This Indenture made the twenty ninth day of July One thousand eight hundred and eighty nine Between Henry Joseph Tenison Halsey of Pirbright in the County of Surrey Esquire of the first part John Moxon Daborn of Great George Street Westminster Robert John Porcher Broughton of Great Marlborough Street London and Frederick Peake of Bedford Row London Esquire of the second part Frederick Mellersh of Godalming in the said County of Surrey Esquire and Edward Joseph Halsey of No. 9 Drayton Gardens South Kensington in the County of Middlesex Esquire of the third part and The Right Honourable Francis Charteris Earl of Wemyss and March The Most Noble Hugh Lupus Duke of Westminster and The Right Honourable John Poyntz Earl Spencer of the fourth part and the said Earl of Wemyss and March of the fifth part Whereas by an Indenture dated the second day of December One thousand eight hundred and eighty and expressed to be made between Henry William Richard Westgarth Halsey and the said Henry Joseph Tenison Halsey of the one part and the said Frederick Mellersh and Edward Joseph Halsey of the other part the said Henry William Richard Westgarth Halsey and Henry Joseph Tenison Halsey in exercise of the power reserved to them by an Indenture therein referred to dated the first day of December One thousand eight hundred and eighty and expressed to be made between the said between Henry William Richard Westgarth Halsey of the first part and the said Frederick Mellersh and Edward Joseph Halsey of the second part the said Henry Joseph Tenison Halsey of the third part and Henry James Farrer of the fourth part and enrolled in the Chancery Division of Her Majesty’s High Court of Justice on the thirteenth day of December One thousand eight hundred and eighty appointed that the freehold hereditaments hereinafter described and intended to be hereby conveyed should together with other hereditaments therein mentioned remain and be (subject as to such parts of the same premises as were subject thereto to a sum of Thirty thousand pounds for the portions of the younger children of the said Henry William Richard Westgarth Halsey by his then late wife Mary Noel Halsey and the interest thereafter to become due for the same and to a term of One thousand years for raising the same portions (and which sum of Thirty thousand pounds has since been paid off out of monies produced by the sale of parts of the said Settled Estates and the said term has been merged) and also subject as to such parts of the same premises as were subject thereto to such of the annual  sums charged thereon by an Indenture dated the tenth day of March One thousand eight hundred and thirty five as were then subsisting charges and to a term of Ninety nine years for securing the same (all which sums have ceased to be payable and the said term of Ninety nine years has become satisfied) And also subject as to such parts of the same premises as were subject thereto to a yearly rentcharge of Two hundred pounds charged thereon for the Jointure of Caroline Halsey (the then wife of the said Henry William Richard Westgarth Halsey) and to a term of One hundred years for securing the same (which yearly rentcharge of Two hundred pounds has ceased by the death of the said Caroline Halsey on the twenty sixth day of September One thousand eight hundred and eighty six and the said term of One hundred years has become satisfied)) To the intent that it might be lawful for the said Henry Joseph Tenison Halsey to appoint all or any part of the said hereditaments thereby appointed to the use of any person or persons for any term of years by way of mortgage for securing the payment after the death of the said Henry William Richard Westgarth Halsey to such person or persons either beneficially or as Trustee or Trustees for such purposes as the said Henry Joseph Tenison Halsey should think fit of any sum or sums not exceeding on the whole the sum of Seven thousand pounds together with compound interest thereon as therein mentioned (which power has since been exercised and the money charged thereby has subsequently been paid off out of monies arising from the sale of parts of the said settled estates and the term created for securing the same has become satisfied) And subject as aforesaid To the use and intent that the said Henry Joseph Tenison Halsey and his assigns might during the joint lives of himself and the said Henry William Richard Westgarth Halsey receive a yearly rentcharge of two hundred pounds with powers for securing the same And subject to the said rentcharge so limited to the said Henry Joseph Tenison Halsey and to the powers and remedies for securing the same To the use of the said Henry William Richard Westgarth Halsey and his assigns for his life without impeachment of waste with