This is the last Will and Testament of me John Hone of Bisley in the County of Surrey Esquire First I give and devise all that my Messuage Tenement or Farm Arable Land Meadow and Pasture Ground thereto belonging situate and being in the Parish of Bisley aforesaid now or late in the Occupation of John Stedman or his Assigns part whereof is Copyhold and surrendered to the use of my Will and also all those my Lands Tenements and Hereditaments situate lying and being in the parish of Esher in the said County of Surry now or late in the Occupation of .……. Hayman or his Assigns And also all that Messuage Tenement or Farm Lands …………. and Hereditaments situate lying and being in the Parish of Malden in the said County of Surry late in the Occupation of William Plank Part whereof is Copyhold and surrendered to the use of my Will And also all other my Lands Tenements and Hereditaments whatsoever and wheresoever and also all the Rents Issues and Profits Rights Members and Appurtenances to the same or any Part thereof belonging or in anywise appertaining To Hold unto the Revd Joseph Bell the elder of Ratcliffe in the county of Bucks Clerk and my Son in Law Harry St John Bell of Great Marlow in the said County of Bucks Surgeon Upon the several Trusts Intents and Purposes following (that is to say) As of for and concerning the said Messuage Lands Tenements Hereditaments and Premises situate and being in the several Parishes of Bisley and Esher aforesaid In Trust for my Grandson John Bell and the Heirs of his Body lawfully begotten or to be begotten Provided always and upon this Condition that the said John Bell shall and do release and convey all his Estate Right Title Claim and Property of in and to the said Freehold Lands and Premises in the Parish of Malden aforesaid unto my Grandson Joseph Bell and his Heirs within a convenient time after Request thereof made And in case the said John Bell shall neglect or refuse within the time aforesaid to convey his Right and Title to the said Lands in Malden aforesaid unto the said Joseph Bell the younger as aforesaid or if the said John Bell shall depart this Life leaving no Issue of his Body lawfully begotten Then as for and concerning the said Lands Tenements and Premises with the Appurtenances in the said Parishes of Bisley and Esher Upon Trust for the said Joseph Bell the younger his Heirs and Assigns at his age of twenty one years And as for and concerning the said Lands and Premises in the said Parish of Malden and also all other my Lands Tenements Hereditaments and Premises whatsoever with their Appurtenances In Trust for the said Joseph Bell the younger his Heirs and Assigns at his age of twenty one years but in case the said John Bell shall depart this Life without issue of his Body lawfully begotten and the said Joseph Bell shall dye before his said age of twenty one years Then I do give and devise all and every the said Lands Tenements Hereditaments and Premises whatsoever with their and every of their Appurtenances unto my said Son in Law Harry St John Bell his Heirs and Assigns for ever Also I give and bequeath unto Mary Stedman Spinster Daughter of John Stedman of Bisley aforesaid the Sum of thirty Pounds to be paid her by my Executors hereinafter named within twelve Months next after my Decease Also all the rest residue and remainder of my Goods Chattels Plate ready Money Mortgages Bonds Notes and Securities for Money Stock Share or dividend in any Fund or Funds and all other my Personal Estate and Effects whatsoever I give and bequeath unto my Granddaughter Celia Elizabeth Bell to be paid delivered and assigned unto her by my said Executors at the age of twenty one years And in the meantime it is my Will that my Executors shall receive the interest and produce thereof and apply the same for and towards her Maintenance and Education in such manner as they shall think fit And further it is my Will that my said Trustees and Executors shall not be answerable for any Losses in the Execution of the Trusts aforesaid except occasioned by wilful Neglect or Default nor shall one of them be answerable for the Acts deeds or Defaults of the other of them but each for his own Acts and Deeds only and they and each of them shall and may reimburse him and themselves all such Expenses as they shall necessarily be put unto in the said Trusts And Lastly I do hereby make and constitute the said Joseph Bell the elder and Harry St John Bell Executors of this my last Will and Testament revoking all former and other Will and Wills by me made In Witness whereof I the said John Hone have to this my last Will and Testament set my hand and Seal the fifth Day of January in the year of our Lord one thousand seven hundred and sixty eight ~ The Mark of + John Hone ~ Signed Sealed Published and declared by the said John Hone the Testator as and for his last Will and Testament the Day and Year aforesaid in the Presence of us who have hereunto set our Names as Witnesses in the Presence of the said Testator and of each other ~ Wm Williams ~ John Branscomb ~ Bartholomew Branscomb. This Will was proved at London the tenth Day of February in the year of our Lord one thousand seven hundred and sixty eight before the Worshipful George Harris Doctor of Laws and Surrogate of the Right Worshipful George Hay also Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oath of Harry St John Bell one of the Executors named in the said Will to whom Administration was granted of all and singular the Goods Chattles and Credits of the said deceased he having been first sworn duly to administer Power reserved of making the like Grant to Joseph Bell the elder the other Executor named in the said Will when he shall apply for the same.
