CARTER John, Hartley Wintney, Hampshire PRO 11/1418 Will written 16 March 1802 Will proved 24 December 1804 This is the last Will and Testament of Mr. JOHN CARTER of Hartley Wintney in the County of Southampton, Yeoman, first and principally commend my Soul into the hands of Almighty God and my Body I commit to the Earth to be decently interred at the discretion of my Executrix hereinafter named and as to such worldly estate and effects as I shall happen to be possessed of or entitled unto at the time of my decease I give and dispose thereof as follows. That is today given and bequeathed unto my daughter ELEANOR CARTER the sum of ten pounds of lawful English money to be paid to her or her assigns as soon as conveniently can be after my decease for the purpose of her maintenance until the annuity hereinafter given and bequested to her shall become in part payable. Also I give and bequeath to the said ELEANOR CARTER or her assigns one … annuity yearly Rent Charge or sum of forty pounds of like lawful Money to be issuing and payable out of all and every my freehold, copyhold and leasehold messuages, farms, lands and premises which are by me herein after given and devised to my Daughter, MARY HACK Widow, the said annuity or yearly rent charge to be paid to the said ELEANOR CARTER or her assigns by four quarterly payments of ten pounds with the first payment thereof to be made at the end of the first three calendar months next after my decease and always to be paid fare and clear of and from all manner of Taxes Charges and dispositions whatsoever to be taxed charged or assessed upon the said annuity or upon the said ELEANOR CARTER in respect thereof by authority of parliament or otherwise howsoever and if it shall happen that the said annuity and rent charge of forty pounds or any part thereof shall be behind and unpaid by the span of ten days next over or after any or either of the said days whereof the same is made payable and ought to be paid as aforesaid being lawfully demanded that there and from thenceforth and from time to time as often as the said annuity or any part thereof shall be so in arrear and unpaid it shall and may be lawfull to and for the said ELEANOR CARTER or her assigns into and upon all and every the same Messuages, Farms, Lands, Heredits and premises or any part or parts thereof so charged ..... therewith to enter and distrain and the distress and distresses then and there found to take, load ... and carry away and impound and impound to retain and keep or otherwise to sell and dispose of the same untill thereby or otherwise she or they shall be fully satisfied and paid such annuity or yearly rent charge or so much thereof as shall be in arrear together with all costs, charges and expenses whatsoever as shall be occasioned by such entry distress and sale. Also I give and bequeath unto my Daughter ELIZABETH CARTER the sum of seventeen pounds and ten shillings of like money to be paid to her or her assigns as soon as conveniently can be after my decease for the purpose of her maintenance untill the annuity hereinafter given and bequeathed to her shall inpart become payable also I give and bequeath to the said ELIZABETH CARTER or her assigns one … annuity Yearly Rent Charge or sum of seventy pounds of lawful money of Great Britain to be issuing and payable out of all and every my said freehold, copyhold and leasehold Messuages, Farms, Lands, Heriditaments and premises The said annuity or Rent Charge to be paid to the said ELIZABETH CARTER or her assigns by four quarterly payments of seventeen pounds and ten shillings each the first payment thereof to be made available? of the first three calendar months next after my demise and always to be paid free and clear of and from all taxes charges and dispositions whatsoever to be taxed charged or assessed upon the said annuity or upon my said Daughter ELIZABETH CARTER in respect thereof by authority of parliament or otherwise howsoever and if it shall happen that the said annuity or Rent Charge of seventy pounds or any part thereof shall be behind or unpaid by the span of ten Days next over or after any or either of the said Days whereupon the same is made payable and ought to be paid as aforesaid being lawfully demanded that there and from thenceforth and from time to time as often as the said annuity or any part thereof shall be so in arrears and unpaid it shall and may be lawful to and for my said Daughter ELIZABETH CARTER into and upon all and every the same Messuages, Farms, Lands, Heridits and premises or any part or parts thereof to enter and distrain and the distress and distresses then and there found to take, load ... and carry away and impound and impound to retain and keep or otherwise to sell and dispose of the same untill thereby or otherwise she or they shall be fully satisfied and paid such annuity or yearly rent charge or so much thereof as shall be in arrear together with all costs, charges and expenses whatsoever as shall be occasioned by such entry distress and sale. Also I give and bequeath unto my daughter ELIZABETH CARTER the sum of one thousand pounds of like lawfull money to be paid to her or her assigns within twelve calendar months next after my decease out of the residue of my personal estate and it is