This is the last Will & Testament of me Robert Pepall of the Parish of Holywell in the City of Oxford Gentleman, made this twenty fifth day of March one thousand eight hundred and eight first I give and bequeath unto my wife Elizabeth Pepall all my household furniture, plate, linen and china to and for her own use and benefit absolutely. also I give and bequeath unto The Reverend Joshua Dix of New College in the University of Oxford Master of Arts and Thomas Marson Butler of Jesus College in the said University of Oxford the sum of ten pounds each for the trouble they may have in the execution of the trusts hereby in their reposed. also I give and bequeath unto the said Joshua Dix and Thomas Marson all the rest residue and remainder of my personal estate and effects of what nature or kind soever and whensoever upon the following trusts that is to say upon trust that they or the survivor of them his executors or admons do and shall permit and suffer my said wife to occupy all those my messuages or tenements with the gardens and appurts then unto belonging situate in the parish of Holywell aforesaid which I hold by Lease under Merton College in the University of Oxford aforesaid or otherwise do and shall pay unto or permit and suffer her to raise and take the rents fines and profits thereof for and during the term of her natural life to and for her own use the paying the quit rent and taxes and keeping the said premises in tenable repair and from and after her demise upon trust that they my said trustees and the survivor of them his executors and admons do and shall permit and suffer my daughter Mary Looker to occupy the said household premises or otherwise do and shall pay unto or permit and suffer my said daughter Mary Looker to raise and take the rents fines and profits thereof to and for her own use and benefit for and during the term of her natural life she paying the quit rent and taxes and keeping the said premises in tenable repair and from and after the demise of my said daughter Mary Looker. upon trust that they my said trustees and the survivors of them his executors and admons do and shall assign and transfer all and singular the said household messuages or tenements and premises with their and every of their appurts unto my two grandchildren John Looker and Thomas Looker their executors advisors and assigns to whom I give and bequeath the same as tenants in common and not as joint tenants. and as for and concerning my ready money in the funds and money due to me from any person or persons and upon any account whatsoever upon trust that they my said trustees or the survivors of them his executors or admons do place the same out at interest or permit such monies as are already out at interest to remain where they are already placed upon public or private security in their own names and do and shall pay the interest and dividends thereof as the same shall become due and be received unto my said wife for and during the term of her natural life and from and after her decease do and shall divide the said principal monies and other the said last mentioned trust monies into six equal share and proportions and assign transfer and pay one sixth part or share thereof unto my daughter Sarah Dix to whom I give and bequeath the same and also do and shall assign transfer and pay the remaining five sixth parts of the said principle and other trust monies unto and between all my grandchildren Ann Dix, William Robert Dix, Harriot Dix, John Looker and Thomas Looker equally between them share and share alike and it is my will that the shares of each of them respectively shall be paid to them on their eventually attaining the age of twenty one years and that the interest and profits of each own share be applied in the mean time for and towards their respective maintenance's and education's and if either or any of them my said grandchildren shall happen to die before the age of twenty one years it is my will that the share or shares of each of them so dying shall go to the survivors or survivor at the age aforesaid and if all of them shall happen to die without attaining the age of twenty one years then it is my will that the said principle and other trust monies shall go and be paid to my loyal representatives and it is my express will and I do hereby declare that the receipt of my said daughter Sarah Dix shall be a good and sufficient discharge to my said trustees and the survivor of them his executors and admons for her share of the said trust monies not withstanding her govenature and that my said trustees do stand and be possessed thereof till paid unto her own hands for her own separate use and benefit independent of her present husband and that the same or any part thereof shall not be subject to his disposition by need or will or be under his control or be liable to the payment of any of his debts provided and it is my will that as often as the Lease of my said household Mesauges or Tenements Gardens and premises shall become renewable according to the custom of renewality Lease of the like kind it shall maybe lawful to and for my said trustees and the survivor of them his executors and admons and I do hereby direct them to surrender the existing Lease for the time being and to use this endeavours to procure a new Lease to be granted to them of the said premises upon the trusts aforesaid for such new term or terms as the Lessors shall be willing to grant and that the fines and fees and all other incidental expenses for such respective renewals shall be paid out of the rents and profits of the said premises all which now Lease hereafter to be taken shall from time to time remain continue and be subject to the like trusts as are herewith fore declared of and concerning the said Leasehold premises and I do hereby declare my mind and will to be that my said trustees and the survivor of them his executors and admons shall and may from time to time deduct and retain to him and themselves respectively by and out of the monies which shall by virtue of this my will come to his or their hands all such loss costs charges and expenses as they or either of them shall or may hear pay sustain or be put unto in the execution of this my will and that they my said trustees and the survivors of them his executors or admons shall be charged and chargeable only for such sums of money as they shall respectively actually receive by virtue of this my will and shall not be answerable or accountable the one for the other of them or for the acts receipts or defaults of the other of them or for any loss or damage which may happen to the aforesaid trust monies and premises unless the same shall happen by or through his or their wilful default and I do hereby nominate constitute and appoint the said Joshua Dix and Thomas Marson joint executors of this my will hereby revoking and making void all former and other wills by me made and declaring this only to be my last will and testament in witness whereof I have to this my will contained in these sheets of paper to the first two sheets thereof set my hand and to the last sheet
