Know all Men by these Presents That Thomas Heckstall Smith of Chistlehurst in the County of Kent Esquire Edmund Boyle Church of The Bank Highgate Esquire and Joseph Prior of No. 61 Lincolns Inn Fields in the County of Middlesex Gentleman the Devisees of Trust and Mortgage Estates named in the Last Will and Testament of Sarah Marshall late of Broadwater in the parish of Godalming in the County of Surrey Widow deceased dated the thirty first day of August one thousand eight hundred and seventy and a Codicil thereto dated the tenth day of September one thousand eight hundred and seventy three Do and each of them Doth make ordain constitute and appoint Hugh Framingham Day of Godalming in the County of Surrey Gentleman and John Debenham the younger of Godalming aforesaid Gentleman and each of them jointly and severally their and each of their true and lawful Attornies and Attorney for them and each of them and in their and each of their names or name and stead as such Devisees as aforesaid or in the names or name of the said Attornies either of them or otherwise as the case may require to attend at the next or subsequent General or Special Court to be holden for the manor of Bisley aforesaid and to claim admittance of the Lord of the said Manor and to be admitted to the following copyhold hereditaments held of the said Manor viz. Firstly All those two pieces or parcels of meadow land containing together by admeasurement three acres three roods and nineteen perches be the same more or less situate and lying in the parish and manor of Bisley in the said County of Surrey adjoining to the land hereinafter described called Loam Pitts And also All that piece or parcel of arable land called the Shoulder of Mutton Field containing by admeasurement one acre two roods and three perches be the same more or less situate and lying in the parish and manor of Bisley aforesaid Secondly all those two pieces or parcels of land called Loam Pits containing by admeasurement nine acres one rood and one perch be the same more or less situate and lying in the parish and manor of Bisley aforesaid Thirdly all that Messuage or tenement with the appurtenances called Whichood and one close of land adjoining by estimation one acre lying in Bisley aforesaid Fourthly All that piece or parcel of land or Ground (inclusive of the Road leading into North West Corner thereof Allotted by an award under the hand and seal of the Commissioner for the inclosure of certain open and common lands and fields of the said parish of Bisley bearing date the sixth day of August One thousand eight hundred and sixty eight unto and for the said Sarah Marshall as devisee of her husband George Marshall deceased containing one acre situate and being in Neltro or Neltrow Common Field and bounded on the North by land the property of Jane the wife of William Daborn on the East by the allotments awarded to William Chandler and Numbered 9 on the Inclosure plan on the South East by the Allotment next hereinafter described and on the West by a portion of the allotment awarded to Thomas Charlton and William Lowless and numbered 1 on the same plan which allotment last hereinbefore described is Numbered 3 on the said Inclosure plan and was allotted to the said Sarah Marshall in lieu of and for one acre of land in Neltro being part and parcel of the copyhold premises described on the Court Rolls of the said Manor as “All that Customary Messuage with the Orchard formerly in the tenure of Philip Roberts and one close of land to the same belonging containing by estimation one acre more or less and one acre of land more or less in Neltro with the appurtenances” Fifthly All that piece or parcel of land or Ground allotted by the said award unto and for the said Sarah Marshall as such devisee as aforesaid containing one acre and nineteen perches situate and being in Neltro or Neltrow Common field aforesaid and bounded on the North by the allotment lastly hereinbefore described on the East by the allotments No.s 7 and 8 on the said Inclosure plan on the South East by the allotment next hereinafter described and on the West the allotment No. 1 on the said Inclosure plan and which allotment last hereinbefore described is No.d 3 on the said Inclosure plan and was allotted unto the said Sarah Marshall in lieu of and for the copyhold premises described on the Court Rolls of the said Manor as “All that parcel of Arable land in the Common Field called Neltro in Bisley by estimation one acre more or less and half an acre of Meadow in Churchbourne Mead with the appurtenances in Bisley“ And Sixthly all that piece or parcel of land or Ground allotted by the said award unto and for the said Sarah Marshall as such devisee as aforesaid containing Four acres and two roods situate and being in Neltro or Neltro common field aforesaid and bounded on the North by the allotment lastly hereinbefore described and No. 3A on the said Inclosure plan on the East by the allotments No.s 6 and 11 on the said Inclosure plan on the South East by land belonging to the Estate of the late Edmund Vincent on the West by a portion of the allotment No. 1 on the said Inclosure plan which allotment last hereinbefore described is No. 3B on the said Inclosure plan and was allotted unto the said Sarah Marshall in lieu of and for the copyhold premises described on the Court Rolls of the said Manor as “Two acres of land and half an acre of land lying in the Common Field called Neltro and Two acres of land and half an acre of land lying in the Common Field