my express wish and I so hereby order and direct that the said several annuities and legacies so by me given and bequeathed unto my said daughters ELEANOR and ELIZABETH respectively shall from time to time as the same shall become due be paid into their proper hands respectively to and for their own respective sole and separate use and benefit to the intent that the same or any part thereof may not be at the disposal of or subject or liable to the control debts or engagements of any husband with whom they my said Daughters ELEANOR and ELIZABETH or either of them intermarry and that the receipt and receipts of their my said daughters respectively not withstanding their coverture shall be good and sufficient discharged from time to time for their said respective annuities and legacies and every part thereof and by and subject to the payment of the said several annuities and legacies herein before by me given and bequeathed and hereafter given and bequeathed upon the contingencies hereinafter mentioned and also to the payment all and every my just debts funeral and testamentary charges and expenses I give devise and bequeath all and every my freehold copyhold and leasehold messuages or tenements farms lands heredits and premises whatsoever and wheresoever and also all and every my Monies Securities for Money Stock Goods Chattels Personal Estate and Effects whatsoever and wheresoever and of what nature kind soever the same be and consist unto my said daughter MARY HACK her heirs executors administrators and assigns respectively for ever according to the respective natures and qualities of the same Estates provided always that in case my said Daughter ELEANOR CARTER shall happen to intermarry and shall bear any child or children of her body lawfully begotten living the time of her decease who shall live to attain the age of twenty one years then my will is and I do hereby give and bequeath unto such child or children the Legacy or sum of one thousand pounds of like lawfull money to be divided between them if more than one equally share and share alike and if but one child then the whole to such one child and to be paid and payable to them respectively when and so soon as he she or they shall arrive to and attain his her or their age or ages of twenty one years and I do hereby charge and subject the said several freehold copyhold and leasehold Messuages Farms Lands Hereditaments and Premises so herein before by me given and devised to the said MARY HACK as aforesaid and every part and parcel thereof with the payment thereof accordingly provided also that in case my said Daughter ELIZABETH CARTER shall happen to intermarry and shall bear any child or children of her body lawfully begotten living the time of her decease who shall live to attain the age of twenty one years then my will is and I do hereby give and bequeath unto such child or children the Legacy or sum of two thousand pounds of like lawfull money to be divided between them if more than one equally share and share alike and if but one child then the whole to such one child and to be paid and payable to them respectively when and so soon as he she or they shall arrive to and attain his her or their age or ages of twenty one years and I do hereby charge and subject the said several freehold copyhold and leasehold Messuages Farms Lands Hereditaments and Premises so herein before by me given and devised to the said MARY HACK as aforesaid and every part and parcel thereof with the payment thereof accordingly And I do nominate constitute and appoint the said MARY HACK sole executrix of this my Will hereby revoking and making void all former Wills by me made. In witness whereof I the said JOHN CARTER the Testator have to this my Last Will and Testament contained in four sheets of paper to the first three sheets thereof set my hand and to the fourth and last sheet my hand and seal this sixteenth day of March in the forty second year of the Reign of our Sovereign Lord George the third by the Grace of God of the United Kingdom of Great Britain and Ireland King Defender of the Faith and in the year of our Lord one thousand eight hundred and two. Whereas I JOHN CARTER have made my Last Will and Testament bearing date the sixteenth day of March instant which is intended to be hereunto annexed and thereby have given and bequeathed unto my Daughter ELEANOR CARTER therein named amongst other things one clear? Annuity Yearly Rent Charge or sum of forty pounds of lawfull English Money to be issuing and payable out of all and every my freehold copyhold and leasehold messuages farms lands and premises which are by me therein after given and devised to my Daughter MARY HACK Widow payable as therein mentioned with certain powers of entry distress and sale for the b… securing the payment thereof accordingly and I have also by the same Will amongst other things given and bequeathed unto my Daughter ELIZABETH CARTER one clear? Annuity yearly Rent Charge or sum of seventy pounds of like lawfull money payable as therein mentioned and charged the same on the same Estates and premises and under and subject to such powers as before mentioned with respect to my said Daughter ELEANOR’s annuity and whereas I have by my said Will provided that in the event of my said