This is the last Will and Testament of me William Cobbett of Kingston upon Thames in the County of Surrey Malster I hereby appoint William Turner the younger of East Molesey in the Said County Victualler and Christopher Bythewood of Kingston aforesaid Glazier and Painter to be Executors of this my Will and I do hereby authorize empower and direct them or the survivor of them and the heirs and assigns of such survivor to make sale and dispose of all my copyhold or customary messuage or Tenement Malthouse and Premises now in my own occupation situate on the south side of London street in Kingston aforesaid and holden of the manor of Kingston Canbury otherwise Canonbury and all other my real estates whatsoever and wheresoever with all convenient speed after my decease either by public auction or private contract for the most money that can be reasonably obtained for the same and I hereby will and declare that the receipt or receipts of the said William Turner and Christopher Bythewood or the survivor of them and the heirs and assigns of such survivor shall be an effectual discharge or effectual discharges in Law and Equity to the purchasers of my said estate for his her or their purchase money and that such purchaser or purchasers shall not be answerable or accountable for the loss application misapplication or non application of his her or their purchase money after having obtained such receipt or receipts for the same as aforesaid and the money which shall arise from the sale of my said estates after deducting all the costs and charges attending the same I will and direct shall become part of my personal estate and I give to my said Executors and to two other Inhabitants of Kingston aforesaid in Vestry Assembled three hundred pounds four per cent Consolidated Annuities upon trust that they and the future trustees thereof to be appointed as is hereinafter mentioned shall yearly forever pay the dividends or interest of the said Annuities into the hands of the Churchwardens for the time being of Kingston aforesaid to be by them distributed in bread amongst the most necessitous poor inhabitants of the Town of Kingston aforesaid upon the first day of January in every year for ever except when that they shall fall on a Sunday and then on the following Monday and in order to keep up a succession of trustees of the said Annuities for the purpose aforesaid I will and desire that when the said Trustees shall by death resignation or incapacity be reduced to two then two new Trustees shall be appointed by the said inhabitants in Vestry assembled and the said Annuities shall thereupon be transferred to such new Trustees jointly with the surviving or continuing Trustees and so on for ever as often as the Trustees for the time being shall be reduced to two also I give to such of the children of Charles Ayres deceased brother of my late Wife as shall be living at my decease one hundred pounds to be equally divided between them if more than one also I give to Lydia Clark and Henrietta Clark daughters of John Clark of East Molesey aforesaid ffarmer fifty pounds each also I give to the said William Turner one hundred pounds also I give to the said Christopher Bythewood twenty pounds and all the rest and residue of my personal estate including the money that shall arise by sale of my real estate after payment of my debts legacies funeral and testamentary expences and the expences of my said Executors and Trustees in and about the execution of this my Will I dispose of as follows vizt one third part of the said residue I give unto my niece Sarah Rose only child of my eldest Sister Sarah Davis deceased if she shall be living at my decease but if she shall die before me I give the same to such of her children as shall be living at my decease to be equally divided between them if more than one one other third part of the said residue I give to my sister Ann Elliott if she shall be living at my decease but if she shall die before me then I give the said last mentioned third unto such of her children as shall be living at my decease to be equally divided between them if more than one one third part of the said remaining third part of the said residue I give unto my nephew John Boxall son of my late sister Elizabeth Boxall if he shall be living at my decease but if he shall die before then I give the same unto such of his children as shall be living at my decease to be equally divided between them if more than one one other third part of the said remaining third part of the said residue I give unto such of the children of my late niece Martha Browing deceased another daughter of my said late sister Elizabeth Boxall as shall be living at my decease to be equally divided between them if more than one and as to the other third part of the said remaining third part I will and direct shall be placed out at interest by my said Executors and Trustees in their names in the public funds and from time to time as the same interest or dividends shall become due to pay the same to my niece Lettice Jones one of the daughters of my said late sister Elizabeth Boxall and now the Wife of John Jones ffisherman if she shall be living at my decease for and during her life and after her decease to pay the same interest and dividends to the said John Jones for life and in case both shall happen to die then I give the said last mentioned stock ffunds dividends or interest unto such of their children as be living at my decease to be equally divided between them if more than and if any person or persons under the above disposition of the said residue shall be a Minor or Minors at the time he she or they shall become entitled to any part of it then I direct my said Executors to invest the part or parts of such minor or minors in some of the public funds and apply the dividends thereof in the maintenance and education of such minor or minors respectively or otherwise for his her or their benefit during such minority and I hereby declare that it shall be lawful for such Executors or Trustees to deduct and retain out of my estates all such costs charges damages and expences as they shall respectively pay sustain or be put unto in the execution of the trusts hereby in them reposed and that they shall not be answerable or accountable for the acts deeds neglect and defaults of each other but each of them for his own acts deeds neglect and defaults only nor shall they or either of them be answerable or accountable for any loss or damage which shall happen to my said estates or any part thereof unless the same shall happen by or through their respective wilful neglect or default and I do hereby revoke every other will by me made In Witness whereof I the said William Cobbett
