TRANSCRIPTION OF THE WILL OF HENRY WARD [124]

This is the last Will and Testament of me Henry Ward of Chadlington in the County 
of Oxford Yeoman First I desire all my just debts funeral expences and the expences 
proving this my Will to be fully paid and satisfied then I give and devise all that my 
messuage or tenement orchard yard garden and premises situate and being in the 
Parish of Chadlington aforesaid and now in my own occupation unto my son Charles 
Ward and his assigns for and during the term of his natural life and from and after the 
determination of that estate by forfeiture or otherwise in the lifetime of the said 
Charles Ward then I give and devise the same premises unto Richard Pratt and Robert 
Woollams of Chadlington in the County of Oxford Farmers and to their heirs in trust 
only to preserve and support contingent remainders and uses hereinafter limitted from 
being defeated barred or destroyed and for that purpose to make entries and bring 
actions as occasion may be or require Nevertheless to permit and suffer the said 
Charles Ward to receive and take the rents issues and profits thereof for and during 
the term of his natural life and from and immediately after the decease of my said son 
Charles I give and devise the same premises unto and to the use of my son James 
Ward during the term of his natural life and from and immediately after the 
determination of that estate by forfeiture or otherwise then I give and devise the same 
unto the said Richard Pratt and Robert Woollams and their heirs in trust as aforesaid 
to preserve and support the contingent remainders and hereinafter limitted from being 
defeated barred and destroyed and for that purpose from time to time and at all times 
to make entries and bring actions as occasions may require Nevertheless to permit and 
suffer the said James Ward to receive and take the rents issues and profits thereof for 
and during the term of his natural life and from and immediately after the decease of 
the said James Ward I give and devise the same premises unto and to the use of my 
grandson Henry Ward during the term of his natural life and from and immediately 
after the determination of that estate by forfeiture or otherwise then I give the same 
unto the said Richard Pratt and Robert Woollams and their heirs in trust as aforesaid 
to preserve and support the contingent remainder and uses hereinafter limitted from 
being defeated barred and destroyed and for that purpose from time to time and at all 
times to make entries and bring actions as occasions may require Nevertheless to 
permit and suffer the said Henry Ward to receive and take the rents issues and profits 
thereof for and during the term of his natural life and from and immediately after the 
decease of the said Henry Ward I give and devise the same premises unto and to the 
use and behoof of the first son lawfully begotten or to be begotten of the said Henry 
Ward and the heirs male of the body of such first son lawfully issuing and for default 
of such issue to the use and behoof of the second third and all and every other son and 
sons of the said Henry Ward and the heirs male of the body and bodies of such second 
third and other son and sons lawfully begotten or to be begotten severally and 
successively as they shall be in seniority of age and priority of birth and for default of 
such Issue then to the use of my own right heirs male for ever and it is my will and 
desire that the orchard belonging to the above described premises be continued 
pasture land in the same condition it now is and not at any time hereafter to be 
ploughed or converted into arable land by any person or persons hereafter instilled to 
the same by virtue of this my will and I do hereby make this condition upon which the 
persons for the time being shall be entitled to hold and enjoy the same Also I give and 
devise all that my messuage or tenement garden and premises thereto belonging 
situate and being in the Parish of Crawley in the County of Oxford and now in the 
occupation of Daniel Ward unto my son Daniel Ward for and during the term of his 
natural life and from and immediately after the determination of that estate by 
forfeiture or otherwise I give and devise the same premises unto the said Richard Pratt 
and Robert Woollams and their heirs in trust only to preserve and support the 
contingent remainders and uses hereinafter limitted from being defeated barred or 
destroyed and for that purpose from time to time and at all times to make entries and 
bring actions as occasions may be or require Nevertheless to permit and suffer the 
said Daniel Ward to receive and take the rents issues and profits thereof for and 
during the term of his natural life and from and immediately after the decease of the 
said Daniel Ward I give and devise the same premises unto and to the use and behoof 
of the first son lawfully begotten or to be begotten of the said Daniel Ward and the 
heirs male of the body of such first son lawfully issuing and in default of such issue to 
the use and behoof of the second third and all and every other son and sons of the said 
Daniel Ward and the heirs male of the body and bodies of such second third and other 
son and sons lawfully begotten or to be begotten severally and successively as they 
shall be in seniority of age and priority of birth and for default of such issue to the use 
of my own right heirs male for ever Also I give and devise all that my thatched 
