This is the Last Will and Testament of me William Shrubsole of Kingston upon Thames in the County of Surrey Banker and Draper I direct my mortal remains to be deposited in the vault in the Church Yard at Rottingdean near Brighton in which rest the remains of the late Mr Knight and his first wife and also those of two of my dear children and it is my desire that my funeral may be plain and free from lavish expence I direct that all my just debts funeral and testamentary expenses be fully paid and satisfied as soon as convenient after my decease I direct that all my capital in the trade now carried on by me my son William and Mr. William Row under the firm of “Shrubsole Row and Shrubsole” shall remain in the said trade at interest after the rate of five pounds per centum per annum they my said partners the said William Shrubsole the younger and Mr. William Row giving security to the satisfaction of my Executors for the amount of my said capital I direct that my said son William and the said William Row or the partners in my said business for the time being shall be charged with the then annual rent of Two hundred pounds in respect of my shop for shop fixtures and premises in which my said business is now carried on I do hereby express my sincere wish that my business as Draper Mercer and Undertaker should be continued by my said son William and Mr. William Row in equal shares and for their mutual benefit and advantage and concerning my dear son John now assisting us in the said business my hope and constant desire is that my said partners do continue him as one of the Assistants in the said business and with the most perfect unlimited confidence I have of their kind feeling towards him to give him such an annual remuneration As they may be mutually disposed to grant him and when they should think proper to admit him to a share in the partnership and it is my wish and desire that the Banking business shall be carried on by my son William and my friend and partner Robert Francis Lambert for their mutual benefit and advantage under the firm of “Shrubsole and Lambert” they paying to my dear wife the then yearly rent of Thirty five pounds for the Banking Office safe and fixtures to be applied to the purposes of this my will after mentioned And I do desire that the capital in the Bank shall be allowed to remain with my said partners therein on security to be approved by my Executors so long as the said Banking business shall be carried on at interest after the rate of five pounds per centum per annum and subject to such arrangements I do hereby give devise and bequeath All my real and personal estate whatsoever and wheresoever the same may be situate unto my dear wife Elizabeth her heirs executors administrators and assigns for ever in the full confidence that she will provide for her own dear children in the best manner she can and that she will in the disposition of her property bear in mind the advances I have already made to some of them I appoint my sons William Shrubsole and Henry Shrubsole my friend William Row and my brother in law Ebenzer King Executors of this my will and I bequeath to them the sum of Fifty pounds a piece for their trouble in the management thereof I give and devise to my said son William Shrubsole all estates and properties whatsoever held by me as a trustee for any person or persons whomsoever I do direct that my said Executors shall be at liberty to reimburse themselves and to allow to their cotrustees and Coexecutors all costs charges damages and expenses which they shall respectively necessarily incur in the execution of the trusts of this my Will or in relation thereto and that they shall not be answerable the one for the other of them nor for any loss which may happen to my estate unless the same shall arise through their own wilful neglect or default respectively and hereby revoking all former wills I do declare this alone to be my last Will and Testament In witness whereof I have hereunto set my hand this thirty first day of August in the year of our Lord one thousand eight hundred and forty four _ Wm Shrubsole _ Signed and declared by the testator William Shrubsole as and for his last Will and Testament in the presence of us present at the same time who in his presence and in the presence of each other have subscribed our names as Witnesses _ Chas.
