In the name of God Amen. I Francis Lord Howard of Effingham being in good health 
of body and mind thanks be to Almighty God doe make and ordaine this my last Will 
and Testament in manner following First I Surrender with all humility of Spirit my 
Soul unto Almighty God who gave it stedfastly beleiving thro' the merritts of my 
blessed Saviour Jesus Christ and the mercyes of my heavenly Father it will be happy 
in the heavenly Mansions to all eternity my body I committ to the Earth in full 
assurance of a blessed resurrection to be buryed with all decent privacy in my 
Chancell at Lyngfield in the place I have appointed as near my ever dearly beloved 
wife Philadelphia as possible  And what Inscription shall be thought requisite to be 
written over my grave be affixed in that vacant part of the Toomb I have placed over 
the Grave of my dear Wife in memory of us both And as to the worldly Estate 
wherewith God hath blessed me I doe dispose thereof in this manner  First I doe 
Ratifye and confirme the settlement by me made made heretofore on the marriage of 
the said Philadelphia my former wife And doe will and devise that all and every the 
Mannors lands and Hereditaments therein contained or mentioned shall be held and 
enjoyed according to the uses estates and trusts in the same Settlement mentoned 
limitted and declared for and concerning the same I doe give and devise all and 
singular other the Messuages Farmes land tenements and hereditamts in the County 
of Surry which since the makeing the said Settlement on my marriage with my said 
former wife I have purchased or had in exchange of or from any person or persons 
whatsoever And alsoe all such other messuages Farmes lands and Hereditaments 
as I have or shall hereafter purchase or have in exchange and every of them with 
their appurtenances unto my dear and eldest Sonn Thomas Howard and to the heirs 
males of his body begotten and for default of such issue unto my Sonn Francis 
Howard and to the heires males of his body begotten and for want of such Issue unto 
my owne right Heires males for ever Secondly I do give and devise unto my dear 
wife Susan Lady Howard of Effingham all rents and arreares of rents which shall be 
due and oweing to me at the time of my death from any the Lands or Estate which 
she holds in Joynture from Mr Harboard her former Husband or otherwise for life or 
hath any estate in whether for yeares or otherwise in her owne right or as Executrix 
of her said Husband And whereas my now said wife before our intermarriage did 
with my consent reserve unto her self all the personall estate whereof she was then 
possessed as money bonds mortgages plate jewells leases or otherwise whatsoever 
to be at her owne dispose notwithstanding her Coverture with me Now I doe by this 
my will ratifye and confirme arrangements by me made with my said wife before our 
intermarriage and all powers and authorityes to her given and granted thereby And 
whereas I am entitled to the yearly rent or Annuall Summe of eighty four pounds a 
yeare for and dureing the terme of the naturall life of my eldest Thomas Howard for 
the Sume of Six hundred pounds which I have paid unto their Maties Receipt of 
Exchequer upon an Act of Parliament lately passed in the Parliament holden at 
Westminster in the fourth Yeare of their now Maties Reigne entitled an Act for 
granting to their Maties certaine recompences and advantages in the said Act 
menconed to such persons as shall voluntarily advance the Sume of tenn hundred 
thousand pounds towards carrying on the Warr against France And whereas I am 
likewise entitled to the yearly rent or Annuall Summe of eighty four pounds a yeare 
for and dureing the terme of the naturall life of my Sonn Thomas Howard for the like 
Sume of Six hundred pounds which I have paid unto their Maties Receipt of 
Exchequer upon the said Act of Parliament before menconed Now I doe give and 
devise unto my dear wife Susan for and dureing the terme of her naturall life the 
yearly rent or Annuall Sume of Seventy pounds a yeare ____ being the Interest of 
five hundred pounds after the rate of fourteen pounds a yeare which I am intitled to 
as aforesaid for and dureing the term of the naturall life of my Son Thomas Howard 
to be paid unto her my dear wife by my Executors hereinafter named at the Feast of 
St John the Baptist St Michaell the Archangel The birth of our Lord Christ And the 
Annunciation of the blessed virgin Mary by even and equall porcons the first 
payment thereof to begin at the first of those Feasts next comeing after my death 
And if it should please God my Sonn Thomas dye before my said wife then I give 
and devise unto my said dear wife the like summe of Seventy pounds a yeare out of 
the yearly rent or Annuall Summe of eighty four pounds a yeare which I am entitled 
to by Act of Parliament as aforesaid for and dureing the terme of the naturall life of 
my said Sonn Francis to be paid to her my dear wife by my Executors hereinafter 
named at the Feasts aforesaid and in manner aforesaid And if it should please God 
both my sonns should dye before my said wife then I doe give and devise unto my 
said dear wife the life summe of Seventy  pounds a yeare for and dureing the terme 
of her naturall life to be paid unto her by my Executors as aforesaid out of the 