messuage or tenement garden and premises thereto belonging situate and being in the 
Parish of Ducklington in the County of Oxford now in the occupation of     Boon unto 
my son James Ward and his assigns for and during the term of his natural life and 
from and immediately after the determination of that estate by forfeiture or otherwise 
I give and devise the same premises unto the said Richard Pratt and Robert Woollams 
and to their heirs in trust only to preserve and support the contingent remainders and 
uses hereinafter limitted from being defeated barred or destroyed and for that purpose 
from time to time and at all times to make entries and bring actions as occasions may 
be or require Nevertheless to permit and suffer the said James Ward to receive and 
take the rents issues and profits thereof for and during the term of his natural life and 
from and immediately after the decease of the said James Ward I give and devise the 
same premises unto and to the use of my grandson Charles Ward son of the said 
James Ward during the term of his natural life and from and immediately after the 
determination of that estate by forfeiture or otherwise I give and devise the same 
premises unto the said Richard Pratt and Robert Woollams and their heirs in trust as 
aforesaid to preserve and support the contingent remainders and uses hereinafter 
limitted from being defeated barred or destroyed and for that purpose from time to 
time and at all times to make entries and bring actions as occasions may be or require 
Nevertheless to permit and suffer the said Charles Ward to receive and take the rents 
issues and profits thereof for and during the term of his natural life and from and 
immediately after the decease of the said Charles Ward I give and devise the same 
premises unto and to the use and behoof of the first son lawfully begotten or to be 
begotten of the said Charles Ward and the heirs male of the body of such first son 
lawfully issuing and for default of such issue to the use and behoof of the second third 
and all and every other son and sons of the said Charles Ward and the heirs male of 
the body and bodies of such second third and other son and sons lawfully begotten or 
to be begotten severally and respectively as they shall be seniority of age and priority 
of birth and for default of such issue to the use of my own right heirs male for ever 
Also give and devise all that my stated messuage or tenement and premises thereto 
belonging situate and being in the Parish of Ducklington in the County of Oxford and 
now in the occupation of     Clarke unto my daughter Rhoda the wife of Datus Collis 
and her assigns for and during the term of her natural life and from and immediately 
after the determination of that estate by forfeiture or otherwise I give and devise the 
same premises unto the said Richard Pratt and Robert Woollams and to their heirs in 
trust only to preserve and support the contingent remainders and uses hereinafter 
limitted from being defeated barred or destroyed and for that purpose from time to 
time and at all times to make entries and bring actions as occasions may be or require 
Nevertheless to permit and suffer the said Rhoda Collis to receive and take the rents 
issues and profits thereof for and during the term of her natural life and from and 
immediately after the decease of the said Rhoda Collis I give and devise the same 
premises unto and to the use of my grandson Datus Collis son of the said Rhoda 
Collis during the term of his natural life and from and immediately after the 
determination of that estate by forfeiture or otherwise I give and devise the same 
premises unto the said Richard Pratt and Robert Woollams and to their heirs in trust 
as aforesaid to preserve and support the contingent remainders and uses hereinafter 
limited from being defeated barred or destroyed and for that purpose from time to 
time and at all times to make entries and bring actions as occasions may be or require 
Nevertheless to permit or suffer the said Datus Collis to receive and take the rents 
issues and profits thereof for and during the term of his natural life and from and 
immediately after the decease of the said Datus Collis I give and devise the same 
premises unto and to the use and behoof of the first son lawfully begotten or to be 
begotten of the said Datus Collis and the heirs male of the body of such first son 
lawfully issuing and for default of such issue to the use and behoof of the second third 
and all and every other son and sons of the said Datus Collis and the heirs male of the 
body and bodies of such second third and other son and sons lawfully begotten or to 
be begotten severally and respectively as they shall be in seniority of age and priority 
of birth and for default of such issue to the use of my own right heirs male for ever 
Also I give and devise all that my messuage or tenement garden and premises thereto 
belonging situate and being in the Parish of Ramsden in the County of Oxford and 
now in the occupation of Thomas Hancock unto my daughter Catherine Jeffery and 
her assigns for and during the term of her natural life and from and immediately after 
the determination of that estate by forfeiture or otherwise I give and devise the same 
premises unto the said Richard Pratt and Robert Woollams and their heirs in trust only 
to preserve and support the contingent remainders and uses hereinafter limitted from 
