Release David Stevens and others to John Mose
This Indenture made the twenty eighth day of April in the year of our Lord One thousand eight hundred and forty seven Between David Stevens of Chobham in the County of Surrey Farmer and Ann his Wife formerly Ann Mose Spinster Edmund Nicholls of Bagshott in the same County Currier and Mary his Wife formerly Mary Mose Spinster William Mose of Chobham aforesaid Blacksmith Frances Mose of Weybridge in the said County of Surrey Spinster Sarah Mose of Chobham aforesaid Spinster James Mose of the same place Blacksmith Thomas Mose of the same place Baker and Ellen Mose of the same place Spinster and which said Ann Stevens Mary Nicholls William Mose Frances Mose Sarah Mose James Mose Thomas Mose and Ellen Mose are with John Mose the younger hereinafter mentioned the only children now living of John Mose of Chobham aforesaid Blacksmith hereinafter called John Mose the elder of the first part the said John Mose the elder of the second part and John Mose the younger of Bisley in the County of Surrey Blacksmith the eldest son of the said John Mose the elder of the third part Whereas John Mose late of the Parish of Chobham aforesaid duly signed and published his last Will and Testament in writing bearing date the twenty fourth day of May one thousand eight hundred and sixteen and thereby among other devises and bequests devised in the words and manner following that is to say “I give and bequeath to my daughter Grace Mose all my land lying in the Parish of Bisley called Gates amounting to about Ten acres and also my mead lying at Stafford Lake in the parish of Wokeing amounting to about two acres both which on condition of Grace Moses paying her Sister Elizabeth Lush five pounds per year during her natural life and also five pounds to each of Elizabeth Lush’s Children as they become of age and provided my Daughter Grace Mose dies without issue my Will is the land and all her right subject to the same Conditions to go immediately to my Grand daughter Martha Mose and to be sold when she come of age and the produce equally divided among all her brothers and sisters” And whereas the said John Mose the Testator departed this life in the month of June One thousand eight hundred and twenty two without having altered or revoked his said Will so far as respects the said recited Devise of the said copyhold hereditaments therein contained and leaving the said John Mose the elder his only son and customary heir and several grandchildren including the said Martin Mose issue of the said John Mose the elder him surviving And whereas the said Grace Mose departed this life shortly after the decease of the said Testator her father without having been married and without having been admitted to the said copyhold hereditaments so devised to her as aforesaid And whereas at a Court Baron held for the Manor of Bisley aforesaid on the twenty sixth day of November one thousand eight hundred and twenty four the said Martha Mose was admitted tenant of the same Copyhold hereditaments so devised to her in remainder as aforesaid to hold the same to the said Martha Mose her heirs and assigns for ever upon and subject to the trusts mentioned in the said Will of the said John Mose the Testator by Copy of Court Roll at the Will of the Lord according to the custom of the said Manor and by the rents and services therefore due and of right accustomed And whereas Martha Mose lived to attain her age of twenty one years And whereas the said John Mose the younger Ann Stevens Mary Nicholls William Mose Frances Mose Sarah Mose James Mose Thomas Mose and Ellen Mose were the only brothers and sisters of the said Martha Mose And whereas the said Martha Mose departed this life in the year One thousand eight hundred and twenty eight Intestate and without having been married and leaving the said John Mose the younger her eldest brother and heir at law and also her customary heir according to the custom of the said Manor and whereas at a Court Baron held for the said Manor of Bisley on the twenty sixth day of April One thousand eight hundred and thirty one the said John Mose the younger was admitted tenant of the said Copyhold hereditaments to hold the same to the said John Mose the younger his heirs and assigns for ever upon and subject to the trusts mentioned in the said Will of the said John Mose the Testator by Copy of Court Roll at the Will of the Lord according to the custom of the said Manor and by the rents and services therefore due and of right accustomed And whereas the said Elizabeth Lush departed this life in the month of February one thousand eight hundred and forty six And whereas the said Annuity of Five pounds was duly paid to the said Elizabeth Lush during her life and the legacies of five pounds to each of her children as they became of age have been duly paid and satisfied And whereas the said John Mose the younger hath contracted and agreed with the said David Stevens and Ann his Wife Edmund Nicholls and Mary his Wife William Mose Frances Mose Sarah Mose James Mose Thomas Mose and Ellen Mose for the absolute purchase of their respective shares and interests under the said Will of the said John Mose the Testator in the said Copyhold hereditaments hereinafter released and in the monies to arise or be produced by the sale thereof at or for the price or sum of Two hundred pounds to be divided into eight equal parts or shares of Twenty five pounds each And whereas the said John Mose the elder as the Customary heir of the said John Mose the Testator has agreed to join in the Release hereinafter contained for better confirming the Title of the said John Mose the younger to the same hereditaments Now this Indenture witnesseth that in pursuance of the said Agreement