In the Name of God Amen I James Waterer the Elder of the parish of Wokeing in the County of Surry Yeoman being of sound and disposing mind memory and understanding praised be God for the same do make publish and declare this my last Will and Testament as follows I give and devise unto my dear Wife the use and occupation of two rooms in the dwellinghouse wherein I now live with a convenient part of the Garden belonging thereto and so direct that she shall have the same for the term of her natural life and that she shall be provided with fuel at the expence of my Estate during the time aforesaid and I give and bequeath unto my said dear Wife the bed bedstead and furniture thereof in the room wherein we normally sleep and such other part of my household goods and furniture as she shall chuse to take sufficient to furnish two rooms in my said dwellinghouse for her own use and I do give and bequeath unto each of my daughters Elizabeth Waterer and Mary Waterer a bed bedstead and the furniture thereof for their own use And I give devise and bequeath unto my Son James Waterer all and every my freehold leasehold and copyhold messuages farms lands tenements hereditaments and real Estate whatsoever and wheresoever situate lying and being subject to the said devise to my said Wife hereinbefore contained and also all my personal Estate of every sort and kind not hereinbefore disposed of to have and to hold my said real and personal Estate unto and to the use of my said Son James Waterer his heirs Executors administrators and assigns according to the respective tenures and qualities thereof respectively subject nevertheless and charged and chargeable with the payment of all my just debts and funeral and Testamentary expences and also subject to and charged and chargeable with the annuity yearly rent or sum of fifty pounds hereinafter mentioned and devised to my said Wife and with the payment of the several legacies or sums of money by this my Will given and bequeathed at the times and in manner by this my Will directed And I do hereby give devise and bequeath unto my dear Wife Sally Waterer and her assigns for and during the term of her natural life one annuity or clear yearly rent or sum of fifty pounds of lawful money of Great Britain free and clear of and from all taxes and deductions whatsoever the said annuity to be chargeable and charged on and issuing and payable out of my said messuages farms lands tenements hereditaments and real and personal Estates hereinbefore given devised and bequeathed to my said Son James Waterer and to be paid and payable by him my said Son James Waterer by two even and equal half yearly payments (that is to say) on the feast days of the Annunciation of the Blessed Virgin Mary and Saint Michael the Archangel in every year the first payment thereof to begin and be made on such of the same feasts as shall first and next happen after my decease and I do hereby charge and subject my said freehold copyhold and leasehold messuages arms lands tenements hereditaments and real and personal Estate to and with the payment of the said annuity or yearly rent or sum of fifty pounds accordingly and in case the said Annuity or yearly rent or sum of fifty pounds or any part thereof shall at any time during the life of my said Wife Sally Waterer be behind or unpaid by the space of twenty one days next after any or either of the said feasts or days of payment whereon the same is hereinbefore directed to be paid being lawfully demanded that then and so often it shall be lawful to and for my said Wife and her Assigns to enter upon the said messuages farms lands tenements hereditaments and real and person Estate hereby charged with the said annuity as aforesaid and to distrain for the same annuity or for so much thereof as shall be so in arrear and the distress and distresses then and there found to detain and keep until she shall be fully paid and satisfied all such arrears of the said annuity with costs and charges in and about the making and keeping the said distress for the same and in case the said annuity or any part thereof shall be behind or unpaid by the space of forty days next after any of the said days of payment whereon the same ought to be paid as aforesaid that then and so often it shall and may be lawful to and for my said Wife and her assigns to enter into and enjoy all and singular or any part or parts of the said premises hereby charged with the said Annuity as aforesaid and to receive and take the rents issues and profits thereof for her and their own use and benefit until she or they shall be therewith and thereby paid and satisfied or until the person or persons who shall be entitled to the immediate possession of the said Premises shall pay satisfy and discharge unto my said Wife all the arrears of the said annuity and every part thereof together with all costs damages and expences whatsoever to be laid out and sustained by reason of the nonpayment thereof And I do hereby declare my Will to be that the several bequests hereinbefore made to my said Wife are and were by me made and meant and intended to be made to her in lieu bar and full satisfaction of and for all such dower and thirds at the common law as she my said Wife can shall or may or otherwise could or might have claim challenge or demand in upon from or out of all or any of the hereditaments and real Estate whereof I have been now am or at any time or times hereafter shall or may be seized of any Estate of freehold during the Coverture between us and I direct my said Wife within three Calendar months after the decease by some deed or writing under her hand and seal to be prepared at the expence of my Estate to declare her acceptance of the said bequest to her hereinbefore contained in lieu bar and satisfaction of such dower and thirds accordingly and in case my said Wife shall refuse to accept the bequest aforesaid and release her dower and thirds in manner aforesaid then I do hereby revoke the said bequest hereinbefore contained to and in favour of my said Wife and declare the same shall be null and void and I give and bequeath unto my Son James Waterer and daughter Mary Waterer their Executors and administrators the sum of one thousand pounds of lawful money aforesaid upon trust to lay out and invest the same in their names on Government or real Securities at Interest in England and do and shall alter vary transfer and transpose the stocks funds or Securities so to be purchased as they or the Survivor of them shall think proper and do and shall pay the dividends and interest of the said trust monies stocks funds and securities unto my daughter Elizabeth Waterer and her assigns for and during the term of her natural life for her own sole separate personal and particular use and benefit independantly and exclusively of any husband with whom she may intermarry And I do hereby declare that the same or any part thereof shall not in any case be subject or liable to the debts control or Engagements of any such husband and after the decease of my said daughter Elizabeth Waterer do and shall stand possessed of and interested