being defeated barred or destroyed and for that purpose from time to time and at all 
times to make entries and bring actions as occasions may be or require Nevertheless 
to permit and suffer the said Catherine Jeffery to receive and take the rents issues and 
profits thereof for and during the term of her natural life and from and immediately 
after the decease of the said Catherine Jeffrey I give and devise the same premises 
unto and to the use of my son James Ward during the term of his natural life and from 
and immediately after the determination of that estate by forfeiture or otherwise I give 
and devise the same premises unto the said Richard Pratt and Robert Woollams and to 
their heirs in trust only to preserve and support the contingent remainders and uses 
hereinafter limitted from being defeated barred or destroyed and for that purpose from 
time to time to make entries and bring actions as occasions may be or require 
Nevertheless to permit and suffer the said James Ward to receive and take the rents 
issues and profits thereof for and during the term of his natural life and from and 
immediately after the decease of the said James Ward I give and devise the same 
premises unto and the use of my grandson James Ward son of the above named James 
Ward during the term of his natural life and from and immediately after the 
determination of that estate by forfeiture or otherwise I give and devise the same 
premises unto the said Richard Pratt and Robert Woollams and to their heirs in trust 
only to preserve and support the contingent remainders and uses hereinafter limitted 
from being defeated barred or destroyed and for that purpose from time to time and at 
all times to make entries and bring actions as occasions may be or require 
Nevertheless to permit and suffer my grandson James Ward the younger to receive 
and take the rents issues and profits thereof for and during the term of his natural life 
and from and immediately after the decease of my grandson the said James Ward I 
give and devise the same premises unto and to the use and behoof of the first son 
lawfully begotten or to be begotten of my grandson the said James Ward and the heirs 
male of the body of such first son lawfully issuing and for default of such issue to the 
use and behoof of the second third and all and every other son and sons of my 
grandson the said James Ward and the heirs male of the body and bodies of such 
second third and other son and sons lawfully begotten or to be begotten severally and 
successively as they shall be in seniority of age and priority of birth and for default of 
such issue to the use of my own right heirs male for ever Also I give and devise all 
that my newly erected messuage or tenement and premises thereto belonging situate 
and being at Finstock Heath in the County of Oxford and now in the occupation of 
Jonathan Bowerman unto my daughter Dorcas the wife of Samuel Hope for and 
during the term of her natural life and from and immediately after the determination 
of that estate by forfeiture or otherwise I give and devise the same premises unto the 
said Richard Pratt and Robert Woollams and to their heirs in trust only to preserve 
and support the contingent remainders and uses hereinafter limitted from being 
defeated barred or destroyed and for that purpose from time to time and at all times to 
make entries and bring actions as occasions may be or require Nevertheless to permit 
and suffer the said Dorcas Hope to receive and take the rents issues and profits thereof 
for and during the term of his natural life and from and immediately after the decease 
of the said Dorcas Hope I give and devise the same premises unto and to the use of 
my son James Ward during the term of his natural life and from and immediately after 
the determination of that estate by forfeiture or otherwise I give and devise the same 
premises unto the said Richard Pratt and Robert Woollams and to their heirs in trust 
as aforesaid to preserve and support contingent remainders and uses hereinafter 
limitted from being defeated barred or destroyed and for that purpose from time to 
time and at all times to make entries and bring actions as occasions may be or require 
Nevertheless to permit and suffer the said James Ward to receive and take the rents 
issues and profits thereof for and during the term of his natural life and from and 
immediately after the decease of the said James Ward I give and devise the same 
premises unto and to the use of my grandson George Ward the son of the above 
named James Ward during the term of his natural life and from and immediately after 
the determination of that estate by forfeiture or otherwise I give and devise the same 
premises unto the said Richard Pratt and Robert Woollams and to their heirs in trust 
as aforesaid to preserve and support the contingent remainders and uses hereinafter 
limitted from being defeated barred or destroyed and for that purpose to make entries 
and bring actions as occasions may be or require Nevertheless to permit and suffer the 
said George Ward to receive and take the rents issues and profits thereof for and 
during the term of his natural life and from and immediately after the decease of the 
said George Ward I give and devise the same premises unto and to the use and behoof 
of the first son lawfully begotten or to be begotten of the said George Ward and the 
heirs male of the body of such first son lawfully issuing and for default of such issue 