Daughter ELEANOR’s marriage and having any child or children of her body lawfully begotten living at the time of her decease who should live to attain the age of twenty one years such child or children should have and be entitled to the Legacy or sum of one thousand pounds to be paid and applied as therein is particularly mentioned and I have charged and subjected the before mentioned freehold copyhold and leasehold Estates so given by my said Will to the said MARY HACK with the payment thereof and I further provided by my said Will that in the event of my said Daughter ELIZABETH’s marriage and having any child or children of her body lawfully begotten living at the time of her decease who should live to attain the age of twenty one years such child or children should have and be entitled to the Legacy or sum of two thousand pounds to be paid and applied as therein particularly mentioned which last mentioned legacy I have also charged and subjected the same Estates and premises so as aforesaid devised to my said daughter MARY HACK with the payment of and whereas I have considered that by? reason of the said several Annuities and legacies being charged on the said Estates so devised to my said Daughter MARY HACK as aforesaid it may be attended with difficulty or inconvenient for her to make a marketable Title to the same Estates in case she should have occasion to sell or dispose of the same therefore to obviate? any such difficulty or inconvenience I do by this paper writing which I declare to be a codicil to my said Will and direct to be and considered as part thereof order and provide that in case my said Daughter MARY HACK her heirs executors or admin shall be at any time disposed to exonerate the said freehold copyhold and leasehold Estates so by me given and devised to her by my said Will of and from the before mentioned annuity and contingent legacies so thereby given to my said Daughters ELEANOR and ELIZABETH and provided for their respective assigns shall invest on good and sufficient Security at interest in the names of two Trustees one to be named by her the said MARY HACK and the other by the said ELEANOR and ELIZABETH respectively such principal sum or sums of money as shall produce any Interest equal to the said several Annuities so given and bequeathed to the said ELEANOR and ELIZABETH as aforesaid which interest shall be from time to time … and paid to the said ELEANOR and ELIZABETH respectively in such and the same manner as the same Annuities are made payable to them respectively by the terms of my said Will and also do and shall in like manner invest in any or either of the public funds or on other good and sufficient security the said several sums of one thousand pounds and two thousand pounds so provided and intended by my said Will for the Child or Children of my said Daughters ELEANOR and ELIZABETH respectively in the event of their respective Marriage and having any / the Interest of which said several sums is to be paid unto her my said Daughter MARY HACK her Executors Administrators and Assigns until the same several Legacies shall respectively become payable by virtue of my said Will then and immediately from and after such several investments shall be made in manner aforesaid and the Trustees so to be named as aforesaid in whose Names the said investments shall be made their signed and executed Declarations of Trust of the same monies for the several intents and purposes therein before and in my said Will expressed and so thereby declare that all and every the same freehold copyhold and leasehold Estates so by me given and bequeathed by my said Will to the said MARY HACK as aforesaid shall be wholly exonerated and discharged of and from the said several annuities and contingent Legacies so given to my said Daughters ELEANOR and ELIZABETH and provided for their Issue? respectively as aforesaid and all and every the powers in my said Will contained for the receiving or recovering the same. In Witness whereof I the said JOHN CARTER the Testator have to this my said Codicil written and contained in two sheets of paper to the first sheet thereof have set my hand and to this second and last sheet thereof set my hand and affixed my seal this twenty seventh day of March in the year of our Lord one thousand eight hundred and two. Whereas since the oath and execution of my last Will and Testament I have made several purchases of Land Hereditaments and Premises and I have contracted for the purchase of a farm lands and premises wherein I now reside situate in Hartley Wintney aforesaid Now I declare my Mind and will to be that consideration? Money expressed in such contract shall be paid and satisfied by and out of my personal Estate and I do give and devise the same Estate and all benefit of the said Contract as well as all the other Hereditaments and premises which I have acquired subsequent to the date and execution of my said Will with their and every of their appurtenances unto my Daughter MARY HACK her heirs and assigns for ever and I confirm my said Will in every respect and I desire this to be annexed to and taken as part thereof In witness whereof I have hereunto set my hand and seal the ninth day of June in the year of our Lord one thousand eight hundred and four.