remainder To the use of the said Henry Joseph Tenison Halsey and his assigns for his life without impeachment of waste with divers remainders over And in the Indenture in recital is contained a power for the said Henry Joseph Tenison Halsey after the death of the said Henry William Richard Westgarth Halsey by any Deed or Deeds (but subject as to such of the said incumbrances as might then be subsisting charges) to charge all or any part of the said premises with the payment to himself or to any other person or persons and his and their executors administrators or assigns of any sum or sums of money not exceeding in the whole the sum of Eight thousand pounds with interest at any rate not exceeding Ten pounds per centum per annum And by the same or any other Deed or Deeds (but subject as aforesaid) to appoint the premises charged as aforesaid for any term or terms of years upon trust for raising by mortgage or otherwise the principal sum and interest so charged as aforesaid (which power has been exercised and the money charged thereby has subsequently been paid off out of monies arising from a Sale of parts of the said settled estates and the term created for securing the same has become satisfied) And in the Indenture now in recital is contained a power for the said Frederick Mellersh and Edward Joseph Halsey or the survivor of them or the Executors or Administrators of such survivor during the life of any person thereby made tenant for life with his consent in writing to sell all or any of the said premises in manner therein mentioned And by the Indenture now in recital the said Henry William Richard Westgarth Halsey consented to surrender among other hereditaments the copyhold hereditaments hereinafter described and intended to be hereby conveyed into the hands of the Lord of the Manor of Bisley To the use of the said Frederick Mellersh and Edward Joseph Halsey their heirs and assigns to be held at the Will of the Lord according to the custom of the said Manor And it is by the Indenture now in recital declared that the said Frederick Mellersh and Edward Joseph Halsey or the survivor of them his heirs or their or his assigns should hold the said last mentioned hereditaments Upon and for such trusts intents and purposes and with and subject to such powers provisoes and declarations thereinbefore limited and declared of and concerning the hereditaments thereinbefore appointed or intended so to be as the different tenure and quality of the premises would permit but not so as to increase or multiply charges or powers of charging And whereas at a Court held for the said Manor of Bisley on the second day of December one thousand eight hundred and eighty the said Henry William Richard Westgarth Halsey surrendered into the hands of the Lord of the said Manor the copyhold hereditaments hereinafter described and intended to be hereby conveyed To the use of the said Frederick Mellersh and Edward Joseph Halsey their heirs and assigns according to the custom of the said Manor Upon and for the trusts intents and purposes and with and subject to the provisoes and declarations expressed and declared or referred unto of and concerning the same copyhold hereditaments by the hereinbefore recited Indenture And whereas by an Indenture dated the third day of June One thousand eight hundred and eighty six and expressed to be made between the said Joseph Tenison Halsey of the one part and the said John Moxon Daborn Robert John Porcher Broughton and Frederick Peake (thereinafter called the Mortgagees) of the other part the said Henry Joseph Tenison Halsey demised unto the Mortgagees among other hereditaments the Freehold hereditaments hereinafter described and intended to be hereby conveyed To hold the same unto the Mortgagees for the term of Ninety nine years from the date of the Indenture now in recital of the said Henry Joseph Tenison Halsey should so long live subject to such of the several charges affecting the same as were still subsisting and had not determined or been discharged as aforesaid and subject also to the proviso for redemption thereinafter contained And by the Indenture now in recital the said Henry Joseph Tenison Halsey assigned unto the said Mortgagees among other things the life estate and interest of him the said Henry Joseph Tenison Halsey of and in the copyhold hereditaments hereinafter described and intended to be hereby conveyed To hold the same unto the Mortgagees subject to such of the several charges and incumbrances as were still subsisting and had not determined and been discharged as aforesaid And also subject to a proviso for redemption of all the said premises on payment by the said Henry Joseph Tenison Halsey or the person deriving title under him of the sum of Six thousand five hundred pounds