This is the last Will and Testament of me Richard Butler of Adderbury East in the 
County of Oxford Gardener First I give all my Stock of Fuel which I shall be 
possessed of at the Time of my Decease to be equally divided between my Son 
Thomas and Jane the Wife of my Son William Share and Share alike And Whereas I 
have some time since surrendered into the Hands of the Lord of the Manor of 
Adderbury in the said County of Oxford according to the Custom thereof All and 
singular my Messuages Cottages Closes Lands  Tenements and Hereditaments 
whatsoever situate lying and being in Adderbury aforesaid or elsewhere within the 
said Manor To the use and Behoof of such Person and for such Estate and Estates 
and subject to such Charges and Conditions as I should by my last Will and 
Testament give devise direct limit or appoint the same, now I do give and devise unto 
my trusty Friends Richard Spencer, Farmer and James Flint, Baker both of 
Adderbury East aforesaid their Heirs and Assigns all and singular my Messuages 
Cottages Closes Lands  Tenements and Hereditaments whatsoever situate lying and 
being in Adderbury aforesaid or elsewhere whether Freehold or Copyhold I also give 
and bequeath unto the said Richard Spencer and James Flint all my Goods Chattells 
and Personal Estate whatsoever and wheresoever And I do declare that the said real 
and personal estate so given Upon Trust that they the said Richard Spencer and 
James Flint or the Survivor of them their Heirs Executors Administrators and Assigns 
of such Survivor shall and do as soon as conveniently may be after my Decease 
absolutely sell and dispose of the same real and personal Estates  and every part 
thereof for the best price or prices that can or may reasonably be had and obtained 
for the same And my will is that the Receipt and Receipts of my said Trustees or 
either of them shall to the purchaser or purchasers of my said real and personal 
Estate or any part thereof be good and sufficient Discharge and Discharges for the 
purchase or Consideration Money and that the purchaser or purchasers shall not be 
answerable for the Misapplication or Nonapplication thereof and the Money arising 
from the said Sale of my said real and personal Estates Upon Trust that they my said 
Trustees or the Survivor of them his Heirs Executors and  Administrators shall and do 
in the first place pay and discharge all my just Debts and funeral Expences and after 
payment thereof and all Costs and Charges attending such Sale or Sales shall and 
do pay and distribute the same unto and amongst my Children and Grandchildren 
hereinafter named and in Manner hereinafter mentioned (that is to say) To my son 
Thomas one equal fifth part To my son Richard one other fifth part thereof  To my 
son James one other fifth part thereof To my son John one other fifth part thereof and 
to the five children of my late Daughter Mary the remaining fifth part thereof to be 
equally divided And I hereby nominate constitute and appoint my said Trustees the 
said Richard Spencer and James Flint joint Executors of this my Will hereby revoking 
all former Wills by me at any time heretofore made provided and my Will is and I do 
hereby specifically declare that my said Trustees or either of them shall not be 
accountable for more of the Trust Money than they shall respectively actually receive 
or shall come to that their respective Hands by Virtue of this my Will nor with or for 
the Loss of the same or any part thereof so as the same shall happen without their 
wilful Default nor the one of them for the other of them, but each of them for his own 
Acts and Deeds only and that it shall and may be lawful to and for my said Trustees 
and each of them by and out of the said Trust Money to deduct and reimburse him 
and themselves all such Loss Costs Charges Damages and Expences which they or 
either of them shall or may sustain expend or be put unto for or by reason of this my 
Will or the Management or Execution thereof or the Trusts in them reposed or any 
things or anywise relating thereunto In Witness whereof I have to this my Will 
contained in two Sheets of Paper to each Sheet thereof set my Hand and seal this 
ninth Day of April in the Year of our Lord one thousand eight hundred and Nine
