This is the last Will and Testament of me Johnson William Savage formerly of the City of Chester but now of Box Grove Guildford in the County of Surrey a Colonel in the Army Retired late of His Majesty's Corps of Royal Engineers. I appoint my wife Anne Elizabeth Savage and my sons Arthur Johnson Savage and Francis Richard Savage (hereinafter call "my Trustees") to be the Executors and Trustees of this my Will. I give and bequeath all my plate linen china glass books pictures prints wines liquors furniture and other household effects including my Violoncellos and other musical instruments and music to my Wife absolutely if she shall survive me And in case she shall die in my lifetime I give and bequeath the same to my children Arthur Johnson Savage Evelyn Chomley Lyle Smyth Francis Richard Savage Gerald Fahourdin Savage and Mary Norah Grace Savage or such of them as shall survive me to be fairly and equally distributed among them in such manner as they shall agree upon or in case they shall be unable to agree then as shall be settled by my Trustees whose decision shall be final. I devise unto and to the use of my Son Arthur Johnson Savage free of all duties All that freehold property which was devised to me by the Will of my Father Johnson Savage M D Royal Artillery Deputy Inspector General of Hospitals containing Four Acres one rood and twelve perches or thereabouts known as Blairs Hill or Castle situate at Sunday's Well in the North Liberties of the City of Cork Ireland. I give and bequeath free of duty to my Son Francis Richard Savage in consideration of the loss he has sustained in consequence of his wound a sum of One thousand pounds Five pounds per centum War Stock 1929-1947 and I declare that my Trustees may either transfer to my said Son such a sum of stock forming part of my estate or may purchase in his own name such a sum of stock with money to arise from my estate but with power for my Trustees to satisfy such legacy by transfer or purchase of a sum of some other species of stock being a Trustees investment which will produce a gross annual income of Fifty pounds. I give and bequeath to my Wife free of duty a legacy or sum of Two Hundred pounds to be paid to her immediately after my death. I devise and bequeath all my real and personal estate not hereby otherwise disposed of unto my Trustees upon trust that my Trustees shall sell call in and convert into money the same or such part thereof as shall not consist of money and shall with and out of the moneys produced by such sale calling in and conversion and with and out of my ready money pay my funeral and testamentary expenses and debts and the legacy hereinbefore bequeathed to my Wife and shall with the consent in writing of my said Wife during her life and after her death at the discretion of my Trustees invest the residue of the said moneys with power for my Trustees from time to time with such consent or at such discretion as aforesaid to vary such investments and shall stand possessed of the said residuary trust moneys and the investments for the time being representing the same (hereinafter called "the Residuary Trust Funds") In trust to pay the Income thereof to my said Wife during her life and after her decease In trust for all my Children in equal shares except that my said Son Arthur Johnson Savage shall bring into hotchpot and account for as part of his share of the Residuary Trust Funds the sum of One thousand four hundred pounds which for the purpose of this Clause shall be treated as the Value of a sum of One thousand pounds New South Wales Three pounds ten shillings per centum Inscribed Stock and a sum of Four hundred pounds New South Wales Four pounds per centum Inscribed Stock which I gave to or settled upon him on his Marriage. Provided that if any child of mine dies in my lifetime leaving issue living at my death the share in the Residuary Trust Funds to which such child would have been entitled if living at my death shall nevertheless go and devolve in like manner and be held on the like trusts as if the child so dying had survived me and died immediately after my death But so nevertheless that this proviso shall operate by way of direct gift to the person or persons (if any) beneficially interested under the Will or on the intestacy of such child and shall not make such a share part of the estate of such child so as to be liable to death or estate or other duty I declare that my Trustees may postpone the sale and conversion of my real and personal property or any part thereof and in particular may continue any investments whether the same are of a nature authorised by law for trust funds or not for so long as they shall think fit without being answerable for any loss arising thereby and the rents profits and income to accrue from and after my death from such part of my property as shall for the time being remain unsold and unconverted shall after payment thereout of all such expenses and outgoings as in the opinion of my trustees ought to be paid out of income be paid and applied to the person or persons and in the manner to whom and in which the income of moneys produced by such sale and conversion would for the time being be payable or applicable under this my Will if such sale and conversion had been actually made. In Witness whereof I have to this my last Will and Testament contained on this and the two preceding sheets of paper set my hand this fourth day of November One thousand nine hundred and twenty one. Whereas I have recently given to my Son Francis Richard Savage a sum of One thousand pounds Cash Now I hereby revoke the Legacy of a sum of One thousand pounds Five pounds per centum War Stock 1929-1947 given and bequeathed by my Will to my said Son Francis Richard Savage. Be it known that Johnson William Savage of Box Grove Guildford in the County of Surrey died there on the 7th day of June 1929 And be it Further known that at the date hereunder written the last Will and Testament with a Codicil (a copy whereof is hereunto annexed) of the said deceased was proved and registered in the Principle Probate Registry of His Majesty's High Court of Justice and that Administration of all the Estate which by law devolves to and vests in the personal representative of the said deceased was granted by the aforesaid Court to Arthur Johnson Savage and Francis Richard Savage sons of deceased two of the Executors named in the said Will Anne Elizabeth Savage widow the relict of deceased the other Executor therein named having renounced probate thereof and of the said Codicil. And it is hereby certified that an Affidavit for Inland Revenue has been delivered wherein it is shewn that the gross value of the said Estate in Great Britain (exclusive of what the said deceased may have been possessed of or entitled to as a Trustee and not beneficially) amounts to œ14145. 0. 4 And it is further certified that it appears by a Receipt signed by an Inland Revenue Officer on the said Affidavit that œ1128.15. 10 on account of Estate Duty and interest on such duty has been paid.
