This is the last Will and Testament of me William Smither in the Parish of Woking in the County of Surrey farmer I will and direct that all my just debts funeral and Testa- mentary charges and expenses be in the first place fully paid and satisfied by my Executors hereinafter named and appointed I wish and desire that my body shall be decently interred in Woking Church Yard after the same manner as my brother Henry Smither that is to say for my four nephews to carry me to the Grave Isaac and Arthur Smither the sons of my brother Isaac Smither and Stephen the son of my brother Stephen Smither and James the son of my brother Edward Smither in the first place I give and devise unto my brother Edward Smither all that my Copyhold field called Chalkey Field and now in my own occupation to hold the same unto and to the only use and behoof of my said brother Edward Smither his heirs and assigns for ever Also I give and bequeath unto my nephew William Smither all that my freehold plott or field lying and being near my aforesaid copyhold estate for his sole and whole use whatsoever also I give and bequeath unto my nephew Stephen Smither all that my copyhold Estate where I now live consisting of the house yard barn garden and land thereunto belonging situate on Whitstreet Hill in the Parish of Woking to hold the same unto and to the only use of my said nephew Stephen Smither Son of my brother Edward Smither his heirs or assigns for ever and to and for other use intent or purpose whatsoever also I give unto my brother Edward Smither all and every my other freehold or copyhold land or estate what-soever whereof I am seized or possessed or wherein I am any way interested or entitled either in possession reversion expectancy or otherwise whatsoever To hold the same unto and to the only use and behoof of my said brother Edward Smither his heirs and assigns for ever and I do hereby make ordain constitute and appoint my brother Edward Smither and my nephew Stephen Smither son of Edward Smither Executors of this my last Will and Testament and do hereby revoke and make void all and every other Will or Wills by me at any time heretofore made and do declare this only to be my last Will and Testament In witness whereof I have hereunto set my hand and seal this Seventeenth day of May in the year of our Lord one thousand eight hundred and forty three The X mark William Smither ~Signed sealed published and declared by the said testator as and for his last Will and Testament in the presence of us who in his presence on his request and in the presence of each other have subscribed our names as witnesses to the execution hereof. ~ John Hooper Woking Inn Keeper ~ William Hooper Woking.