to the use and behoof of the second third and all and every other son and sons of the 
said George Ward and the heirs male of the body and bodies of such second third and 
other son and sons lawfully begotten or to be begotten severally and successively as 
shall be in seniority of age and priority of birth and for default of such issue to the use 
of my own right heirs male for Also I give and devise all that my messuage or 
tenement garden and premises thereto belonging situate and being in Finstock 
aforesaid now in the occupation of Edward Debank (?) unto my daughter Leah the 
wife of James Stow and her assigns for and during the term of her natural life and 
from and immediately after the determination of that estate by forfeiture or otherwise 
I give and devise the same premises unto the said Richard Pratt and Robert Woollams 
and to their heirs in trust only to preserve and support the contingent remainders and 
uses hereinafter limitted from being defeated barred or destroyed and for that purpose 
from time to time and at all times to make entries and bring actions as occasions may 
be or require Nevertheless to permit and suffer the said Leah Stow to receive and take 
the rents and profits thereof during the term of her natural life and from and 
immediately after the decease of the said Leah Stow I give and devise the same 
premises unto and to the use of my grandson Dennis Stow son of the said Leah Stow 
during the term of his natural life and from and immediately after the determination of 
that estate by forfeiture or otherwise I give and devise the same premises unto the said 
Richard Pratt and Robert Woollams and to their heirs in trust as aforesaid to preserve 
and support the contingent remainders and uses hereinafter limitted from being 
defeated barred or destroyed and for that purpose from time to time and at all times to 
make entries and bring actions as occasions may be or require Nevertheless to permit 
and suffer the said Dennis Stow to receive and take the rents issues and profits thereof 
for and during the term of his natural life and from and immediately after the decease 
of the said Dennis Stow I give and devise the same premises unto and to the use and 
behoof of the first son lawfully begotten or to be begotten of the said Dennis Stow and 
the heirs male of the body of such first son lawfully issuing and for default of such 
issue to the use and behoof of the second third and all and every other son and sons of 
the said Dennis Stow and the heirs male of the body and bodies of such second third 
and other son and sons lawfully begotten or to be begotten severally and successively 
as they shall be in seniority of age and priority of birth and for default of such issue to 
the use of my own right heirs male for ever I also give and devise all that my 
messuage or tenement garden and premises thereto belonging situate and being in the 
Parish of Finstock aforesaid and now in the occupation of Henry Cross unto my 
daughter Eunis the wife of the said Henry Cross and her assigns for and during the 
term of her natural life and from and after the determination of that estate by 
forfeiture or otherwise I give and devise the same premises unto the said Richard Pratt 
and Robert Woollams and to their heirs in trust only to preserve and support the 
contingent remainders and uses hereinafter limitted from being defeated barred or 
destroyed and for that purpose from time to time and at all times to make entries and 
bring actions as occasions may be or require Nevertheless to permit and suffer the 
said Eunis Cross to receive the rents issues and profits thereof during the term of her 
natural life and from and immediately after the decease of the said Eunis Cross I give 
and devise the same premises to my grandson Cornelius Cross during the term of his 
natural life and from and immediately after the determination of that estate by 
forfeiture or otherwise I give and devise the same premises unto the said Richard Pratt 
and Robert Woollams and to their heirs in trust as aforesaid to preserve and support 
the contingent remainders and uses hereinafter limitted from being defeated barred or 
destroyed and for that purpose from time to time and at all times to make entries and 
bring actions as occasions may be or require Nevertheless to permit and suffer the 
said Cornelius Cross to receive and take the rents issues and profits thereof for and 
during the term of his natural life and from and immediately after the decease of the 
said Cornelius Cross I give and devise the same premises unto and to the use and 
behoof of the first son lawfully begotten or to be begotten of the said Cornelius Cross 
and the heirs male of the body of such first son lawfully issuing and for default of 
issue to the use and behoof of the second third and all and every other son and sons of 
the said Cornelius Cross and the heirs male of the body and bodies of such third and 
other son and sons lawfully begotten or to be begotten severally and successively as 
they shall be in seniority of age and priority of birth and for default of such issue to 
the use of my own right heirs male for ever And I do hereby subject and make 
chargeable the above described premises with the payment of the sum of ten pounds 
unto my grandson Daniel Ward to be paid him by the person or persons entitled for 
the time being to the rents thereof by virtue of this my will by four annual payments 
