Will of Francis Searle of Guildford In the Name of God, Amen. I Francis Searle of the Parish of St Nicholas in Guildford in the County of Surrey, Yeoman, being in good state of health and of sound and disposing mind, memory and understanding, thanks be to God for the same, do make my last Will and Testament in manner and form following. That is to say in the first place, I commend my soul to God, my body I commit to the Earth to be decently interred at the discretion of my Executors hereinafter named and as for my Wordly Estate, I dispose thereof as followeth. Whereas I am Mortgagee in possession of all that Messuage or Tenement and Malthouse with the apputenances thereunto belonging, situate, lying and being in a place called Swan Gate in the Parish of St Mary in Guildford aforesaid now in the occupation of Henry Potter. Now I do hereby give and bequeath all my Estate and Interest of and in the said premises and all Moneys due to me thereon unto my som William Searle, his Executors and Administrators subject nevertheless and I do hereby charge and subject the same with the payment of and do direct my said son William to pay the rent the sum of fifty pounds of lawful money of Great Britain to my loving wife Mary Searle within six calendar months after my decease provided nevertheless that if my said son William Searle who is now in parts beyond the seas shall happen to die abroad without issue of his body lawfully begotten then I give and bequeath what I have above given and bequeathed unto him unto my other children Francis Searle, Mary Harrison and Sarah Black not jointly but share and share alike as Tenants in common and to their severl and respective Executors and Administrators. Also I give and devise unto my said wife Mary Searle and her assigns for and during the term of her natural life all those my several Messuages, Tenements and Heriditaments with the appurtenances thereunto respectively belonging, situate, lying and being in Park Lane in the Parsih of St Nicholas in Guildford aforesaid now in the respective occupations of me the said Francis Searle, the Widow Smith, George Nettleford, ______ Eames and James Harrison and from and after the decease of my said wife, I give and devise the said Messuage in the occupation of the said James Harrison unto my daughter Mary the wife of the said James Harrison and her heirs and as for and concerning the other respective appurtenances in Park Lane aforesaid in the occupations of me the said Francis Searle, the Widow Smith, George Nettleford and _____ Eames, I give and devise the same unto my sons Francis and William and my daughter Sarah the wife of Henry Black as Tenants in common and not as joint Tenants and to their several and respective heirs and assigns for ever and subject to the payment of all my just debts, funeral expenses. And of the further sum of one hundred pounds of lawful money of Greta Britain to my said wife at the end of twelve calendar months next after my decease. I give and bequeath unto my son Francis Searle all and singular my household goods and furniture and all my stock of corn and grain of all kinds, hay straw, horses, oxen, cows, ploughs, harrows and other stock and implements of farming and husbandry of what nature or kind soever being within, without or about my dwelling house, barns, farm and lands or elsewhere belonging tome and also all my ready monies, monies on security, debts, dues, demands and all and singular the rest and residue of my personal Estate to and for his absolute use and benefit. And I do hereby nominate, constitute and appoint him my said son Francis, my said wife Mary and my friend Thomas Birknoll (Birknell?) of the said Parish of St Nicholas, Yeoman, Executors of this my last Will and Testament and I desire that my said wife and son Francis will submit themselves to the guidance and advice of the said Thomas Birknell and I do direct that he shall settle any and all disputes between them in relation to and concerning this my Will and the Devises and bequests herein contained. In witness whereof I have hereunto set my hand and seal this fourteenth day of March in the year of Our Lord one thousand seven hundred and sixty three. John Chandler, Thomas Herbert, Joseph Pickstone This Will was proved at London on the thirteenth day of September in the year of Our Lord one thousand seven hundred and sixty five before the Worshipful Francis Simpson, Doctor of Laws Surrogate of the Right Worshipful george Bay, Doctor of Laws, Master Keeper or Commissary of the Prerogative Court of Canterbury lawfull constituted by the oath of Francis Searle the son of the said deceased and one of the Executors named in the said Will to whom administration was granted of all and singular the Goods, Chattels and Credits of the said deceased having been first sworn duly to administer power reserved of making the like grant to Mary Searle, Widow, the Relict and Thomas Birknell the other Executors named in the said Will when they or either of them shall apply for the same.