and in consideration of the Sum of Twenty five pounds of lawful money of Great Britain to the said David Stevens and Ann his Wife and of the like Sum of Twenty five pounds to the said Edmund Nicholls and Mary his Wife and of the like Sum of Twenty five pounds to each of them the said William Mose Frances Mose Sarah Mose James Mose Thomas Mose and Ellen Mose by the said John Mose the younger at or before the sealing and delivering of these presents in hand well and truly paid the receipts of which several Sums of Twenty five pounds Twenty five pounds Twenty five pounds Twenty five pounds Twenty five pounds Twenty five pounds Twenty five pounds and Twenty five pounds making together the sum of Two hundred pounds they the said David Stevens and Ann his Wife Edmund Nicholls and Mary his Wife William Mose Frances Mose Sarah Mose James Mose Thomas Mose and Ellen Mose do hereby respectively admit and acknowledge and declare the same to be the full consideration money for the absolute purchase of their respective shares and interests in the said Copyhold hereditaments hereinafter released and confirmed and the monies to be produced by the sale thereof and of and from the same respective sums of twenty five pounds each and every part thereof do respectively acquit release and discharge the said John Mose the younger his heirs executors administrators and assigns for ever by these presents and also in consideration of the sum of Ten shillings of like lawful money as aforesaid by the said John Mose the younger to the said John Mose the elder in hand paid the receipt whereof is hereby acknowledged They the said David Stevens and Ann his Wife Edmund Nicholls and Mary his Wife William Mose Frances Mose Sarah Mose James Mose Thomas Mose and Ellen Mose according to their respective estates and interests in the copyhold hereditaments hereinafter released and confirmed have and every of them hath released quit claimed and confirmed and by these presents Do and every of them Doth release quit claim, and confirm and he the said John Mose the elder as such customary heir of the said John Mose the Testator Hath released and quit claimed and by these presents Doth release and quit claim unto the said John Mose the younger and his heirs All that messuage or tenement with the Blacksmiths shop and edifices belonging with the appurtenances called or known by the name of Paynes one close of Land by estimation four acres one close of Land by estimation three acres one piece of land called Brook Plot by estimation one acre and one piece of land heretofore a Wood by estimation one acre at Knaphill adjoining to Hankmore Coppice with the appurtenances in Bisley aforesaid being the hereditaments so devised in and by the said recited Will of the said John Mose the Testator in the event of the death of the said Grace Mose without issue to the said Martha Mose and to be sold when she came of age for the benefit of all her brothers and sisters as hereinbefore recited and all other the hereditaments if any situate in the Manor and Parish of Bisley aforesaid comprised in the said recited devise in the said Will of the said John Mose the testator contained with their appurtenances And the reversion and reversions yearly and other rents issues and profits of the said hereditaments and every part thereof and all the estate right title interest reversion use trust possession property possibility claim and demand whatsoever both at law and in equity of them the said David Stevens and Ann his Wife Edmund Nicholls and Mary his Wife William Mose Frances Mose Sarah Mose James Mose Thomas Mose Ellen Mose and John Mose the elder and every of them in and to the same premises and every part and parcel thereof To have and to hold the said messuage or tenement lands hereditaments and all and singular other the premises hereinbefore released and confirmed or intended so to be freed and discharged from the trusts for sale in the said Will of the said John Mose the Testator contained and all claims and demands of them the said several persons parties hereto of the first part under or by virtue of the said Will or otherwise howsoever unto and to the use of the said John Mose the younger his heirs and assigns for ever of the Lord of the said Manor of Bisley by Copy of Court Roll at the Will of the said Lord according to the custom of the said Manor and by the rents and services therefore due and of right accustomed And he the said David Stevens as to the acts and deeds of himself and of the said Ann his wife and he the said Edmund Nicholls as to his own acts and deeds and the acts and deeds of the said Mary his Wife and each of them the said William Mose Frances Mose Sarah Mose James Mose Thomas Mose and Ellen Mose so far as respects his and her own respective acts and deeds only but not further or otherwise Doth herby for himself and herself his and her heirs executors and administrators covenant and declare with and to the said John Mose the younger his heirs and assigns that they the said David Stevens and Ann his Wife Edmund Nicholls and Mary his Wife William Mose Frances Mose Sarah Mose James Mose Thomas Mose and Ellen Mose have not at any time heretofore made done committed executed or knowingly permitted or suffered or been party or privy to any act deed matter or thing whatsoever whereby or by reason or means whereof the messuage or tenement land and other hereditaments hereby released and confirmed or expressed and intended so to be with their appurtenances or any part thereof are or is can shall or may be in anywise impeached charged affected or incumbered in title estate or otherwise howsoever In witness whereof the said parties to these presents have hereunto set their hands and seals the day and year first
