In the Name of God Amen I Humphrey Orme of the City of Peterborough in the County of Northampton Esqr being of sound and disposing Mind Memory and Understanding(thanks be to Almighty God for the same)do make and Ordain this to be my last Will and Testament in manner and form following ffirst and Principally I recommend my Soul into the Hands of Almighty God that gave it me and my Body I commit to the Earth to be decently interred at the discretion of my Executors hereinafter mentioned And as to the Worldly Estate wherewith it hath Pleased Almighty God to bless me I Dispose thereof as follows that is to say I Give and bequeath unto my Dear Brother Captain John Orme and to my Worthy friend Armstead Parker of Peterborough aforesaid Esqr and to their Heirs and Assigns All and Singular my ffreehold and Copyhold Messuages Lands Tenements and Hereditaments Whatsoever and wheresoever within this Realm To hold the same and every Part and Parcell thereof to them In Trust and for the Sole use and benefit of my Dearly beloved Son Walden Orme for and untill Such time as he the Said Walden Orme shall arrive at his full age of Twenty five Years then and from thenceforth I Give and Devise the said Premises to my said Son his Heirs and Assigns for ever I also Give & Devise unto the said John Orme and Armstead Parker their Executors Administrators and Assigns after Payment of my Just Debts and ffuneral Expences All and Singular my Goods and Chattles Rights Credits and Personal Estate whatsoever likewise In Trust for the Sole use and benefit of my said Son untill he shall arrive at his said Age of Twenty five Years and then to and for his Sole use and Benefit But if my said Son Walden Orme shall depart this Life before he arrives at his said Age of Twenty five Years without issue of his Body lawfully begotten or shall before that time Marry without the Consent or good liking of the said two Trustees In either of the Said Cases I Give and bequeath unto my Said Brother John Orme All my said Real and Personal Estates to hold the same to him his Heirs Executors Administrators and Assigns to his and their own Proper use and benefit absolutely forever And it is my Will and Pleasure that whatsoever charges or Expences the said Trustees or either of them Shall be put to in or about the Execution of this my Will or the Trusts in them hereby reposed Shall be deducted out of my said Personal Estate and allowed them before my Said Son Shall be intitled to receive the Remainder and that neither of my Said Trustees Shall be Answerable for any Act or Deed of the other of them or for any Loss that may happen in the Putting out at Interest or otherwise disposing of any Part of my Personal Estate Unless the Same Shall be Occasioned by any of their Wilfull Neglect And Lastly I hereby constitute Depute and appoint the said John Orme and Armstead Parker full and Sole Executors of this my last Will and Testament In Trust and for the Purposes aforesaid In full Confidence that they Will Act with Integrity and do all that may be in their Power for the benefit and Advantage of my said Son And I Do hereby earnestly Admonish my Said Son to be Governed and Advised by Such good Counsel as my Said Brother and the said Armstead Parker will give him in regard to his future Behaviour In Witness whereof I have hereunto Set my Hand and Seal this Twenty fourth day of ffebruary in the Year of our Lord God One Thousand seven hundred and forty six H Orme (Attestation Clause) Richd Berrow Char Burdet Char Burdet Junr. A Codicil annexed to the last Will and Testament of Captain Humphry Orme Whereas I Humphrey Orme of the City of Peterborough have made my Will I do hereby Order and Appoint that this Present Writing and the several requests hereinafter mentioned be Annexed as a Codicil to my said last Will and Testament and by taken as Part and Parcell thereof that is to Say that all my Debts be paid out of the Money due unto me upon the Estate late my Wife?s and now one Moiety of the said Estate belonging to my Son Walden Orme and the other Moiety to the Wife of ffelton Hervey Esqr or to any other concerned therein My Will is to have Money Raised out of the said Estate as allowed by a Master in Chancery to pay my Debts Dues and Demands and untill Part of the Estate be Sold to Pay off the Incumbrances that is upon it I order that the Rents and Profits of my Estate in the Town of Peterborough Shall be Subject to Pay the Interest Money due from time to time to my Creditors untill Money is raised off the Estate to pay my Debts which I most sincerely request of my Son to be done as Soon as Possible As Witness my Hand and Seal this Sixteenth day of November 1747 Proved at London (with a Codicil Annexed) 29 August 1751 PCC Prob11/789
