This is the last Will and Testament of me Elizabeth Lady Howard Baroness 
Dowager of Effingham WIfe of the Right Honble Sir Cowpers Darcy Knight of 
the Bath as follows I desire to be buryed in a private manner at the discretion 
of my Executor in the vault at Lingwell in the County of Surry near the 
Remains of my late Lord according to his Earnest and Dying request and I do 
hereby in pursuance of the powers and authority to me given and reserved in 
and by two several indentures Tripartite the one bearing date on or about the 
Sixteenth day of July which was in the year of our Lord Christ One thousand 
Seven hundred and Eighteen and made or mentioned to be made betweeen 
Sir Theophilus Napier thgn of Suton Hoo in the County of Bedford Baronet my 
former Husband since deceased of the first part John Rotheram of the Parish 
of Saint Gyles in the Fields in the County of Middlesex Esqr and Sir Henry 
Penrite of Offley in the County ofHertford Knight of the Second part and me 
the said Elizabeth Lady Howard by the name of Dame Elizabeth Napier Wife 
of the said Sir Theophilus Napier of the third part  And the other bearing date 
the Sixth day of January which was was in the year of our Lord Jesus Christ 
One thousand Seven hundred and twenty one and made or mentioned to be 
made between me the said Elizabeth Lady Howard by the name of Elizabeth 
Lady Napier of London Widow of the first part the said Sir Henry Penrite by 
the name of Sir Henry Penrite of Doctors Commons London Bridge of the 
High Court of Admiralty Knight and the said John Rotheram by the Name of 
John Rotheram of Gray Inn in the said County of Middlesex Esqr of the 
second part and the Right Honable Thomas Lord Howard my late Deceased 
Husband of the third part And also in pursuance of of the Powers and 
Authoritys to me given or reserved in and by a Certain Deed Poll or Writing of 
Appointment Executed by me the said Elizabeth Lady Howard and the said 
Sir Cowpers Darcy previous to our Marriage and bearingn date the Eleventh 
day of September which was in the year of our Lord Christ One thousand 
Seven hundred and twenty Eight And of all and every other Power and 
Powers Authority and Authoritys whatsoever to me in that behalf given or 
reserved And of all and every right in any wise me thereunto Enabling give 
devise Limit direct and appoint all and every my Mannors Messuages Farms 
Lands Tenements Hereditaments reversions and Real Estate whatsoever and 
wheresoever with their Appurtenances unto my said Husband Sir Cowpers 
Darcy his Heirs and Assigns for Ever Subject nevertheless to and Charged 
and Chargeable with the Payment of the several Sums of money after the 
decease of the said Sir Cowpers Darcy upon the Contingencys hereinafter by 
me given and directed to be raised that is to say unto my Sister Frances Lady 
Somerville the sum of Five hundred pounds unto my Sister Mrs Mary 
Rotheram the sum of Five hundred pounds unto my Sister Mrs Anne Wyatt the 
sum of Five hundred pounds And unto my God Daughter Anne Yonge 
Daughter of Sir William Yonge Baronet the sum of Five hundred pounds And I 
do hereby Charge my Manners Lands Tenements and Hereditaments so 
given devised and appointed unto the said Sir Cowpers Darcy and his heirs 
with the raising and paying the said several Sums of money unto the said 
Frances Lady Somerville Mary Rotheram Anne Wyatt and Anne Yonge 
respectively immediately after the decease of the said Sir Cowpers Darcy in 
case theyshall be then Living and not otherwise And I do hereby declare and 
direct that in case any one or more of them shall happen to dye in the Life 
time of the said Sir Cowpers Darcy that the Sum of money so given and 
directed to be raised for her or them that shall so happen to dye shall not be 
raised but shall from the time of her or their Deaths sink and not become 
payable And I give to my Servant Sarah Sibley the Anynity or Clear yearly 
Sum of ten pounds for her Life Commencing from my decease And to be 
payd to her only in case she shall not so long continue in the Service of the 
said Sir Cowpers Darcy Also I give to the Right Honble the Earl of Effingham 
the whole Length Picture of his Father and also the half Length Picture of his 
Mother and the two whole Length Pictures of my late Lord and my self all 
which Pictures are at Estwinand I do direct that the said Earl of Effingham 
may have the use of the said Pictures during his life and at his death I give 
the same unto his Son the Right Honable the Lord Howard and I do hereby 
give all my Goods Chattels and Personal Estate whatsoever unto my said 
Husband Sir Cowpers Darcy To and for his own use and benefit And of this 
my last Will and Testament I make and appoint the said Sir Cowpers Darcy 
Sole Executor hereby revoking all former Wills by me at any time heretofore 
made In Witness whereof I the said Elizabeth Lady Howard have to this my 
last Will and Testament set my hand and Seale this tenth day of January in 
the Fourteenth year of the Reign of his Majesty King George the Second of 
Great Britain and so forth and in the year of our Lord Christ One thousand

This Will was proved at London before the Right Wppfull John Bettesworth 
Doctor of Laws master Keeper or Commissary of the Prerogative Court of 
Canterbury lawfully constituted the twenty Second day of January in the year 
of our Lord One thousand Seven hundred and Forty one By the oath of the 
Right Honble Sir Cowpers Darcy Knight of the Honble order of the Bath the 
Husband of the deceased and Sole Executorin the said Will named to whom 
Administration was granted of all andsingular the Goods Chattells and Credits 
of the said deceased being first sworn duly to administer.
