John Stedman the younger Sworn.
At this Court cometh here into Court in his proper person Henry Atfield and in open Court Surrendered into the hands of the Lord of the said Manor by the acceptance of the said Steward All that his Messuage or Tenement and Garden with the Appurtenances called Edmeads situate lying and being in the Parish of Bisley within this Manor and now in the Occupation of John Shir? To the use and Behoof of John Stedman the Elder his heirs and Assigns for ever To the intent that he may be admitted thereto and become a perfect Tenant thereof with the Appurtenances So that a perfect common Recovery with double voucher may be had and suffered in this Court according to the usual Course of Recoveries for the Assurance of Lands Whereupon the said John Stedman the Elder present here in Court prayed to be admitted to the said premises To whom the Lord of the said Manor by his said Steward Granted the same To have and to hold to the said John Stedman the Elder his heirs and Assigns for ever by Copy of Court Roll at the will of the Lord according to the custom of the said Manor by the rents customs and Services therefore formerly due and of right accustomed and he gave to the Lord as a Fine for such his Estate as appears afterwards and so he is Admitted Tenant thereof hath Seizin by the Rod and his Fealty is pardoned
And afterwards at this Court came Henry Whittall in his proper person and by leave of the Court complains against the said John Stedman in a plea of Land that is to say of One Cottage one Garden and One Acre of Land with the Appurtenances held of the said Manor by Copy of Court Roll within the Jurisdiction of this Court and made Protestation to prosecute the Suit here against the said John Stedman in form and nature of a writ of Entry Sur Disseizin in le post at common Law according to the custom of this Manor and found Sureties for prosecuting his said Suit in form aforesaid to wit John Doe and Richard Roe And thereupon the said Henry Whittall in his proper person Demands against the said John Stedman the Tenements aforesaid with the Appurtenances in the said Manor of Bisley within the Jurisdiction of this Court and held by Copy of Court Roll as his right and Inheritance and into which the said John Stedman the Elder hath not Entry but after the Disseisin which Hugh Hunt unjustly and without Judgement made thereof to the said John Stedman the Elder within thirty years last past And thereupon he says he was Seised of the Tenements aforesaid with the Appurtenances in the Demesne as a Fee and Right at the Will of the Lord according to the custom of this Manor in the time of peace in the time of our Lord the Present King by takeing the profits thereof to the value &c and into which &c And thereupon he brings his Suite &c And the said John Stedman the Elder present here in Court in his proper person comes and defends his right when &c and thereupon he vouches to warrant the said Henry Atfield who personally present here in Court comes and defends his right when &c and freely warranteth to him the Tenements aforesaid with the Appurtenances Whereupon the said Henry Whittall demands against the said Henry Atfield Tenant by his own warranty the Tenements aforesaid with the Appurtenances in form aforesaid And thereupon he says that he was Seised of the Tenements aforesaid with the Appurtenances in his Demesne as of Fee and right at the Will of the Lord according to the custom of the said Manor in the time of peace in the time of the Lord the King that now is by takeing the profits thereof to the value &c and into which &c And thereupon the said Henry Atfield Tenant by his own warranty comes and defends his right when &c and thereupon further vouched to warrant James Scarlett who present herein Court in his proper person freely warranteth to him the Tenements aforesaid with the Appurtenances Whereupon the said Henry Whitall Demands against the said James Scarlett Tenant by his own warranty the Tenements aforesaid with the Appurtenances in his Demesne as of Fee and right at the will of the Lord according to the custom of the said Manor in the time of peace in the time of our Lord the present King by takeing the profits thereof to the value &c and into which &c And the said James Scarlett Tenant by his own warranty aforesaid in his proper person comes and defends his right when &c And says that the aid Hugh Hunt Did not Disseise the said John Stedman the Elder of the Tenements aforesaid with the Appurtenances as the said Henry Whitall by the plaint above supposed and upon this he puts himself upon the Homage of this Court according to the custom of this Manor And the said Henry Whitall doth the like And the said James Scarlett desired leave of the Court here to Imparle till one of the Clock in the afternoon of the same day and he hath it &c and the same hour is given to the said Henry Whitall And afterwards at this same Court at the hour aforesaid the said Henry Whitall cometh into Court in his proper person and the said James Scarlett though solemnly called did not appear but departeth in Contempt of the Court and made default therefore it is considered by the said Court that the said Henry Whitall recover The Seisin against the said John Stedman the Elder of the Tenements aforesaid with the Appurtenances And that the said John Stedman the Elder shall have of the Lands of the said Henry Atfield to the value &c And that the said Henry Atfield shall have of the Lands of the said James Scarlett to the value of &c And that the said James Scarlett shall be amerced And upon this the said Henry Whitall desired a precept to cause him to have full Seisin of the Tenements aforesaid with the Appurtenances directed to the Officer of this Court returnable without delay and it is granted to him &c.
And afterwards (to wit) on the same day the said Court yet sitting the said Henry Whittall comes into Court and the Officer of the same Court (to wit) Robert Hunt returneth and rectified to the Court here that he by virtue of the said Precept to him directed had caused the said Henry Whitall to have full Seisin of the Tenements aforesaid with the Appurtenances as by the said Precept he was commanded.
And afterwards at the same Court (to wit) Henry Whittall prayed to be Admitted Tenant to the Tenements aforesaid with the Appurtenances To whom the Lord of the said Manor by his said Steward Granted the same To have and to hold to the said Henry Whittall his heirs and Assigns for ever by Copy of Court Roll at the will of the Lord according to the custom of the said Manor by the Rents Customs and Services therefore due and of right accustomed And he is Admitted Tenant thereof and the Fine and Fealty thro the favour of the Lord are excused
Whereupon at this Court came again here into Court the said Henry Whittall Henry Atfield and John Stedman the Elder in their proper persons and Surrender into the hands of the Lord of the said Manor by the acceptance of the said Steward The said Messuage or Tenement Garden and Premises with their Appurtenances of which the said Recovery was hereinbefore immediately suffered and of all their Estate and Interest therein To the use and Behoof of John Hone of Bisley aforesaid Gentleman his heirs and Assigns and to and for no other use intent or purpose whatsoever.
Whereupon cometh into Court the said John Hone by John Stedman the Elder his Attorney and humbly prayed to be admitted to the said Messuage and Premises with their Appurtenances so Surrendered into the hands of the Lord of the said Manor by the said Henry Whittall Henry Atfield and John Stedman the Elder as aforesaid To whom the Lord of the said Manor by his said Steward Granted the same To have and to hold to the said John Hone his heirs and Assigns by Copy of Court Roll at the will of the Lord according to the custom of the said Manor by the yearly rent of eight pence half penny Herriot when it shall happen Suit of Court and other customs and Services therefore formerly due and of Right accustomed And he gave to the Lord as a Fine for such his admission as appears in the Margin [£2.2s] He is Admitted Tenant thereof hath Seisin by the Rod and his Fealty is Respited.
