is my desire that this my present Codicil be annexed to this my last Will and Testament to all intents and purposes In Witness whereof I have hereunto this my last Will and Testament contained in two sheets of paper set my hand and seal this day above written Rich.d Bonsey Signed sealed published and declared by the above named Richard Bonsey as a Codicil to be annexed to his last Will and Testament in the presence of _ John Alexander _ William Stevens _ John Knowls.