Interest of such moneys as I shall leave at my death to be paid unto my dear wife 
before any bequests I shall make of the said moneys next the Porcons of my two 
younger children Thirdly I doe give and devise unto my said dear wife a pair of my 
best coach-horses by best coach and all my household Linnen which shall be in my 
house at London at the time of my death And the Sume of one hundred pounds of 
good English money to buy her mourning desireing her to continue her love good 
instructions and advise to my deare Children soe long as they continue to pay her 
that duty love and respect which is due to her which I hereby charge them all 
solemnly to doe and that they remember it is my Will and command they be in noe 
sort wanting in it Fourthly I doe give and devise unto my dear daughter Elizabeth 
Howard the sume of three thousand pounds of good English money for her porcon to 
be paid unto her at the age of eighteen yeares  And I doe give unto her my said 
daughter for her maintenance untill her porcon shall grow due to be paid the yearely 
summe of fourscore pounds in good English money to be paid unto her by my 
Executors hereinafter named by quarterly payments at the four Feasts aforesaid the 
first quarterly payment thereof to be made on the first of the Feasts next coming or 
happening after my death  Fifthly I doe give and devise unto my dear sonne Francis 
Howard the sume of twelve hundred pounds of good English money for his Porcon to 
be paid unto him at the age of one and twenty yeares And I doe likewise give unto 
my Sonn Francis Howard the yearly rent or Annuall Sume of fourscore and four 
pounds a yeare whereunto I am entitled for and dureing the terme of his naturall life 
for the Summe of six hundred pounds which I have paid into their Maties Receipt of 
Exchequer upon the said act of Parliament hereinbefore menconed And the said 
Sume of fourscore and four pounds a yeare to be taken and received dureing all the 
continuance thereof by my said Sonn Francis for his owne use and benefitt for his 
support and maintenance unlesse it should please God my Sonn Thomas should 
dye before him and before my dear wife if soe then my will is that the seventy 
pounds a yeare hereinbefore given to my said wife shall be paid her as aforesaid out 
of the  yearly rent or Annuall Summe of fourscore and four pounds a yeare herein 
given to my said sonn Francis for and dureing the terme of her naturall life And my 
further Will and meaning is that if it shall happen that the said yearly rent or Annuall 
summe of fourscore and four pounds shall cease and not be paid And the said Act of 
Parliament whereby the same is secured shall be repealed or by other meanes 
become void and of none effect Then and in such case I doe give and devise unto 
my said Sonne Francis Howard the summe of six hundred pounds of good English 
money over and above the twelve hundred pounds hereinbefore given to him by me 
for the increase of his porcon And for his better support and maintenance to be paid 
to him at such time as the said Yearly rent or Annuall Sume of Fourscore and four 
pounds shall cease to be paid and the said Act of Parliament shall be repealed or by 
other meanes shall become void and of noe effect or force And my meaning and will 
is that my Executors hereafter named doe secure the said Sume of six hundred 
pounds on good security to be paid unto my sonn Francis at such time as aforesaid 
And that the Interest thereof untill the said yearly Rent or Annuall Summe of foure 
Score and four pounds shall cease and not be paid and the said Act of Parliament be 
repealed or by any other meanes become of noe effect be paid unto my eldest sonn 
Thomas his Executors and Administrators And my further Will and meaning is that if 
my daughter Elizabeth dye after the age of eighteen yeares unmarried That she shall 
and may dispose of the Sume of one thousand pounds in good English money of her 
porcon but noee more the residue and remainder of her porcon being two thousand 
pounds  I will devise and appoint to be paid unto my sonne Thomas Howard his 
Executors and Administrators And my further Will and meaning is that if either of my 
sonns shall dye under the age of one and twenty yeares unmarried that then my said 
daughter Elizabeth shall have the sume of five hundred pounds of good English 
money added to her porcon to be paid at such times and in such manner as her 
porcon is herein appointed to be paid but if it should please God both my sonns 
should dye under the age of one and twenty years unmarried Then I give and devise 
all my personall estate unto my said daughter Elizabeth her Executors and 
Administrators at her owne dispose And whereas I am entitled to the Yearely rent or 
Annuall Sume of forty eight pounds a yeare for and during the term of sixteen yeares 
for the Sume of five hundred pounds which I have paid into their Majies Receipt of 
Exchequer upon an act of Parliament lately passed in the Parliament holden at 
Westminster in the fifth and sixth yeare of their now Majies Raigne entitled an act for 
granting to their Majies certaine Rates and duties upon bear Ale and other liquors for 
securing certain recompences and advantages to such persons as shall voluntarily 
advance the Summe of tenn hundred thousand pounds towards carrying on a Warr 
