DEATH ON OR AFTER 1st JANUARY, 1898 Will BE IT KNOWN that James Smith of Bosworth King’s Road Walton on thames in the County of Surrey formerly of Mayville Kings Road aforesaid – died – on the 31st day of October 1925 at Bosworth aforesaid AND BE IT FURTHER KNOWN that at the date hereunder written the last Will and Testament of the said deceased was proved and registered in the Principal Probate Registry of His Majesty’s High Court of Justice, and that administration of all the estate which by law devolves to and vests in the personal representative of the said deceased was granted by the aforesaid court to Thomas James Smith of (Ivor?) Bowes Road Builder – Ernest William Smith of Alrewas Station Avenue- Builder – and Robert Henry Smith of Southholme Kings Road – Plumber all of Walton on Thames aforesaid – Sons of deceased – and Alfred Victor West of Bosworth aforesaid – Civil Servant – four of the Executors – named in the said Will – Power reserved to the other executor on a vacancy occurring – Dated the 6th day of February 1926 Gross value of Estate £7213-19-0 Net value of Personal Estate £5594-12-6 THIS IS THE LAST WILL AND TESTAMENT of me JAMES SMITH of “Bosworth” Kings Road Walton on Thames in the County of Surrey Retired Builder I appoint my sons Thomas James Smith Ernest William Smith and Robert Henry Smith my daughter Lucy Mabel West and my son in law Alfred Victor West (hereinafter called my trustees) to be the EXECUTORS AND TRUSTEES of this my will I direct that all my just debts and funeral and testamentary expenses be paid and satisfied as soon as conveniently may be after my decease I give and bequeath all my household furniture and personal effects to my dear wife Elizabeth Sarah for her own use and benefit absolutely I give devise and bequeath my freehold house situate and known as “Chevening” Hersham Road Walton on Thames unto my trustees Upon trust to pay the rent profits and income thereof to my wife during her life and from and after her death in trust for my said daughter Lucy Mabel West for her own use and benefit absolutely And I declare that my trustees may during the life of my wife at their sole discretion sell and dispose of the said freehold house and invest the money arising thereby (with power from time to time to vary the investments) in any stocks funds or securities for the time being authorised by law for trust money such invenstment or investments to be held by them upon the like trusts as is hereinbefore declared and contained of any concerning my said freehold house situate and known as “Chevening” aforesaid And as to all the rest residue and remainder of my estage and effects both real and personal and whatsoever and wheresoever I give devise and bequeath the same Unto my trustees upon trust that my trustees shall thereout pay my funeral and testamentary expenses and debts and shall stand possessed of the residue upon trust to pay the income thereof to my wife during her life and from and after her death In trust to divide the same equally between my said four children Thomas James Smith Ernest William Smith Robert Henry Smith and Lucy Mabel West their respective heirs executors administrators and assigns I declare that as regards any real property remaining unsold my trustees may let or demise the same either from year to year or for any term of years at such rent and subject to such covenants and conditions as they shall think fit and may accept surrenders of leases and tenancies expend money in repairs and improvements and generally manage the property according to their absolute discretion And hereby revoking all former wills and testamentary dispositions at any time heretofore made by me I do declare this only to be my last will and testament IN WITNESS WHEREOF I have hereunto set my hand this twenty eighth day of October one thousand nine hundred and twenty five – JAMES SMITH – SIGNED by the above named James Smith in our presence and by us in his presence – ARTHUR W LOWE 7 Bridge Street Walton on Thames accountant – ALFRED R CARTER Clerk to C Haddon Gray Solicitor Bridge Street Walton on Thames- On the 6th day of FEBRUARY 1926 Probate of this will was granted to Thomas James Smith and Ernest William Smith and Robert Henry Smith and Alfred Victor West four of the Executors.