with interest at the rate and on the day therein mentioned And whereas by an Indenture dated the ninth day of March One thousand eight hundred and eighty nine and made between the said Henry Joseph Tenison Halsey of the one part and the said John Moxon Daborn Robert John Porcher Broughton and Frederick Peake (thereinafter called the Mortgagees) of the other part the said Henry Joseph Tenison Halsey further charged the hereditaments then remaining subject to the last recited Indenture with the payment to the Mortgagees of the sum of Five hundred pounds with interest thereon at the rate and on the day therein mentioned And whereas at a Court held for the said Manor of Bisley on the thirtieth day of July One thousand eight hundred and eighty six the said Frederick Mellersh and Edward Joseph Halsey were admitted tenants to the copyhold hereditaments hereinafter described and intended to be hereby conveyed To hold the same unto the said Frederick Mellersh and Edward Joseph Halsey their heirs and assigns according to the custom of the said Manor Upon and for the trusts intents and purposes and with under and subject to the powers provisoes and declarations expressed of and concerning the same premises in and by the hereinbefore firstly recited Indenture And whereas the said Caroline Halsey died on the twenty ninth day of September One thousand eight hundred and eighty six And whereas the said Henry Joseph Tenison Halsey in exercise of the power given to a tenant for life by the Settle Land Act 1882 has agreed with the said Earl of Wemyss and March Duke of Westminster and Earl Spencer for the sale to them at the price of Ten thousand and five hundred pounds of the freehold hereditaments hereinafter described and intended to be hereby conveyed for an estate of inheritance in fee simple in possession free from incumbrances and of the copyhold hereditaments hereinafter described and intended to be hereby conveyed for an estate of inheritance according to the custom of the said Manor of Bisley free from incumbrances except the rents fines heriots suits and services therefore due and of right accustomed And whereas the said sums of Six thousand five hundred pounds and Five hundred pounds together with current interest are still owing to the said John Moxon Daborn Robert John Porcher Broughton and Frederick Peake upon the security of the hereinbefore recited Indenture of Mortgage and further Charge and they have agreed to join in these presents in manner hereinafter appearing And whereas the said Henry Joseph Tenison Halsey has at the request of the said Earl of Wemyss and March Duke of Westminster and Earl Spencer agreed to convey the said copyhold hereditaments hereinafter described in manner hereinafter appearing Now this Indenture Witnesseth that in pursuance of the said Agreement and for affectuating the sale and in consideration of the sum of Ten thousand and five hundred pounds to the said Frederick Mellersh and Edward Joseph Halsey as such trustees as aforesaid at or before the execution of these presents paid by the said Earl of Wemyss and March Duke of Westminster and Earl Spencer (out of monies belonging to them upon a joint account) (the receipt whereof the said Frederick Mellersh and Edward Joseph Halsey do hereby acknowledge) He the said Henry Joseph Tenison Halsey by virtue of the power in this behalf given to a tenant for life by the Settled Land Act 1882 and of every other power in anywise enabling him in this behalf and with the concurrence of the said John Moxon Daborn Robert John Porcher Broughton and Frederick Peake as such Mortgagees as aforesaid and as beneficial owner  Doth hereby convey unto the said Earl of Wemyss and March Duke of Westminster and Earl Spencer  All and singular the cottages tenements lands and hereditaments situate partly in the parish of Pirbright and partly in the parish of Chobham in the County of Surrey more particularly described in the first part of the first schedule hereto (the description in the first and second columns of such first part being the description taken from the Tithe Commutation Award of the said Parishes and the numbers and quantities in the third and fourth columns of such first part being taken from the Ordnance Survey of the said parishes) and delineated in the plan drawn on these presents and thereon colored red