against France  And whereas I am likewise entitled by the said act of Parliamt to the 
yearly rent or Annuall Summe of eighteen pounds a yeare for the like term of sixteen 
yeares by the advantage of two benefitted Ticketts each of tenn pounds a yeare and 
the eighteen pounds a yeare aforesaid and any other Sume or sumes which I shall 
or may buy of any person or persons whatsoever and be thereby entitled to receive 
the said Sume or Sumes by virtue of the said Act of Parliament dureing the said 
terme of sixteen yeares shall be Annually received by my Executors hereafter named 
from the time of my death for and dureing the remaining terme of the sixteen Yeares 
And soe received shall be by them Annually placed out at Interest on good security 
for the benefitt of my eldest Sonn Thomas his heires and Executors And my will and 
meaning is that my Executors doe pay at the end and expiration of the terme of the 
said sixteen yeares the full Sumes soe annually received by them with the annuall 
Increase of the Interest of the said Sumes unto my said sonn Thomas he Heires and 
Executors for my Will and meaning is that till the said sixteen yeares shall be fully 
compleated and ended my siad Sonn nor his Heires nor Executors shall have any 
benefitt from or receive any of the said yearly Rents or Annuall Summes but that 
they be disposed of as afore is by me directed by my Executors for the benefitt of my 
said sonn Thomas his heires and Executors And further my Will and meaning is that 
the severall procons hereinbefore devised to my daughter and younger sonn shall be 
raised and paid by and out of the two thousand pounds for which Sr John Pelham 
and Sr Nicholas Pelham were Trustees for the benefitt of my younger children in the 
Settlement made upon my marriage with the said Philadelphia my former dear wife 
And out of the further Sume of two thousand pounds charged on my Estate before 
my said former marriage towards a Provision for younger children And from moneys 
which I shall have by me or out upon Securityes or other my personall estate 
whereof I shall be possessed of at my death I doe give and devise unto my dearest 
sister Mrs Methwold twenty pounds in good Enlish money to buy her mourning And 
to my sister Howard tenne pounds in like money for mourning and to my servant 
Thomas Bowyer fifty pounds in like money if he shall be with me when I dye  And I 
will and appoint the summe of twenty pounds in like money to be disposed of by my 
Executors to such persons as they shall judge indigent and objects of Charity And I 
doe give five pounds of like money to the poor of the Parish of great Bookham in the 
County of Surrey to be disposed of by the Minister of the said Parish And I doe give 
five pounds to the poor of the Parish of Lyngfeild in the said County to be disposed 
of by the Minister of the said parish  I doe give and devise unto my sister Howard 
dureing her widdowhood the yearely Sume of forty pounds of good English money to 
be quarterly paid her at the feasts aforesaid by equall procons free from all Taxes 
the first payment thereof to begin and be made at the first of those Feasts next 
coming after my death  And the said yearly Sume of forty pounds to be paid unto my 
said sister out of such use money as I shall leave unto my eldest Sonn All the rest 
and residue of my personall Estate after my debts legacyes and funeralls shall be 
fullysatisfyed And this my Will performed I doe give and devise unto my said eldest 
Sonn Thomas Howard And if he shall dye under the age of twenty and one yeares 
unmarryed unto my now younger sonn Francis Howard and if he dye under the age 
of twenty and one yeares unmarryed unto my said daughter Elizabeth her heires and 
Executors  And I doe nominate and appoint my very loveing brother Sr Nicholas 
Pelham of Catsfeild in the County of Sussex Knight my loveing Nephew George 
Monson of Grays Inn Esquire and my loveing brother Thomas Methwold of 
Halehouse in Kensington in the County of Middx Esqr Guardians of my dear sonn 
Thomas and of my other younger children respectively and of their respective ages 
untill they shall attaine the age of twenty and one yeares or be marryed And I doe 
likewise nominate and appoint my said brothers Sr Nicholas Pelham and Thomas 
Methwold and my said Nephew George Monson Executors of this my last Will and 
Testament and I doe intreate them to take upon them the trust thereof and to see the 
same performed And I doe give and devise unto them my said Executors the sume 
of twenty pounds apeice of good English money for mourning I doe revoake all other 
Wills by me at any time heretofore made And doe declare this to be my last Will and 
Testament In witnesse that this is my last Will and Testament containeing seven 
shheets of paper signed by me Effingham at the bottome of every sheete And fixed 
together on the Topp with a black Ribband and to the topp of the first and the 
bottome of the last I have sett my Seale the twentyeth day of December in the yeare 
of our Lord God one thousand six hundred ninety and four And in the sixth yeare of 
the Reigne of King William and Queen Mary Effingham signed sealed and published 
by the said Francis Lord Howard of Effingham for his last Will and Testament in the 
presence of us who have hereunto subscribed our names as Witnesses thereto in