called Widecroft in the said manor” to all which said hereditaments firstly secondly and thirdly hereinbefore described and to the hereditaments in respect of which the three several allotments fourthly fifthly and sixthly hereinbefore described were allotted the said Sarah Marshall was admitted at a General Court Baron held for the said Manor on the twelfth day of May One thousand eight hundred and fifty six as devisee of her said late husband George Marshall deceased which said George Marshall was admitted to the same hereditaments at a Special Court Baron held for the said Manor on the fourth day of June One thousand eight hundred and fifty three on the forfeited surrender of James Hone and Jane his wife And also for their and each of their and in their and each of their names or name and stead as such Devisees as aforesaid or in the names or name of the said Attornies either of them or otherwise as the case may require immediately after such admittance or at some subsequent General or Special Court or at any time thereafter out of Court to surrender the same premises Together with all rights of common trees fences hedges ditches ways watercourses easements and appurtenances to the same premises belonging or in any wise appertaining And all the estate right title interest property claim and demand whatsoever at law and equity of them the said Thomas Heckstall Smith Edmund Boyle Church and Joseph Prior and each and every of them as such Devisees of the said Sarah Marshall as aforesaid in to and out of the same premises and every part thereof into the hands of the Lord of the said Manor by the rod and acceptance of the Steward according to the custom of the said Manor To the Use of William Williams of No. 9 Southampton Street Bloomsbury in the County of Middlesex Gentleman his heirs and assigns at the will of the Lord of the said Manor according to the custom of the said Manor by and under the suits services rents fines and heriots therefore due and of right accustomed freed and discharged from all equity of redemption heretofore affecting the said premises And generally to do execute and perform all acts matters and things necessary for obtaining such admittance and affecting such surrender as aforesaid as fully and effectually as the said Thomas Heckstall Smith Edmund Boyle Church and Joseph Prior could do if personally present the said Thomas Heckstall Smith Edmund Boyle Church and Joseph Prior and each of them truly ratifying and confirming and agreeing to ratify and confirm all and whatsoever the said attornies or either of them may lawfully do in the premises by virtue of these presents In witness whereof the said Thomas Heckstall Smith Edmund Boyle Church and Joseph Prior have set their hands and At this Court came here into Court William Williams of No. 9 Southampton Street Bloomsbury in the County of Middlesex Gentleman by Charles Gilbert his Attorney and delivered to the said Deputy Steward a certain Absolute Surrender taken out of Court and since the last General Court to wit on the twenty fourth day of November instant Whereby Thomas Heckstall Smith of Chislehurst in the County of Kent Esquire Edmund Boyle Church of Highgate in the County of Middlesex Esquire Joseph Prior of 61 Lincolns Inn Field in the County of Middlesex Gentleman Devisees of Trust and Mortgage Estates under the last Will and Testament of Sarah Marshall late of Broadwater in the parish of Godalming in the County of Surrey Widow deceased three of the Customary Tenants of the said Manor by Hugh Framingham Day of Godalming in the County of Surrey Gentleman their Attorney duly authorized by writing under the hands and seals of the said Thomas Heckstall Smith Edmund Boyle Church and Joseph Prior for that purpose (heretofore enrolled on the Court Rolls of this Manor) in consideration of eight hundred pounds Sterling to them paid by the said William Williams did Surrender into the hands of the Lord of the said Manor by the rod and by the acceptance of the said Deputy Steward according to the Custom of the said Manor Firstly all those two pieces or parcels of meadow land containing together by And thereupon at this Court upon the First Proclamation came here into Court the said William Williams by the said Charles Gilbert his Attorney and humbly prayed to be admitted tenant to All those two pieces or parcels of meadow land containing together by admeasurement three acres three roods and nineteen perches be the same more or less situate and lying in the parish and manor of Bisley in the said County of Surrey adjoining to the land hereinafter described called Loam Pitts And also all that piece or parcel of arable land called the Shoulder of Mutton Field containing by admeasurement one acre two roods and three perches be the same more or less situate and lying in the parish and manor of Bisley aforesaid in pursuance of the said Surrender To whom the Lord of the Manor aforesaid by his Steward aforesaid granted the same To hold to the said William Williams his heirs and assigns for ever by Copy of Court Roll at the Will of the Lord according to the custom of the said Manor by the yearly rent of one shilling and one penny Heriot when it shall happen suit of Court and other services and customs therefore formerly due and of right accustomed And so the said William Williams was by his said Attorney admitted tenant of the said premises accordingly Gave to the Lord as a fine for such his admittance as appears afterwards had seizin by the rod and his fealty was respited.