To have and To hold the said hereditaments and all other the premises hereinbefore conveyed or expressed and intended so to be Unto and to the use of the Earl of Wemyss and March Duke of Westminster and Earl Spencer as joint tenants in fee simple freed and discharged from all claims and demands under the hereinbefore recited Indenture of Mortgage and Further Charge of the third day of June One thousand eight hundred and eighty six and the ninth day of March One thousand eight hundred and eighty nine respectively but subject to all rights of way and other easements (if any) And this Indenture also witnesseth that in further pursuance of the said Agreement and for affectuating the sale and in consideration of the said sum of Ten thousand and five hundred pounds so paid as aforesaid He the said Henry Joseph Tenison Halsey by virtue of the power in this behalf given to a tenant for life by the Settled Land Act 1882 and of every other power in anywise enabling him in this behalf and by the direction of the said Duke of Westminster and Earl Spencer and with the concurrence of the said John Moxon Daborn Robert John Porcher Broughton and Frederick Peake as such Mortgagees as aforesaid and as beneficial owner  Doth hereby convey unto the said Earl of Wemyss and March and his heirs All and singular the lands and hereditaments situate in the parish of Bisley in the County of Surrey more particularly described in the second part of the first schedule hereto (the description in the second column of such second part being the description on the Court Rolls of the said Manor and the numbers and quantities in the third and fourth columns of such second part being taken from the Ordnance Survey of the said parish) and delineated on the plan drawn on these presents and thereon colored Blue being copyhold of the said Manor of Bisley and being the lands to which the said Frederick Mellersh and Edward Joseph Halsey were so admitted as aforesaid To have and To hold the said hereditaments and all other the premises lastly hereinbefore conveyed or expressed and intended so to be Unto and to the use of the said Earl of Wemyss and March for an estate if inheritance according to the custom of the said Manor of Bisley by and under the rents fines heriots suits and services therefore due and of right accustomed freed and discharged from all claims and demands under the hereinbefore recited Indentures of Mortgage and Further Charge of the third day of June One thousand eight hundred and eighty six and the ninth day of March One thousand eight hundred and eighty nine respectively but subject to all rights of way and other easements (if any) Provided always and it is hereby declared that as respects the reversion or remainder expectant on the life estate of the said Henry Joseph Tenison Halsey in the said premises and the title to and further assurance of the said premises after his death the covenants on his part in these presents implied shall not extend to the acts deeds or default of any person or persons other than or besides himself and his own heirs and persons claiming or to claim through or in trust for him them or some of them And the said Henry Joseph Tenison Halsey retaining possession of the documents of title specified in the second schedule hereto doth hereby acknowledge the right of the said Earl of Wemyss and March Duke of Westminster and Earl Spencer to production of the same documents and to delivery of copies thereof and hereby undertaken for the safe custody thereof And the said John Moxon Daborn Robert John Porcher Broughton and Frederick Peake hereby acknowledge the right of the said Earl of Wemyss and March Duke of Westminster and Earl Spencer to production of the recited Indentures of Mortgage and Further Charge and to delivery of copies thereof  In Witness whereof the said parties to these presents have hereunto set their hands and seals the day and year first above written.

At a Special Court Baron of The Right Honorable William Hillier Earl of Onslow Lord of the said Manor held for the said Manor on Tuesday the twenty fourth day of December in the fifty third year of the Reign of Our Sovereign Lady Victoria by the Grace of God of the United Kingdom of Great Britain and Ireland Queen Defender of the Faith and in the year of our Lord one thousand eight hundred and eighty nine Before Humphrey Percy Smallpeice Gentleman Deputy of  Frederic Ferdinand Smallpeice Gentleman Chief Steward there.

At this Court came here into Court The Right Honorable Francis Charteris Earl of Wemyss and March by Thomas Edmonds his Attorney and produced to the said Deputy Steward a certain Indenture of conveyance bearing date the twenty ninth day of July One thousand eight hundred and eighty nine made between Henry Joseph Tenison Halsey of the first part John Moxon Daborn Robert John Porcher Broughton and Frederick Peake of the second part Frederick Mellersh and Edward Joseph Halsey of the third part the said Earl of Wemyss and March The Most Noble Hugh Lupus Duke of Westminster and The Right Honourable John Poyntz Earl Spencer of the fourth part and the said Earl of Wemyss and March of the fifth part which Indenture has been enrolled upon the Court Rolls of this Manor.

