In the Name of God Amen I John Watterer of Mayford in the Parish of Woking in the County of Surry Yeoman considering the uncertainty of this mortal life and tho weak in body yet of a sound and disposing mind and memory blessed be almighty God for the same Do make this my last Will & Testament in manner and form following (that is to say) First and principally I commend my Soul to God and my Body to the Earth to be decently buried at the discretion of my Executrix hereinafter named As to such worldly Estates as God of his Goodness has bestowed upon me after payment of all my just Debts Funeral Expences and proving of this my Will I dispose of as follows (that is to say) I give and bequeath unto Jesse Algrove and my sister Sarah his Wife for and during their natural lives all that Copyhold Estates late the Property of my late Uncle Jesse Watterer deceased (the same being duly surrendered to the use of my Will) containing two messuages or tenements together with the five acres and a half of Land thereunto belonging and held of the Manor of Woking in the said County of Surry Also ten acres of Freehold arable Land late the Property of my said Uncle Jesse Watterer deceased lying and being in the said Parish of Woking in the said County of Surry To have and to hold to the said Jesse Algrove and Sarah his Wife for and during all their natural lives and at their decease to the Issue of their two Bodies share and share alike (if more than one) as Tenants in common and not as joint Tenants absolutely But in default of such Issue then over to my Brothers and Sisters James Jesse Elizabeth (the wife of George Chitty) and Jane Watterer as Tenants in common and not as joint Tenants I give devise & bequeath all and every my other Freeholds and Copyholds Estates (the Copyhold being duly surrendered to the use of my Will) unto my Uncle James Stedman of Horsell Yeoman John Kemp of Woking Yeoman in the said County of Surry Upon the Trust nevertheless and to the intents & purposes hereinafter declared of and concerning the same (that is to say) to pay the Products Profits and Rents thereof (after deducting every Imposition & Expences) as follows (that is to say) To pay unto my Sister Sarah Algrove the full Sum of Five pounds per Year for and during the term of ten years free from all deductions whatsoever and the residue and Remainder thereof to Pay unto my said Brothers and Sisters James Jesse Elizabeth (the wife of George Chitty) and Jane Watterer by equal proportions for and during their natural lives as Tenants in common and not as joint Tenants absolutely and after their several deceases Then over to each and every their several Issue and Issues absolutely for ever nevertheless my Will and meaning is that should my said Trustees hereafter think proper and for the advantage of the said Legatees to sell the Freehold and Copyhold Estates I hereby give them power and authorize them so to do And the monies from the Sale thereof then arising in their Names to place in the Funds or on other good securities as to them shall seem best and the Interest and Product thereof (after deducting what Expences they may sustain or be put unto by means thereof) to dispose thereof as follows (that is to say) to pay unto my said sister Sarah Algrove the said Sum of Five pounds per year for the said Term of ten years should the said Term be unexpired but so that she is paid no more in the whole than the Sum of Fifty Pounds And the rest residue and Remainder thereof to pay unto my Brothers and Sisters James Jesse Elizabeth (the wife of George Chitty) and Jane Watterer by equal portions for and during their natural lives as Tenants in common and not as joint Tenants absolutely and after their several deceases then over to each and every their several Issue and Issues absolutely for ever I give and bequeath unto the said Jesse Algrove and Sarah his Wife one half of my Household Goods and the other half unto my said Sister Jane Waterer And lastly as to the rest residue and remainder of my personal Estates Goods Plate Linnen Wearing Apparel and Chattels of what kind or nature soever I give and bequeath unto my said Trustees to dispose thereof for the most Monies they can get and to apply the same towards the payment of my Debts and upon further Trust that the said James Stedman and John Kemp shall and may retain the sum of five pounds each for their trouble in performing the Trusts of this my Will I do hereby nominate constitute and appoint the said James Stedman and John Kemp Executors to this my last Will and Testament hereby revoking and making void all and every former Will by me at any time before made In Witness whereof I have hereunto set my Hand and Seal this fifth day of April in the year of our Lord God one thousand seven hundred and ninety nine. N.B The Words Sister and most wrote interlined and Sarah his Wife one half wrote upon an Erasement John Waterer Signed sealed published and declared by the above named John Watter the Testator as and for his last Will & Testament in the presence of us who at his request and in his presence have subscribed our Names as Witnesses thereto James Snelling Benjamin Spooner John Goring. This Will was proved at London the thirteenth day of February in the Year of our Lord one thousand eight hundred before the Right Honourable Sir William Wynne Knight Doctor of Laws Master Keeper or Commissary of the prerogative Court of Canterbury lawfully constituted by the Oaths of James Stedman and John Kemp the Executors named in the said Will to whom Administration was granted of all and singular the Goods Chattels and Credits of the Deceased having been first sworn (by Commission) duly to administer.