of two pounds and ten shillings each year the first payment to be made at the end of 
the first year next after my decease Also I give I give and devise all that my messuage 
or tenement orchard garden and premises thereto belonging situate and being at New 
Yat in the Parish of Hailey in the County of Oxford now in the occupation of John 
Vines (?) unto my two grandsons Aaron Stow and Moses Stow and their assigns in 
equal moieties for and during the term of their natural lives and from and after the 
determination of that estate by forfeiture or otherwise I give and devise the same 
premises unto the said Richard Pratt and Robert Woollams and to their heirs in trust 
only to preserve and support the contingent remainders and uses hereinafter limitted 
from being defeated barred or destroyed and for that purpose from time to time and at 
all times to make entries and bring actions as occasions may be or require 
Nevertheless to permit and suffer the said Aaron Stow and Moses Stow to receive and 
take the rents issues and profits thereof for and during the term of their natural lives in 
equal moities and from and immediately after the decease of the survivor of them the 
said Aaron Stow and Moses Stow I give and devise the same premises in equal 
moities unto and to the use and behoof of the first sons lawfully begotten or to be 
begotten of the said Aaron Stow and Moses Stow and the heirs male of the bodies of 
such first sons lawfully issuing and for default of such issue to the use and behoof of 
the second third and all and every other son and sons of the said Aaron Stow and 
Moses Stow and the heirs male of the bodies of such second third and other son and 
sons lawfully begotten or to be begotten severally and successively as they shall be in 
seniority of age and priority of birth and for default of such issue to the use of my own 
right heirs male for ever Also I give and devise all that my messuage or tenement and 
premises thereto belonging situate and being in Finstock aforesaid and now in the 
occupation of Elizabeth Baker unto my son Daniel Ward and his assigns for and 
during the term of his natural life and from and immediately after the determination of 
that estate by forfeiture or otherwise I give and devise the same premises unto the said 
Richard Pratt and Robert Woollams and to their heirs in trust only to preserve and 
support the contingent remainders and uses hereinafter limitted from being defeated 
barred or destroyed and for that purpose from time to time and at all times to make 
entries and bring actions as occasions may be or require Nevertheless to permit and 
suffer the said Daniel Ward to receive and take the rents issues and profits thereof for 
and during the term of his natural life and from and immediately after the decease of 
the said Daniel Ward I give and devise the same premises unto and to the use of my 
grandson Charles Ward during the term of his natural life and from and immediately 
after after the determination of that estate by forfeiture or otherwise I give and devise 
the same premises unto the said Richard Pratt and Robert Woollams and to their heirs 
in trust as aforesaid to preserve and support the contingent remainders and uses 
hereinafter limitted from being defeated barred or destroyed and for that purpose from 
time to time and at all times to make entries and bring actions as occasions may be or 
require Nevertheless to permit and suffer the said Charles Ward to receive and take 
the rents issues and profits thereof during the term of his natural life and from and 
immediately after the decease of the said Charles Ward I give and devise the same 
premises unto and to the use and behoof of the first son lawfully begotten or to be 
begotten of the said Charles Ward and the heirs male of the body of such first son 
lawfully issuing and for default of such issue to the use and behoof of the second third 
and all and every other son and sons of the said Charles Ward and the heirs male of 
the body and bodies of such second third and other son and sons lawfully begotten or 
to be begotten severally and successively as they shall be in seniority of age and 
priority of birth and for default of such issue to the use of my own right heirs for ever 
All the rest residue and remainder of my real and personal estates and effects of 
whatever nature or kind the same may be or consist of at the time of my decease not 
hereinbefore given or disposed of after payment of my just debts funeral and 
testamentary expences and other charges relating thereto I give devise and bequeath 
unto all and every my children in equal shares and proportions And lastly I do hereby 
nominate constitute and appoint the said James Ward my said son sole Executor of 
this my will and revoke all former and other will and wills by me at any time 
heretofore made. In witness whereof I have to this my last Will and Testament 
contained in this and the ten preceeding sheets of paper set my hand and to this 
eleventh and last sheet my hand and seal this sixth day of May one thousand eight

This Will was proved at Oxford on the 4th day of September in the year of our Lord 
1827 Before the Revd William Browne Clerk Master of Arts Surrogate of the 
Reverend George Turner Clerk Master of Arts Official Principal of the Reverend the 
Archdeacon of the Archdeaconry of Oxford lawfully constituted by the Oath of James 
Ward the son and sole Executor therein named to whom Admon was granted being 
first sworn duly to administer.