Whereupon at this Court on the first proclamation came here again into Court the said Earl of Wemyss and March by his said Attorney and humbly prayed to be admitted tenant to All those several parcels of Arable and Wood lands situate in Bisley and held of the said Manor Known by the names and numbers and containing by admeasurement the quantities following that is to say Longmead formerly described as containing Three acres three roods and eighteen perches but now found to contain Two acres three roods and twenty three perches or thereabouts and numbered 275 on the Tithe Map of the parish of Bisley aforesaid and numbered 218 on the Ordnance Map of the said parish The Five acres formerly described as containing seven acres and twenty eight perches but now found to contain seven acres and twenty one perches or thereabouts and numbered 282 on the said Tithe Map and 227 on the said Ordnance Map The Six acres formerly described as containing Five acres three roods and twenty six perches but now found to contain Six acres and nineteen perches or thereabouts and numbered 283 on the said Tithe Map and 226 on the said Ordnance Map Miles Green and Corner Field formerly described as two closes containing Five acres and three perches and two acres three roods and five perches respectively but now one close and found to contain Eight acres one rood and four perches or thereabouts and numbered 331 and 332 on the said Tithe Map and 185 on the said Ordnance Map Oakfield formerly described as containing Six acres and two perches but now found to contain Five acres three roods and four perches or thereabouts and numbered 335 on the said Tithe Map and 179 on the said Ordnance Map and the Four acres formerly described as containing Four acres one rood and thirty one perches but now found to contain Four acres two roods and four perches or thereabouts and numbered 334 on the said Tithe Map and 178 on the said Ordnance Map pursuant to the said conveyance To whom the Lord of the Manor aforesaid by his Deputy Steward aforesaid granted the same and delivered seizin thereof by the rod  To hold to the said Earl of Wemyss and March his heirs and assigns for ever by Copy of Court Roll at the Will of the Lord according to the custom of the said Manor by the yearly rent of three shillings and ten pence Heriot certain Four pounds on the death of every tenant suit of Court and other services and customs therefore formerly due and of right accustomed And so he was by his said Attorney admitted tenant thereof in form aforesaid Gave to the Lord as a fine for such her admittance as appears in the margin [£49 10s] and his fealty was respited.

Know all Men by these Presents that we Edward Elsdale Clark of Snaith in the County of York Gentleman and Marshall Pontifex of St. Andrews Street Holborn Circus in the City of London Gentleman Do hereby appoint Alfred Markby of No. 9 New Square Lincolns Inn in the County of London Solicitor and Spencer Broughton Wilde of the same place Solicitor and Charles Plumptre Johnson of the same place Solicitor Jointly and each of them severally the Attorneys and Attorney of us the said Edward Elsdale Clark and Marshall Pontifex to appear at the next or any subsequent Court to be holden for the Manor of Bisley in the County of Surrey or before the Lord or Lords Lady or Ladies or Steward or Deputy Steward of the said Manor out of Court and then and there to surrender into the hands of the said Lord or Lords Lady or Ladies either personally or by the hands and acceptance of the said Steward or Deputy Steward by the Rod according to the custom of the said Manor All those the copyhold or customary lands described in the Memorandum of Surrender hereto annexed  To the use of The Right Honourable Francis Charteris Earl of Wemyss and March his heirs and assigns according to the custom of the  said Manor as in such Memorandum of Surrender expressed And to execute and do all such further assurance and things as shall be necessary or proper for procuring the said Right Honourable Francis Charteris Earl of Wemyss and March his heirs or assigns to be admitted Tenant or Tenants of the said premises And we the said Edward Elsdale Clark and Marshall Pontifex hereby severally declare that these Presents shall be irrevocable for six calendar months from the date hereof In witness whereof we the said Edward Elsdale Clark and Marshall Pontifex have hereunto severally set our hands and seals the ninth day of August One thousand eight hundred and eighty nine - Edward Elsdale Clark  Marshall Pontifex ~ Signed Sealed and Delivered by the above named Edward Elsdale Clark in the presence of Arthur Hornes Clerk to Messieurs E & J Clark Solicitors Snaith - Signed Sealed and Delivered by the above named Marshall Pontifex in the presence of James Bailey Clerk to Mess.rs Pontifex Hewitt & Pitt Solicitors St Andrews Street Holborn Circus London.