in such stocks funds and Securities and the dividends and Interest thereof in trust for all and every the children of my said daughter Elizabeth Waterer living at the time of her decease and the Issue of such of them as shall be then dead in equal shares and proportions but the Issue of any such deceased child shall take the parents share only to be paid to such children or Issue at their respective ages of twenty one years unless such Events shall happen in the life time of my said daughter in that case I direct the same shall be paid or transferred immediately after her decease And I give and bequeath unto my said Son James Waterer and daughter Elizabeth Waterer their Executors and administrators the like sum of one thousand pounds of lawful money aforesaid upon trust to lay out and invest the said last mentioned sum of one thousand pounds in their names on Government or real Securities at Interest in England and do and shall alter vary transfer and transpose the last mentioned stocks funds or Securities so to be purchased as they or the Survivor of them shall think proper and do and shall pay the dividends and interest of the said trust monies stocks funds and securities unto my daughter Mary Waterer and her assigns for and during the term of her natural life for her own sole separate personal and particular use and benefit independantly and exclusively of any husband with whom she may intermarry And I do hereby declare that the same or any part thereof shall not in any case be subject or liable to the debts control or Engagements of any such husband and after the decease of my said daughter Mary Waterer do and shall stand possessed of and interested in such stocks funds and Securities and the dividends and Interest thereof in trust for all and every the children of my said daughter Mary Waterer living at the time of her decease and the Issue of such of them as shall be then dead in equal shares and proportions but the Issue of any such deceased child shall take the parents share only to be paid or transferred to such children or Issue at their respective ages of twenty one years unless such Events shall happen in the life time of my said daughter in that case I direct the same shall be paid or transferred immediately after her decease and in case of the death of either of my said daughters leaving any children or Issue under the age of twenty one years it shall be lawful for my trustees or trustee for the time being to apply the dividends and Interest of the said respective trust monies stocks funds or Securities in for and towards the cloathing maintenance and Education of such children or issue in proportion to their respective shares and interests therein And I do hereby charge and make subject my said messuages farms lands tenements hereditaments and real and personal Estates above given to my said Son James Waterer to and with the payment of the said two several sums of one thousand pounds at the End of sic calendar months after my decease And I give and bequeath unto my said Wife for her own use the sum of twenty pounds a piece to be paid to her within one week after my decease Also I give and bequeath unto each of my said daughters Elizabeth Waterer and Mary Waterer the sum of twenty pounds a piece to be paid within one week next after my decease for their respective own absolute use and benefit And I do hereby nominate and appoint my said Son James Waterer Executor of this my Will provided & my Will is that my said trustees hereinbefore named and the Survivor of them and the heirs Executors and administrators of such Survivor shall and may at all times in the first place reimburse and indemnify themselves himself and herself and deduct and retain to themselves himself and herself out of the said trust premises all such costs charges damages and expences as they or either of them shall or may at any time expend lay out and be put unto for or by reason or means of the trusts hereby in them reposed and that neither of them shall be answerable for any loss which may happen to the said trust premises unless such loss happen through his her or their wilful neglect or default nor one for the other of them nor for more monies than shall actually come to each of their hands respectively but each of them for his and her own acts deeds receipts neglects and defaults only nor for any loss which shall or may happen by occasion of depositing any money in the hands keeping or custody of any public or common Banker And I do hereby revoke and make void all former and other Wills by me at any time heretofore made and do declare these presents only to be and contain my last Will and Testament In Witness whereof I the said James Waterer the Testator have to this my last Will and Testament contained in five sheets of paper set my hand to the first four sheets and my hand and Seal to this fifth and last sheet the thirty first day of January in the year of our Lord One thousand Eight hundred and twenty nine _ James Waterer _ Signed sealed published and declared by the above named James Waterer the Testator as and for his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as Witnesses _ Richard Collyer of Woking Farmer _ Henry Grove of Woking Farmer _ Edmund Vincent of Guildford Clerk to Mr Hockley Sol.r. This is a Codicil to be added to and taken as part of the last Will and Testament of me James Waterer within written I give devise and bequeath unto my dear Wife Sally Water one annuity or clear yearly rent charge of twenty pounds per annum to be paid and payable to her at the same times and with like powers of distress and entry for recovery thereof as are within mentioned with respect to the within mentioned annuity of fifty pounds it being my Will and meaning that she should have and enjoy the said annuity of twenty pounds in addition to the said annuity of fifty pounds during her life and I charge and subject my messuages or tenements farms lands tythes and hereditaments and real and personal Estate within by me given devised and bequeathed to my Son James Waterer to and with the payment of the said annuity of twenty pounds accordingly And I do hereby declare that in case either of my daughters Elizabeth or Mary shall depart this life without Issue that the legacy or sum of one thousand pounds within given to or in trust for her so dying shall go and be paid to my next of kin according to the statute of distribution And in all other respects I ratify and confirm my said Will save as the same is hereby altered In Witness whereof I have hereunto set my hand and seal the fourth day of September one thousand Eight hundred and thirty _ James Waterer _ Signed sealed published and declared by the above named James Waterer the Testator as and for a Codicil to be added to and taken as part of his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as Witnesses _ Henry Grove _ Samuel Daborn _ Edmund Vincent. Proved at London with a Codicil 25th Oct.r 1830 before the Judge by the Oath of James Waterer the Son the sole Executor to whom Administration was granted being first sworn by commission duly to Administer.
