This the last will and Testament of me, Edward John Collins of Richmond in the county of Surrey Brewer First I desire to be decently buried at the discretion of my Executors hereinafter named I give & bequeath unto my dear wife Sarah Collins the sum of three hundred pounds for her immediate use Also I give unto my said wife all my linen pictures prints plate liquors china and my best set of Glass and such part of my household furniture as she may wish to retain to and for her absolute use and disposal of and I give desire and bequeath all and singular my household furniture and all my Freehold Copyhold and Leasehold Estates whatsoever and wheresoever in partnership with my Brother William Collins all my part and shares on? Therein and in the trades or Businesses of a Brewer and Maltster now carrying on by us at Richmond and in the plant Coppers Vessels Casks implements and utensils ready money book and other debts and ? Stock but owing and belonging to the ?same and all other my Freehold Copyhold and Leasehold Estates whatsoever and wheresoever and all of my Estates and Effects whatsoever (not hereinbefore specifically given or disposed of) with their appurtenances unto and to the use of Fredrick Woodbridge the Third Son of my late Sister) and William Smith of Hill Street Richmond aforesaid Solicitor and their Heirs Executors administrators and assign according to the respective natures thereof upon trusts hereinafter mentioned ( that is to say) upon trust to sell and dispose of such part of my said household furniture as my said wife shall not think absolutely necessary for the use and to invest the monies arising there from the public Stocks or Funds of Great Britain to be applied in manner as is hereinafter directed as to my surplus monies after the payment of the annuity to my said dear wife hereinafter mentioned of and upon future trust to carry on said trades with my Brother and his Successor during the natural life or widowhood of my said dear wife and out of the gains and profits rents Issues and proceeds arising from thereby and rents and Profits of my said Freehold Copyhold and Leasehold Estates and and the Interest of any monies due and owing to me in the first place to pay and satisfy my proporsion Of the debts owing from the said trade and all expenses attending the same and all other debts funeral and Testamentary expenses and the Legacy hereinbefore by me given to my said wife and other fit and proper payments whatsoever to be made out of my Estate for carrying on the said trades otherwise? and subject there to I direct my said Trustees and the Survivor of them to pay over one clear annuity or yearly sum of eight hundred pounds to my said dear wife during the term of her natural life or widowhood for her maintenance and the maintenance and bringing up our Children the same to commence from my decease and to be paid her quarterly on the four most usual quarter days in the year that is to say, the twenty fifth day of March the twenty fourth day of June the twenty ninth day of September and the Twenty fifth day of December in each year the first quarterly payment to begin and be made on such of the said quarter days as shall first happen next after my decease the same to be paid unto her own proper hands during her life and widowhood and also the clear yearly sum of one hundred pounds by like quarterly payments to provide a residence for them and after payment thereof to invest the surplus monies either in the purchase of such freehold copyhold or leasehold estates as may be thought fit and proper by my said Trustees for the better carrying on and of extending the said partnership business (but not for the purchase of Estates for any other purpose) or in the public Stocks or funds of Great Britain as my said Trustees shall see fit and think most advisable and from and after the decease of my said dear wife or in the event of her second marriage I desire that all and singular my said Freehold Copyhold and Leaseholds Estates as well as the Estate and effects as belonging to or forming part of my said trades or Businesses be sold and disposed off subject to the proviso hereinafter mentioned) and that the money arising therefrom be equally divided unto and amongst all my Children living at my decease or born in due time afterwards to be paid to them respectively when and and as they shall respectively attain their ages of twenty five years And I declare that when and as my said estates shall be sold that the receipt or receipts of my said trustees or the survivor of them shall be a good and sufficient discharge to purchase or purchasers thereof and that such purchaser or purchasers shall not afterwards be bound to see to the application or to the nonapplication or misapplication thereof and I declare my will to be that may said trustees or trustee shall and may let and demise all or any part of my said estates for any term not exceeding seven years so as the most improved yearly rent be taken for the same and that no fine premium or foregift be accepted for the granting thereof provided always and it is my further and desire that after the death of my said dear wife or her second marriage that my said Trustees or trustee for the time being shall and may continue my said trades And retain all of the real and personal property employed therein during the minority or respective minority of all or any or either of my sons and until they shall respectively attain the age of twenty five years and to allow my said son or sons to purchase the said trades or any part thereof at fair valuation in case my said sons or any of them shall be disposed or desirous to purchase the same and provided my said trustees shall think it advisable to continue to carry on my said trades during such time as aforesaid but not otherwise in case my said trustees shall not think it beneficial to my estate and the interest of all my children to carry on my said trades after the decease or second marriage of