In the Name of God Amen I James Martin of Bisley in the County of Surry Yeoman do make and ordain this my last Will and Testament as followeth First I commend my Soul to the Mercies of God and my Body to the Earth to be decently buried at the discretion of my Executrix hereinafter named and my Worldly estate I give and dispose of the same as followeth First my Will and meaning is that my Executors shall with all convenient speed after my Death convert my all my Personal estate into Money and the same to dispose of as I shall hereinafter direct And whereas I hold to me and my Heirs A copyhold Cottage and parcel of Land also my Messuage or Tenement and other Copyhold Lands lying in the Manor of Bisley and the same hath or intend to surrender to the use of my Will therefore I give and devise unto my Kinsman John Chitty the younger Son of John Chitty the Elder of Windlesham in the County of Surry Yeoman all that my Copyhold Cottage and parcel the which I now lives in situate in Bisley with all and every its appurtenances to hold unto him the said John Chitty the younger aforesaid and his Heirs and Assigns for ever also I give and bequeath unto him the said John Chitty the younger the sum of ten pounds of lawful money of great Britain to be paid unto him in Six Months after my decease I give and bequeath unto my Kinsman George Martin of Chobham (that is to say) my Brother William Martin's Son the sum of Fifty pounds of like lawful Money to be paid unto hime in Six months after my decease I give and bequeath unto my Kinsman James Martin Son of John Martin who was One of the Sons of my Brother John Martin the sum of Fiftee pounds of like lawful Money to be paid unto him in Six months after my decease of like lawful Money to be paid unto hime in Six months after my decease my Kinsman James Janeway One other of the grandsons of my Brother John Martin the Sum of Five pounds of like lawful Money within Six months after my decease I give and bequeath unto my loving Kinsman John Chitty the Elder of Windlesham in the County of Surrey yeoman all that my copyhold Messuage or Tenement with the Barns Stables Outhouses Orchards Gardens and two Acres of Land called Palmers and alsotwo Acres of Land in a Common Field called Wide Croft and One Close of Land called Westwood with all and every the Appurtenances All lying and being near Bisley Green within the said Manor of Bisley to hold unto him the aid John Chitty the Elder In trust only to sell the same with all convenient speed after my death for the best price he can get for the same and to pay himself all his reasonable Charges (out of the money so made) as he shall be at in the Execution of his trust and all the moneys so made and had of the said Copyhold Messuages or Tenements Land and Premises aforesaid after all the said charges and expences of the Selling and Execution of the said trust aforesaid be fully satisfied and paid out of the said Moneys The Rest of the said Moneys so made and had shall be added unto the Rest of my moneys made of my Personal Estate and what shall remain of all my said Moneys so made and had after all my just debts Funeral expences and all the Legacies by me given be fully satisfied and paid out of the same that then my Will and meaning is that all the Rest and Residue of all my said Moneys so made and had shall And I do give and bequeath the same to and amongst all my Brother John Martin's Sons and Daughters as shall be living at my death but not to have an equal Share but that all the Sons of of my Brother John shall have ten pounds a piece more than the Daughters further my Will is that all the Rents and profits as shall be made of the said Premises before it is sold shall be divided to and amongst all my Brother John Martin's Sons and daughters equally And I do will and ordain for the doing executing and perfect finishing whereof do by these presents give grant will and transfer unto my loving Kinsman John Chitty the Elder of Windlesham Yeoman aforesaid full power and authority to grant apiece bargain and sell convey and issue all that my said copyhold Messuage Lands and premises in Bisley aforesaid called Palmers Wide Croft and Westwood with all and every their appurtenances to any person or persons and their Heirs for ever according to the Custom of the said Manor of Bisley by all and every such lawful ways and means as the Law and Custom of the said Manor shall direct but in case the said John Chitty the Elder should dye before he have finished the whole trust to him by me given that then I do hereby give unto his Son John Chitty the Younger the full power and authority to do in all things to execute this my last Will and Testament in the same power and authority in all things as I have given to his Father And I desire my good Friend George Rempnant of Bisley Yeoman to be Overseer to see this my last Will and Testament faithfully executed And I do give unto him One Guinea over and above his reasonable Charges I give unto my loving Kinsman John Chitty the Elder of Windlesham aforesaid One Guinea and I do hereby constitute ordain and make my sole Executor In trust only to this my last Will and Testament In Witness whereof I have set my hand and seal the Six and twentieth day of April in the year of our Lord One Thousand seven Hundred Fifty and seven James Martin his mark Signed Sealed Published and declared by the Testator to be his last Will and Testament in the presence of us who subscribed our names as Witnesses in the presence of the testator Thomas Howard William Howard John Gyles This Will of James Martin late of the Parish of Bisley in the County of Surry deceased was proved on the thirtieth day of June in the Year of our Lord One Thousand Seven Hundred and Fifty Seven before the Reverend Richard Vincent Clerk a Surrogate by the Oath of John Chitty the sole Executor to whom administration was granted being first sworn duly to Administer.
