Recital of the Will of James Nesmyth

Be it remembered that on the fifth day of July in the year of our Lord one thousand eight hundred and forty three Henry Knowls of Number 8 Lower Grove Street Sloane Square in the County of Middlesex carpenter (the eldest son of Henry Knowls the elder late of Horsell in the County of Surrey Butcher deceased by Mary his Wife before her Marriage Mary Smyth Spinster the only child of William Smyth late of Bisley in the said County of Surrey Farmer by Mary his Wife late copyhold Tenants of this Manor) came before Joseph Hockley Gentleman Steward of the Courts of the said Manor out of Court and produced to the Steward a copy of the last Will and Testament of James Nesmyth late of Chobham in the said county of Surrey Yeoman deceased bearing date the tenth day of November one thousand eight hundred and four Whereby he devised as follows “I give devise and bequeath unto William Smyth and Mary his Wife of Bisley in the said County and to the Survivor of them during their natural lives And then I give and devise the same to Mary their Daughter or if more children by Mary the said Wife of William Smyth equal between them and in case they leave no Children to their heirs and assigns for ever All that my freehold house lands and premises called or known by the name of the Hen and Chickens in Bisley aforesaid And also all that my copyhold Estate containing by estimation twenty six acres situate in Bisley aforesaid and now in the occupation of the said William Smyth and which I have Surrendered to the Use of my Will”

Admittance of Henry Knowls

and it appearing to the said Steward by a Presentment made at a Court Baron holden in and for the said Manor on the thirtieth day of September one thousand eight hundred and twenty eight that the said William Smyth and Mary his Wife and the said Mary their daughter afterwards the Wife of the said Henry Knowls the elder have severally departed this life Thereupon the said Henry Knowls the Son prayed of the Lord of this Manor to be admitted Tenant to All those copyhold Lands arable meadow and pasture with the appurtenances containing by estimation nineteen acres more or less in the Parish of Bisley Which came into the hands of the Lord of this Manor on the death of the said William Smyth  To whom the Lord of the Manor aforesaid by his Steward aforesaid granted the same and delivered Seizin thereof by the Rod  To hold to the said Henry Knowls the Son and the heirs of his Body and for all other his estate and interest therein under the Will of the said James Nesmyth or otherwise by Copy of Court Roll at the Will of the Lord according to the custom of the said Manor by the yearly rent of three Shillings and four pence Heriot when it shall happen Suit of Court and other services and customs therefore formerly due and of right accustomed and so he was admitted Tenant thereof in form aforesaid  but he paid no fine to the Lord because his admittance was for further assurance only and his fealty was respited.

And the said Henry Knowls the Son further prayed of the Lord to be admitted Tenant to one parcel of Land called Loompitts containing by estimation six acres in the said Parish and Manor of Bisley which also came into the hands of the Lord of this Manor on the death of the said William Smyth  To whom the Lord of the Manor aforesaid by his Steward aforesaid granted the same and delivered Seizin thereof by the Rod  To hold to the said Henry Knowls the Son and the heirs of his Body and for all other his estate and interest therein under the said Will of the said James Nesmyth deceased or otherwise by Copy of Court Roll at the Will of the Lord according to the custom of the said Manor by the yearly rent of four pence Heriot when it shall happen Suit of Court and other services and customs therefore formerly due and of right accustomed and so he was admitted Tenant thereof in form aforesaid  He paid no fine to the Lord for the reason aforesaid and his fealty was respited.

 

Absolute Surrender Henry Knowls to John Knowls & James Steadman

And afterwards on the day and year first above written came before the said Steward in his proper person the said Henry Knowls the Son and intending to make a disposition for the purposes of barring docking and extinguishing all estates tail of him the said Henry Knowls the Son in the Copyhold hereditaments hereinafter mentioned to be surrendered over expectant or depending thereon and in order to vest the said hereditaments in John Knowls of Horsell aforesaid Farmer and James Stedman of Horsell aforesaid Farmer (the devisees in trust named in and appointed by the last Will and Testament of the said William Smith) their heirs and assigns for ever Upon the trusts hereinafter declared concerning the said premises and in consideration of  ten shillings to him paid by the said John Knowls and James Stedman surrendered into the hands of the Lord of this Manor by the rod and by the acceptance of the said Steward according to the custom of the said Manor All those copyhold lands arable meadow and pasture with the appurtenances containing by estimation six acres in the said parish and manor of Bisley to which he had immediately before been admitted To the Use of the said John Knowls and James Stedman their heirs and assigns for ever freed and discharged of and from all estates tail of the said Henry Knowles the Son therein and all remainders reversions and limitations over expectant or depending thereupon But nevertheless upon and for the trusts intents and purposes hereinafter mentioned

Whereupon the said John Knowls and James Stedman in their proper persons prayed to be admitted to All those copyhold lands arable meadow and pasture with the appurtenances containing by estimation nineteen acres more or less in the said parish of Bisley in pursuance of the said Surrender  To whom the Lord of the Manor aforesaid by his Steward aforesaid granted the same and delivered Seizin thereof by the Rod  To hold to the said John Knowls and James Stedman their heirs and assigns for ever But nevertheless upon and for such and the like trusts intents and purposes and with under and subject to such and the like powers provisoes and declarations which in and by the last Will and Testament of the said William Smith deceased are expressed and declared of and concerning the copyhold hereditaments hereby devised by Copy of Court Roll at the Will of the Lord according to the custom of the said Manor by the yearly rent of three Shillings and four pence Heriot when it shall happen Suit of Court and other services and customs therefore formerly due and of right accustomed and so they were admitted Tenants thereof in form aforesaid  but they paid no fine to the Lord this admittance being for further assurance only and their fealties were respited.
