At a Special Court Baron of The Right Honorable Arthur George Earl of Onslow Lord of the said Manor held for the said Manor on Saturday the second day of October in the eleventh year of the reign of our Sovereign Lady Victoria by the Grace of God of the United Kingdom of Great Britain and Ireland Queen defender of the faith and in the year of our Lord One thousand eight hundred and forty seven Before Joseph Hockley Gentleman Steward of the Courts of the said Manor.

Death of John Roake
At this Court came here into Court in his proper person David Roake and delivered to the said Steward the Probate Copy of the last Will and Testament of John Roake late one of the Copyhold or Customary Tenants of the said Manor who held to him and his heirs by Copy of Court Roll at the Will of the Lord according to the custom of the said Manor A customary messuage or tenement together with the barn and other outbuildings orchards gardens yards backsides and appurtenances thereto belonging formerly in the tenure of William Johnson or his assigns by the yearly rent of One shilling and sixpence heriot suit of Court and other services and also all those five closes of copyhold arable meadow and pasture land containing by estimation seven acres more or less in Bisley within this Manor by the yearly rent of one shilling and sixpence heriot suit of Court and other services  Also all that messuage tenement or cottage and one acre of land with the appurtenances to the same adjoining lying in Bisley aforesaid by the yearly rent of six pence heriot suit of Court and other services And also a scite of a cottage or tenement called Vanits and one acre of land to the same belonging with the appurtenances and also one acre of land late part of the waste adjoining to a close called Hassell Hill within this Manor by the yearly rent of fourpence heriot suit of court and other services Which Will bears date the third day of May one thousand eight hundred and forty five and is partly in the words following to wit “I give devise and bequeath unto my son David Roake all those my copyhold messuages or tenements buildings gardens land and hereditaments containing altogether about fourteen acres (be the same more or less) situate lying and being within and holden of the Manor of Bisley in the said County of Surrey To have and to hold the said messuages or tenements gardens lands and hereditaments with their respective appurtenances unto and to the use of my son David Roake his heirs and assigns for ever”
Admittance of David Roake
Now at this Court upon the first Proclamation came here into Court in his proper person the said David Roake and humbly prayed to be admitted tenant to the said customary messuage or tenement together with the barn and other outbuildings orchards gardens yards backsides and appurtenances thereto belonging formerly in the tenure of William Johnson or his assigns which came into the hands of the Lord of this Manor on the death of the said John Roake To whom the Lord of the Manor aforesaid by his Steward aforesaid granted the same and delivered seizin thereof by the rod To hold to the said David Roake his heirs and assigns for ever by copy of Court Roll at the Will of the Lord according to the custom of the said Manor by the yearly rent of one shilling and sixpence heriot when it shall happen Suit of Court and other Services and customs therefore formerly due and of right accustomed And so he was admitted tenant thereof in form aforesaid Gave to the Lord as a fine for such his admittance as appears in the Margin [£12] and his fealty was respited.

Also at this Court upon the first Proclamation came here into Court in his proper person the said David Roake and humbly prayed to be admitted tenant to all those five closes of copyhold arable meadow and pasture land containing by estimation seven acres more or less in Bisley within the said Manor which also came into the hands of the Lord of this Manor on the death of the said John Roake To whom the Lord of the Manor aforesaid by his Steward aforesaid granted the same and delivered seizin thereof by the rod To hold to the said David Roake his heirs and assigns for ever by copy of Court Roll at the Will of the Lord according to the custom of the said Manor by the yearly rent of one shilling heriot when it shall happen Suit of Court and other Services and customs therefore formerly due and of right accustomed And so he was admitted tenant thereof in form aforesaid Gave to the Lord as a fine for such his admittance as appears in the Margin [£20 8s] and his fealty was respited.

And again at this Court upon the first Proclamation came here into Court in his proper person the said David Roake and humbly prayed to be admitted tenant to all that the said messuage tenement or cottage and one acre of land with the appurtenances to the same adjoining lying in Bisley aforesaid which also came into the hands of the Lord of this Manor on the death of the said James [sic] Roake To whom the Lord of the Manor aforesaid by his Steward aforesaid granted the same and delivered seizin thereof by the rod To hold to the said David Roake his heirs and assigns for ever by copy of Court Roll at the Will of the Lord according to the custom of the said Manor by the yearly rent of sixpence heriot when it shall happen Suit of Court and other Services and customs therefore formerly due and of right accustomed And so he was admitted tenant thereof in form aforesaid Gave to the Lord as a fine for such his admittance as appears in the Margin [£10] and his fealty was respited.

And also at this Court upon the first Proclamation came here into Court in his proper person the said David Roake and humbly prayed to be admitted tenant to the said scite of a cottage or tenement called Vanits and one acre of land to the same belonging with the appurtenances and also one acre of land late part of the waste adjoining to a close called Hassell Hill within this Manor which also came into the hands of the Lord of this Manor on the death of the said John Roake To whom the Lord of the Manor aforesaid by his Steward aforesaid granted the same and delivered seizin thereof by the rod To hold to the said David Roake his heirs and assigns for ever by copy of Court Roll at the Will of the Lord according to the custom of the said Manor by the yearly rent of four pence heriot when it shall happen Suit of Court and other Services and customs therefore formerly due and of right accustomed And so he was admitted tenant thereof in form aforesaid Gave to the Lord as a fine for such his admittance as appears in the Margin [£5 12s] and his fealty was respited.

Conditional Surrender David Roake to Mary Fenn
And afterwards at this Court came here into Court in his proper person the said David Roake and in consideration of the Sum of two hundred pounds of lawful money of the United Kingdom of Great Britain and Ireland of English value and currency to him the said David Roake paid by Mary Fenn of Horsell in the County of Surrey Spinster Surrendered into the hands of the Lord of the said Manor by the rod and by the acceptance of the Steward aforesaid according to the custom of the said Manor A customary messuage or tenement together with the barn and other outbuildings orchards gardens yards backsides and appurtenances thereto belonging And also all those five closes of copyhold arable meadow and pasture land containing by estimation seven acres more or less in Bisley within the said Manor And also all that messuage tenement or cottage and one acre of land with the appurtenances to the same adjoining lying in Bisley aforesaid And also a scite of a cottage or tenement called Vanits and one acre of land to the same belonging with the appurtenances And also one acre of land late part of the Waste adjoining to a Close called Hassell Hill within this Manor to all which said premises he the said David Roake had at this Court immediately before been admitted To the only use and behoof of the said Mary Fenn her heirs and assigns for ever Upon Condition nevertheless to be void if the said David Roake his heirs executors administrators or assigns do and shall well and truly pay or cause to be paid unto the said Mary Fenn her executors administrators or assigns the full Sum of Two hundred pounds of lawful money aforesaid with interest for the same after the rate of four pounds ten shillings per cent per annum on the second day of April now next ensuing.

 [Margin Note: Be it remembered that on the sixth day of April one thousand eight hundred and fifty three The Reverend Isaac Spencer and Mary his Wife late Mary Fenn in this Surrender named did acknowledge that they had that day had and received of and from David Roake in this Surrender also named All Principal and Interest Monies due and owing upon and by virtue of this Surrender And the said Isaac Spencer and Mary his Wife did by writing under their hands of that date authorise and empower the Steward of this Manor to enter their acknowledgement of such satisfaction on the Court Rolls or Books of the said Manor accordingly.  Witness my Hand Joseph Hockley Steward]