At a Special Court Baron of The Right Honorable William Hillier Earl of Onslow Lord of the said Manor held for the said Manor on Tuesday the twenty fourth day of December in the fifty third year of the Reign of Our Sovereign Lady Victoria by the Grace of God of the United Kingdom of Great Britain and Ireland Queen Defender of the Faith and in the year of our Lord one thousand eight hundred and eighty nine Before Humphrey Percy Smallpeice Gentleman Deputy of  Frederic Ferdinand Smallpeice Gentleman Chief Steward there.

Absolute Surrender Edward Elsdale Clark and Marshall Pontifex to The Right Honorable The Earl of Wemyss and March
At this Court came here into Court The Right Honorable Francis Charteris Earl of Wemyss and March by Thomas Edmonds his Attorney and delivered to the said Deputy Steward a certain Absolute Surrender taken out of Court and since the last General Court to wit on the nineteenth day of August One thousand eight hundred and eighty nine Whereby Edward Elsdale Clark of Snaith in the County of York Gentleman and Marshall Pontifex of St. Andrews Street Holborn Circus in the City of London Gentleman two of the Copyhold or Customary Tenants of this Manor by Charles Plumptre Johnson of No 9 New Square Lincolns Inn in the County of London Solicitor their Attorney in consideration of Seven hundred pounds paid to them for the purchase of the tenements thereinafter mentioned and in pursuance of a covenant on the part of the said Edward Elsdale Clark and Marshall Pontifex contained in an Indenture dated the  _______ day of ____________ One thousand eight hundred and eighty nine and made between the said Edward Elsdale Clark and Marshall Pontifex of the first part Sarah Shereburn of the second part the said Francis Charteris Earl of Wemyss and March The most Noble Hugh Lupus Duke of Westminster and the Right Honorable John Poyntz Earl Spencer of the third part and the said Francis Charteris Earl of Wemyss and March of the fourth part did surrender into the hands of the Lord of the said manor by the rod by the acceptance of the said Deputy Steward All those three pieces of land situate in the parish of Bisley in the County of Surrey containing together fifteen acres one rood and two perches or thereabouts and being N.d 111, 112 and 123 on the Ordnance Survey and delineated on the plan drawn in the margin of the said surrender and thereon colored blue (such plan being a copy of the Ordnance Map) (the same being part of the tenements to which the said Edward Elsdale Clark and Marshall Pontifex were admitted at a Special Court Baron held for this Manor on the thirtieth day of May One thousand eight hundred and seventy three) To the use of the said Francis Charteris Earl of Wemyss and March his heirs and assigns according to the custom of this Manor by and under the rents fines heriot and services  therefore due and of right accustomed.

And thereupon at this Court upon the first proclamation came here into Court the said Francis Charteris Earl of Wemyss and March by his said Attorney and humbly prayed to be admitted tenant to All those the said three pieces of land situate in the parish of Bisley in the County of Surrey containing together fifteen acres one rood and two perches or thereabouts and being N.d 111, 112 and 123 on the Ordnance Survey and delineated on the plan drawn in the margin of the said surrender of the nineteenth day of August One thousand eight hundred and eighty nine and thereon colored blue (such plan being a copy of the Ordnance Map) in pursuance of the said surrender To whom the Lord of the Manor aforesaid by his Deputy Steward aforesaid granted the same To hold to him the said Francis Charteris Earl of Wemyss and March his heirs and assigns for ever by Copy of Court Roll at the Will of the Lord according to the custom of the said Manor by the yearly rent to be apportioned Heriot when it shall happen suit of Court and other services and customs therefore formerly due and of right accustomed And so the said Francis Charteris Earl of Wemyss and March was by his said Attorney admitted tenant of the said premises accordingly Gave to the Lord as a fine for such his admittance as appears in the margin [£15] had seizin by the rod and his fealty was respited.
