In the Name of God Amen I Benjamin Stilwell of Westcott in the Parish of Dorking and County of Surrey Labourer being of sound mind memory and understanding and considering the uncertainty of this mortal Life do make and publish this my last Will and Testament ffirst and principally I recommend my Soul to God who gave it and my Body to the Earth to be decently Buried at the discretion of my Executrix hereinafter named and touching my worldly Estate I give and dispose as follows I give and devise unto my loving Wife ffrances all that my Copyhold Messuage now divided into two Tenements with the Orchards and Close of Land adjoining situate at Westcott aforesaid and now in the Occupation of myself and James King with all and every the Appurtenences.....unto my said Wife for and during the term of her natural Life and from and after her decease I give the same Messuages and Premises unto my youngest Son Stephen Stilwell his heirs and assigns for ever Subject nevertheless and chargeable and I do hereby expressly charge my said Messuages and Premises with the payment of the following Legacies or Sums of Money that is to say To my five Children namely Benjamin Stilwell, John Stilwell, ffrances now the Wife of James Whiteman, Sarah now the Wife of James Hewit and Abigail Stilwell Spinster the Sum of Eight Pounds each to be paid unto them by my said Son Stephen within twelve Months next after the decease of my said Wife And if any of my said Children shall die before my said Wife then I will that the share of him or her so dying be given unto his or her Children share and share alike But if any of them shall die without leaving a Child or Children Then I will that his or her part so dying shall be equally divided between the survivor or survivors of my said children share and share alike and whereas my said Copyhold Estate is now Mortgaged for seventy five pounds I will and direct that the above named Legacys be void and not payable unto my above named Children And whereas I am now possessed of three hundred and fifty pounds three Per Cent reduced Bank Annuities now standing in my Name and Transferable at the Bank of England I do hereby give and devise the same unto my loving Wife ffrances To have and to hold unto her for her own proper use and benefit I also give and bequeath unto my said Wife ffrances all and singular my Household Goods Live Stock Plate ready Money Book debts or any Securitys for Money for her own proper use and Benefit And all the Rest and Residue of my Personal Estate whatsoever and wheresoever the same may be after paying and discharging all my just Debts ffuneral Expences and Proving this my Will I give the same unto my said Wife ffrances for her own proper Use and Benefit And Lastly I nominate and appoint my said Wife ffrances sole Executrix of this my Will hereby revoking and making void all former Will or Wills or any other writing purporting to be so declaring this only to be my last Will and Testament In Witness whereof I have hereunto set my Hand and Seal this ffifth Day of December in the year of our Lord one thousand seven hundred and eighty nine Benjamin Stilwell Ann Growcutt Thomas Trillen...
