Conditional Surrender Joshua Turner to Samuel Higgott
Be it remembered that on the sixth day of April in the year of our Lord one thousand eight hundred and fifty three Joshua Turner of Chobham in the County of Surrey Laborer one of the copyhold or Customary Tenants of the said Manor personally came before Joseph Hockley Gentleman Steward of the Courts of the said Manor out of Court and in consideration of the sum of fifty pounds of lawful money of the United Kingdom of Great Britain and Ireland of English Value and Currency to him the said Joshua Turner in hand paid by Samuel Higgott of Bagshot in the said County of Surrey Innkeeper at or immediately before the making of this Surrender  Hath Surrendered and Doth Surrender into the hands of the Lord of the said Manor by the rod and by the acceptance of the said Steward and according to the custom of the said Manor All that one acre of land lying (in two several pieces) in the Common field called Burcroft within the said Manor And also All that one acre of land lying in the Common field called Widecroft abutting on the land now or late of Mrs Geale on the South part to land now or late of William Eacott on the north and the inclosed land now or late of James Loveland on the West and East with the appurtenances to which said premises the said Joshua Turner was admitted tenant at a General Court Baron held for the said Manor on the sixteenth day of April one thousand eight hundred and forty four on the death of his brother Thomas Turner and the reversion and reversions remainder and remainders rents issues and profits thereof And all the Estate right title interest property possession claim and demand whatsoever of him the said Joshua Turner of into or out of the said premises or any part or parcel thereof  To the only proper and absolute use and behoof of the said Samuel Higgott his heirs and assigns for ever according to the custom of the said Manor subject nevertheless to the proviso or Condition hereinafter Contained (that is to say) Provided always and upon this condition nevertheless that if the said Joshua Turner his heirs executors administrators or assigns do and shall well and truly pay or cause to be paid unto the said Samuel Higgott his executors administrators or assigns the full sum of fifty pounds of lawful money of the United Kingdom of Great Britain and Ireland of English Value and Currency (being the same principal money as is secured or intended to be secured by a Certain Mortgage or Conditional Surrender of certain Copyhold Premises lying in the manor of Chobham in the said County of Surrey made by the said Joshua Turner to the said Samuel Higgott on the day of the date hereof) with interest for the same after the rate of five pounds for one hundred pounds for a year upon the sixth day of October now next ensuing without fraud or delay and without making any deduction or abatement out of the same for or on account of any manner of taxes payments or impositions or any other matter cause or thing whatsoever then this Surrender to be void and of no effect otherwise to be and remain in full force and virtue  X The mark of Joshua Turner. This Surrender was taken the day and year first above written by the acceptance of me Joseph Hockley Steward  in the presence of Edw.d Cha.s Quilley Received the day and year first above written of and from the above named Samuel Higgott the sum of fifty pounds being the consideration money above mentioned to be paid by him to me £50  X The mark of Joshua Turner  Witness Edw.d Cha.s Quilley.
[Margin note: Be it Remembered that Samuel Higgott in this Surrender named did by writing under his hand bearing date the twenty ninth day of September one thousand eight hundred and sixty nine acknowledge to have had and received all principal money and interest due and owing to him upon and by virtue of this Surrender And did thereby authorize and require me to enter his acknowledgement of satisfaction upon the Court Rolls or Books of the said Manor and to vacate the same Surrender and which I have done accordingly.