my said dear wife I h? that they do offer my share of and in the property in real and personal that then shall be employed in or attach to my aforesaid business to him My said Brother or his sons who then may be in the business (should he not then be living) at a fair valuation to be made by Men of judgement one to be chosen by my said trustees or trustees on behalf of my family and the other to chosen by my said Brother or his sons upon his or their paying the amount of such valuation contain twelve Calendar months then next after to my said trustees or trustee and I hereby desire my said trustees or trustee to convey surrender assign transfer or release all such partnership property Real and personal included in such valuation (whether it be to my said son or sons in the event aforesaid or unto my said Brother or his said sons) in such manner as they or any of them shall direct or appoint and that the receipt of my said trustees or trustee shall be a sufficient discharge for the same and I further will and desire that my said trustees or trustee shall and may be at liberty to employ such person and persons as they shall find necessary to assist in or be employed about in the carrying on the aforesaid trades or businesses during the time aforesaid and to allow such person or persons such Salary for their time and trouble therein as to my said trustees or trustee shall seem proper and in the event of said dear wife dying or marrying again before my children shall have attained the age of twenty five years then I direct that the share or shares of such of my children as shall not have attained that age shall be paid and applied for and towards their respective maintenance education And bringing up and that it shall and may be lawful to and for my said trustees or trustee in the mean time to set apart and apply any part of such share or shares of such child or children for and towards his her or their advancement in life and at such times and and in such manner as shall seem advisable to my said trustees or the survivor of them and I do thereby appoint my said dear wife during her widowhood Guardian of my said children and on her death or marrying again I appoint the said Frederick Woodbridge and William Smith to be their Guardians and I do hereby appoint my said dear wife and the said William Smith to be Executrix and Executor of this my will and do declare that it shall and may be lawful to and for my said executor executrix and executor and their respective heirs executors and administrators by and out of all or any of the Monies which by virtue of this my will or any trust therein declared shall come to their or any of their hands to deduct retain to and reimburse themselves all such reasonable costs charges and expenses as they respectively shall or may sustain expend or be put unto in or about the execution of this my will and that they or either of them shall be charged or chargeable only every of them for and with his and her own respective receipts payments and wilful defaults and not otherwise and shall not be charged or chargeable with or for any sum or sums of money other than such as shall actually respectively come to his her and their hands by virtue of this my will nor with or for any loss or damages which may happen in or about the execution of all or any of the trusts hereby in them reposed Without his her or their respective wilful default and hereby revoking all former wills by me made I declare this to be my last will and testament in witness whereof I the said Edward John Collins the testator have to this my last will and testament set my hand and seal this Third day of May in the year of our lord one thousand eight hundred and seventeen - Edwd JhO Collins (mark) Signed Sealed published and declared by the said Edward John Collins the testator as and for his last will and testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses Thomas Snowdall Clerk to MessR Collins /---/ W Smith Secondaries? Appeared personally James Woodbridge of Charlwood Park in the county of Surrey Esquire and Robert Smith Clerk to William Smith of Richmond in the said county Of Surrey Gentleman and jointly and severally made oath that they respectively knew and were well aquainted with Edward John Collins late of Richmond In the county of Surrey deceased for several years before and down to the time of his death and that having during such their acquaintances with the said deceased frequently by sawhim write and subscribe his name to writings they have thereby severally become well acquainted with the manner and character of his hand writing and subscription And and the deponents having now respectively viewed the paper writing hereto annexed which purports to be and contain a Codicil to the last will and testament of the said deceased which said Codicil begins thus “whereas in and by my last will” ends thus “I so direct my Trustees and Executors to observe the same and act accordingly in the management of my affairs” and thus is subscribed “Edwd Jno Collins” and having severally particularly noticed and observed the said recited subscription to the said Codicil They lastly jointly and severally made oath that they verily and in their conciances believe the same to be of the own proper handwriting and subscription of the said deceased – James Woodbridge – Robt Smith On Wednesday the twenty seventh day of January 1819 the said James Woodbridge and Robert Smith were duly sworn to the trust of the afore going Affidavit Before Me – Edward Everard M A Commisioner Left hand margin 2nd page On the 10th Day of June 1845, Admon ( the will and ) of the Goods Chattels and Credits of Edward John Collins late of Richmond in the County of Surrey deceased after mention by?/ Sarah Collins wife widow Deceased ? without?living ?? and one of the Executors named in the said will was granted to Henrietta Prideaux (wife of Samuel Were Prideaux) one of the mentioned and lawful Children of the said deceased ??
