This is the last Will and Testament of me Samuel Smith of Neithrop in the parish of 
Banbury in the County of Oxford Victualler First I direct that all my just Debts Funeral 
Expences and the Charges of Proving this my will are paid and satisfied And subject 
thereto I Give and Devise all those my seven Freehold Messuages Cottages or 
Tenements with the Appurtenances hereunto belonging situate lying and being in the 
parish of Banbury aforesaid unto John Keely of Neithrop aforesaid Victualler his 
Heirs and Assigns Upon Trust to permit and suffer my Wife Elizabeth to receive the 
Rents Issues and Profits thereof until my Daughter Elizabeth shall attain the age of 
twenty one yeares for the support and maintenance of herself and all my Children 
and after my said daughter Elizabeth shall attain the age of twenty one yeares Then I 
do Give and Devise my said Freehold Messuages Cottages or Tenements with the 
Appurtenances unto my three Children Ann William and Elizabeth their Heirs and 
Assigns for ever as Tenants in Common and not as joint Tenants I Give and 
bequeath all that my Leasehold Messuages with the Stable and the Appurtenances 
thereunto belonging situate lying and being in Neithrop aforesaid for and during all 
my Estate Term and Interest therein and also all my Household Goods and Furniture 
Plate Linen China and all and singular my personal Estate and Effects of what nature 
and kind soever unto my said Wife Elizabeth for and during the term of her natural 
life and after her decease Then I Give and bequeath the same and every part and 
parcel thereof equally to be divided amongst my said three Children share and share 
alike when and as they shall severally attain the age of twenty one years But in Case 
any or either of my said Children shall happen to depart this life before he she or they 
shall attain that age then I do hereby direct that the share of him or her or them so 
dying shall go and be paid to the Survivors or Survivor of them equally share and 
share alike And Lastly I do hereby nominate constitute and appoint my said Wife and 
the said John Keely Executrix and Executor of this my last Will and Testament 
hereby revoking and making void all former Will or Wills by me made In Witness 
whereof I have hereunto set my hand and seal the Second day of December One 
thousand eight hundred and five
