In the Name of God Amen I William Smither now of Bisley in the County of Surry being weak in body but of perfect sense and presence of mind thanks be to God I do make this my last Will and Testament as followeth Item I give to my Wife for term of Life the House wherein now I dwell with all the Furniture therein and Orchard and all thereto belonging and twenty pounds which I have on a Mortgage upon a House as the Widow Turner now lives in at Knaphill in the Parish of Woking in the County aforesaid and after the death of my Wife to my Daughter Jane and her Heirs Assigns for ever I give to my Son James only One shilling and likewise I give to my Son John only One shilling I give likewise to my Daughter Mary One shilling In Witness whereof I have hereunto set my Hand and Seal this thirtieth day of July in the year of our Lord One Thousand Seven Hundred and Fifty and Five The mark of William Smither Signed sealed published and declared by the above named William Smither for and as his last Will and Testament in the presence of us Witness James Miles Henry Whittall Thos. Skuller James Walker of Bisley in the County of Surry Labourer and Jane Walker (Wife of the said James Walker) severally make Oath that William Smither late of Bisley aforesaid sometimes since departed this Life but whilst he lived being of sound mind as they these deponents believe duly made and executed his last Will and thereof appointed Mary Smither his Wife his principal Legatee but named no Executor or Residuary legatee and they these deponents further depose that the said Mary Smither doth now live with them these deponents at Bisley aforesaid and by means thereof they these deponents are well acquainted with her state of health and they these deponents do further depose that the said Mary Smither is now so far impaired in her Intellects and Capacity that they verily and in their consciences believe she is incapable of acting or taking on her the Execution of the said Will The mark of James Walker Jane Walker 4th June 1756 The said James Walker and Jane Walker were sworn to the truth of this affidavit before me Geo Harris Surrogate present Tho Adderley NP On the Fourth day of June in the Year of Our Lord One Thousand Seven Hundred and Fifty Six a Commission issued to Jane Walker Wife of James Walker the natural and lawfull daughter and a Legatee named in the last Will and Testament of William Smither late of the Parish of Bisley in the County of Surry deceased to administer the goods chattels and credits of the said deceased with the said Will annexed for the Use and Benefit and during the Lunacy and Incapacity of Mary Smither Widow the Relict and principal Legatee named in the said Will and until she shall be capable of acting in her own name and not further or otherwise having been first sworn duly to administer No Executor or Residuary Legatee being appointed.
